Mahomes is the best QB ever. I love how he runs with the pill often.

I’m no afficionado of the sport. Just a casual observer, but yeah my two cents worth.

It is all bollocks, but I am glad KC won. I used to work with a girl from KC. She was a bogan and good down to earth sheila. That is the USA I am keen for and interested in.

San Francisco can sod off. Poofters/woke and lots of unfortunate deros and druggos littering the streets. They are trying to revisit 1967, but doing a shit job at it.

Lee ruling on this cross claim today re costs ?
I missed that.
From yesterday they all seemed resigned to the fact that Channel 10 would dispute paying for “duplicate work”.
That’s another battle at some stage.

Lee said yesterday he’ll rule in the defamation case during March.

You’ve obviously read the daily abuse from woddenhead – last Thursdays count was a record 26 mindless and abusive comments in two hours and by Friday he denied it.

The trouble is, Junior Cretin, you are always the one who starts the abuse. As I have said before. Stand on a soap box and look in the mirror as it is not a good look. And your abuse of other posters started many years before I appeared on this Blog. And it continues.

You are a serious Offender.

You seem to have an inferiority complex. Short man Syndrome maybe.

My denial was in relation to being involved in the discussion and opinions around getting rid of the Up and Down thumbs. So I must have misunderstood your latest ranting.

3 days might a useful delay in bringing forth the new JC* accounts.

Cane Toad’s position is somewhat mitigated, but her liability won’t be fully extinguished.

Your lips to gods ear, but Im thinking the 10 lawyers have left them hugely exposed.

Who can blame the cane toad for engaging her own lawyers outside 10, when 10s lawyers have admitted in court they were trying to serve 2 different clients with different objectives.

Re transmission lines, AEMO says we’ll need 10 000km of new lines to integrate renewables with the existing eastern grid.

And it has to be done quickly.

A disaster waiting to happen, I fear.

A gentle understatement there, I fear.

In its simplest technical form, 10,000km of 275V transmission lines requires a minimum of 30,000km of heavy section aluminum conductor.

Assuming 2030 and the use of the less efficient old-style, steel core conductor, this would consume the entire bare conductor factory output of one of the World’s largest cable manufacturers (Shan Power Cable: 500km/month) for 5 years solid. Much longer (and more expensive again) if AEMO were to specify a First World, low-loss, smooth composite conductor.

The upshot is that Rewiring the Nation implicitly assumes someone, somewhere, will be building a large, dedicated (and oversized) cable factory at Australia’s expense. While we receive the rough end of the commercial pineapple because of the distressed conditions caused by the looming blackout catastrophe.

But, no doubt, Top Men have thought all this through.

Putin on Sanctions & the BRICS Boogeyman

“I do not advise governments to use sanctions for leverage due to the economic implications that may take time to materialize. In April 2020, I wrote, “Once you impose sanctions, you create a cold war. Look at Russia. Nixon opened China to divide and conquer. Are we really that stupid to close China and encourage them to join Russia in a cold war that will further destroy the world economy and most likely lead to real war?” The US and EU attempted to remove Russia from the global economy through sanctions and prohibiting them from the SWIFT network. Putin further explained in his interview with Tucker Carlson why this was a “grave mistake” for the future of the USD.

Using the dollar for political struggles dealt a blow to the USD that has not yet been felt. First, freezing the assets of Russians sent a signal to the whole world that the USD may not be the safest place to park your money if you happen to be in an “unfriendly” nation. Even our own allies have begun downsizing their dollar reserves.

The SWIFT system was never meant to be used as a political instrument. The West began looking into ways to remove Russia from this payment system back in 2014, and when they finally did, Russia began processing its payments elsewhere. Putin also correctly stated in the interview that China, not Russia, is the larger threat to the West in terms of size, population, manufacturing, and, most importantly, the growing power of the yuan.

The BRICS alliance is stronger than ever before as nations are collaborating without the need for the dollar. This does NOT mean that they are planning to replace the dollar, a myth that Putin termed the “BRICS boogeyman” as the Western media portrays the organization as a major threat to global security. However, this does mean that the yuan will grow in strength, as we have seen with the slow death of the petrodollar. The BRICS partnership means that members are no longer dependent on Western energy, and eventually, no one will be dependent on Western trade or debt. Only a fool would buy their enemy’s debt and expect to receive anything in return. Again, this will happen on target cyclically as nothing remains forever. The dollar overpowered sterling, and the yuan is next in line.

There are boogeyman fables that cooperation with China will lead to the destruction of the West, yet that is happening as a result of our leaders abandoning all domestic policies for globalization. Every nation in the EU and North America has made decisions that directly hurt its own economy but are beneficial to the coming globalization that they wish to bring forth, as stated every year at Davos.

“You can’t choose your neighbors like you can’t choose relatives,” Putin stated in regards to China, “We have a centuries-long history of coexistence.” He correctly stated that China always looks for compromise. They are an independent nation that has not fallen to the globalist agenda and there are not neocons within the ranks looking to bring China into perpetual warfare. The media is afraid of the “no limits” alliance between Russia and China, but look at how China has remained relatively neutral since the war in Ukraine began when they could have easily aided their neighbor. Furthermore, Europe is now closer economically to China than Russia is, as Europe is desperate for solutions to its economic issues and sees China as an opportunity.

Putin stated numerous times that US analysts are the ones discussing these problems, and he is simply repeating what he has read. I have not personally advised Putin, but I do believe his people read our work as he was attempting to explain cycles. “It is like the rise of the sun. You cannot prevent the sun from rising. You must adapt to it,” he said as one analogy. Cycles, indeed, are the operating system behind absolutely everything. Civilization does not change; war and periods of economic decline are inevitable. We can merely observe and learn from the trends to adapt accordingly.”

CH10 external lawyerette struggling already

Lawyerette being thrown under a bus by a network that thought it could trust an exoerienced journalist not to publish an actionable slander live on air (which she subsequently did).

Tom, I think it is a bit of a stretch to suggest that Ten was blindsided by Cane Toad going off reservation and delivering an ad-hoc accusation on air.
There are two separate incidents and two separate lady lawyers involved.
Incident 1 – The initial Project Broadcast. This wasn’t an unscripted improvised jam session by Cane Toad and Britnah. The whole chain of command through production right up to the Executive floor knew about it and were all-in. I think a number of people are accountable including Exec VP Beverley McGarvie and the odious turd Project EP Angus Llewellyn. However, along with Wilkinson, the one I hold most accountable is the self-styled “hard bitten newsman” and legend in his own lunchtime Peter Meakin. At the age of 81, and running a flea-bitten news outfit which trailed badly behind his old employers (Nein and Seven), he was keen to show he was still top of the heap, and this blinded his judgement.
Incident 2 – The Loggies Speech. Yes, Wilkinson carries the can for this and deservedly so but, again, this wasn’t something she scribbled on a beer coaster on the plane on the way to the Loggies. It had been vetted and ticked off by Ten’s lawyers (see below) and McGarvie’s glowing review afterwards didn’t give the impression that she was surprised or disappointed in the speech.
Lady Lawyer 1 – Ten’s inhouse lawyer. The fact that she finds herself under a bus is a circumstance entirely of her own making. Giving legal clearance to the initial broadcast was sailing close to the wind, but maybe legally defensible. Greenlighting the Loggies speech was something else altogether. She should have warned that it would be in contempt. She didn’t. And her career is damaged beyond repair, which is entirely appropriate.
Lady Lawer 2 – Partner in Ten’s external solicitors. Long past the fork in the road between Cane Toad and Ten, where it was obvious a massive conflict of interest existed, she continued to act for both parties, and kept Ten informed of Wilkinson’s legal position.
Why?
Wanting to keep the corporate client onside, but keeping the celebrity client for juicy dinner party chatter?
Some long-standing animosity within the legal profession?
Who knows?
But again, her predicament in finding herself under a bus is entirely of her own making.

However, this does mean that the yuan will grow in strength, as we have seen with the slow death of the petrodollar.

They will struggle if their banking system suffers from more failures. If they peg to the USD and have to accomodate to recapitalise the banks, it simply cannot be done.

The alternative is the PRC Treasury and Central People’s Bank buy failing banks, buy equity at a discount in solvent banks and sell US denominated assets.

Then, “okay, now what”. They’ve lowered productivity without a devaluation.

The piper must be paid at some point.

Cane Toad’s position is somewhat mitigated, but her liability won’t be fully extinguished.

How does that help her on the question of costs (the issue for today)? Either Ch 10 is liable to pay or it is not. Apportionment might come into play for damages in the main action.

Yes. Separate questions.
There is little doubt in my mind, after watching this morning’s televisual feast, that Ten will be picking up the tab for the Toad’s legals.
As to the main game, Lee has given a hint.
Legal advice or not, he still thinks a cadet journo would have known better.

excellent textage.

Question for lawyers & others: why do we rely on everyones memory when relevant docs e.g. “email confirming legal risk review completed on speech by X” would be more accurate and transparent? Are the sides not calling for supporting evidence because its too hard or not available?

Hard to believe there is no chain of command and documented process in place, or at least some historical record.

Takeaways from this morning at the FCA:

1) Despite having one night to re-think her appalling performance yesterday, Smithie (25(!) years experience!) doubled down on stupid, even as Lee was throwing her a life-line.

2) Saunders (lawyer subcontracted to Ch10 and Bunyons) survived relatively unscathed.

3) Chrysanthou, argued that Bunyons acted properly, under Ch10 legal advice, and that several parts of her affidavits were not tested by Brucie or Ch10 (going to credibility)

4) Dick SC (Ch10) was sore that Elliott SC (Bunyons) misrepresented some facts while clinically rogering Smithie yesterday. Lee agreed, but these were issues inconsequential to his final decision on the cross-claim, to be delivered this afternoon.</strong.

5) Lee stated the obvious ie. that both Brucie and Hoggins were lying morons, but that Hoggins was worse. That judgement to be delivered in March, maybe early April.

Conclusions so far…

A) Any interested Cat lawyers should look for Ch10 ads for the upcoming new position of in-house council, probably from tomorrow. Smithie will resign to spend more time with her family (cat/s) before re-training as a Maccas employee.

Ch10 executives should update their LinkedIn profiles for new career "opportunities".

Bunyons will essentially have her legal costs covered by Ch10 and may even escape Brucie's claws.

Yes, and that story is repeated for *multiple* components needed to build our ‘clean energy future’ – many decades of current production required to source the materials required, even if 100% directed to the task. And thats even before you factor in the energy costs to mine and refine – aluminium for example being referred to in the trade as ‘congealed electricity’.

Just as I was screaming at my MP regarding COVID – ‘this cannot work on first principles’, there are power engineers doing the same thing about renewables, and getting cancelled just the same. From Go-Auto EDITION 1205 – FEB 14, 2024:
“The Albanese Labor government via Minister Chris Bowen seeks to
….introduce..a corporate average CO2 per kilometre level for each OEM via the New Vehicle Efficiency Standard (NVES).

Under the regulations each OEM takes its measure of the CO2 emissions
per kilometre of each model variant it sells. The sales of each model variant
are then multiplied by the CO2 figure of that variant. The combined CO2 emission level from each of the model variants sold by the OEM is calculated and is then
divided by its total sales to arrive at that OEM’s corporate average CO2
figure. There are two targets to meet; one for passenger cars and one for
SUVs and utes (which is higher).

Each gram over the target will attract a penalty of $100 multiplied by
the total number of vehicles sold by that OEM (in each category).
Each gram under the target (Tesla and BYD for example) will generate
a CO2 credit. That OEM can accumulate credits and then sell those
credits to OEMs that are struggling to meet their targets.

….
TESLA and BYD are the most obvious winners under the New
Vehicle Efficiency Standard (NVES) with healthy sales and zero ‘tailpipe’
CO2 emissions. They will, as CO2 credit engines, bask in the demand from other car
makers seeking credits to buy. They will, in effect, have the power of
life and death over some OEMs depending on which brands these
credit engines choose to deal with. Securing early agreements with
them, like now, might be critical….”

Indigenous Affairs Minister Linda Burney flags path for truth telling in school curriculum

By rhiannon down

Indigenous Australians Minister Linda Burney says she was in active discussions with cabinet to develop a model for a truth telling process, flagging that it could be included in the school curriculum though she remained “very open” on the framework.

Ms Burney also sought to clarify Anthony Albanese’s commitment to pursue a Makarrata commission, saying Labor would take time to get the process that signifies a coming together after a struggle and truth telling “right”, while the work of treaty making continues at a state level.

Mr Burney said she was engaged in “discussions with the cabinet” about a model for truth telling, but would not reveal details on the government’s next steps following last year’s failure of the voice referendum.

“That’s absolutely why I’m talking to people,” she told ABC Radio National.

“There isn’t a particular model that I’ve got in mind, I am very open and the government is very open to what it might look like.”

Ms Burney said the referendum result had been “devastating” but other government initiatives could improve the lives of Indigenous people, when asked how she would bring people back to the table to address these issues.

“There is enormous hurt and in many cases dismay at the outcome of the referendum, there is no two ways about that,” she said.

“But there is also the important point that the referendum is over and done with.

“We accept the outcome, whether we like it or not, we accept the outcome, and we respect the outcome that the Australian people delivered.”

Ms Burney spruiked the Albanese government’s track record of improving the lives of Indigenous Australians, including an announcement on Tuesday that a commissioner for Aboriginal and Torres Strait Islander children would be established along with a scheme to create 3000 jobs in remote communities.

The Prime Minister handed down a landmark Closing the Gap report this week which revealed the nation was only on track to reach four out of 19 goals, while four were going backwards.

“But that doesn’t mean it was the shot in the locker, there are many things,” she said.

“For example, the junior ranger programs, the jobs we announced yesterday, for example the Children’s Commissioner that we announced yesterday, for example Wi Fi into remote communities, things like clean water for the first time in many communities, those things will continue.

“Including the wonderful initiatives that we’re undertaking in health, including rheumatic heart disease, those things will continue.

“The referendum was devastating, but I can tell you this; as I’ve moved around the country, the resilience of Aboriginal people is inspirational.”

She also said the reason the nation was falling so far behind its Closing the Gaps targets was because “people like (Peter) Dutton use Aboriginal affairs as a political football” and focus on “short term change”.

Ms Burney also ruled out the Opposition Leader’s push for an audit of how money was spent on how funding for Indigenous Australians was spent.

Stories my Nanna told me….

I never thought I’d see this except as a meme to teach people that price floors are a bad idea:

A FIFTY DOLLAR-AN-HOUR USD MINIMUM WAGE FROM A CALIFORNIAN US SENATE CANDIDATE

https://www.dailymail.co.uk/news/article-13079757/democrat-california-minimum-wage-senate-barbara-lee.html

That’s $77.37 per hour here in Australia, before superannuation, worker’s compensation insurance, etc.

The accounting rule of thumb for charging out services at a realistic cost (profitable, covers all costs, sustainable) is usually about four times the wage rate.

So you can imagine paying $300 per hour from a labour-hire firm for house cleaning.

The wage rate would be so damned high it would be like the Soviet Union and more valuable jobs would not attract workers, who would not have much incentive to to their far more difficult jobs well at all – they could always get fired and get a job as a custodian or a gardener.

Witnesses to murder by Roberts-Smith gave strikingly similar accounts, appeal told
David Estcourt
By David Estcourt
February 13, 2024 — 6.21pm

Listen to this article
4 min

The evidence of three key witnesses about the murder of a prisoner with a prosthetic leg by disgraced SAS soldier Ben Roberts-Smith was strikingly coherent and contained only very minor differences, a court has heard.

Roberts-Smith is seeking to reverse a decision by Federal Court Justice Anthony Besanko last year which dismissed his multimillion-dollar defamation case against The Age and The Sydney Morning Herald and found he was complicit in the murder of four unarmed Afghan prisoners.

Besanko found the newspapers had proven on the balance of probabilities that Roberts-Smith was involved in the murders while on deployment in Afghanistan between 2009 and 2012. The judge’s finding is lower than the criminal standard of beyond reasonable doubt.

The former Special Air Service corporal’s legal team, led by high-profile silk Bret Walker, SC, has argued in Roberts-Smith’s appeal that Besanko did not have sufficiently cogent evidence before him to justify making such grave findings against their client, when the former soldier was entitled to the presumption of innocence.

But Nicholas Owens, SC, acting for the newspapers, is urging the full court of the Federal Court not to overturn Besanko’s decision, and argued on Tuesday the court should believe the accounts of three witnesses – dubbed Persons 41, 14 and 24 – in relation to two of the alleged murders.

The witnesses gave an account of a man being roughly manhandled by Roberts-Smith outside a compound called Whiskey 108 on Easter Sunday 2009.

“There is no question that it was Mr Roberts-Smith who killed the man in that location with the machine gun, and it was the man with the prosthetic leg,” Owens said.

“All three of them support that coherent and essential narrative.

“To the extent there are differences between them, they are very minor differences around the very edges of that, which we would say is capable of being explained by the passage of time [and] the natural tendency to focus on the most arresting event.”

There is no dispute the two Afghan men were killed during the mission, but Roberts-Smith gave evidence during the defamation trial that they were enemy combatants killed lawfully in action by him and a second Australian soldier.

Owens also argued that another witness, Person 40, also heard shots and saw the aftermath of the killings.

Roberts-Smith told the defamation trial the two Afghan men were armed with a machine-gun and a rifle respectively, which were shown in a photo tendered to the court.

On Tuesday, Owens also touched on the death of Afghan civilian Ali Jan in September 2012.

Besanko found Roberts-Smith killed Jan, who was unarmed and defenceless, by kicking him off a cliff and procuring the soldiers under his command to shoot him. Roberts-Smith disputes Besanko’s finding.

Owens drew together witness evidence that was challenged by Roberts-Smith’s legal team, and argued that the totality of their evidence shows the consistency of the newspaper’s case at least up to when Jan was killed.

“The combined force of that evidence is clearly sufficient, we say, to induce the state of comfortable satisfaction in our case,” Owens said.

He told the appeal that Besanko had been detailed and careful in his examination of the entirety of the case.

“I can’t make such a facile submission as to say, ‘Look how long this judgment is already. Are you really saying it should be longer?’” Owens said.

“But there is something to be said that one cannot seriously contend that this judgment does not reflect a very careful and thorough analysis of the issues – factual and legal – that we’re throwing up in a very complicated case.”

The newspapers alleged the two Afghan men killed on Easter Sunday 2009 had emerged unarmed from a tunnel at Whiskey 108 and were taken prisoner before they were executed by Roberts-Smith and a “rookie” soldier acting on his instruction.

The mastheads called seven current and former SAS soldiers to give evidence supporting that account. But Roberts-Smith and four of his former SAS comrades told the defamation trial there were no men in the tunnel.

The appeal is expected to run for 10 days and does not involve hearing from witnesses afresh.

The key tactic to deploy at this stage is to simply point out that the final decision to air a program or make a speech rests with those who have that executive delegation. Your opinion isn’t going to stop them doing what is “really important”, it just highlights a risk, which no doubt they are prepared to take … aren’t they?

A pair of lifelong taxeaters encourage the taking of more taxes?
In MY Austfailure!

Australian fossil fuel tax could raise $100bn in first year alone, Rod Sims and Ross Garnaut say
Revenue from carbon solution levy could subsidise green iron, aluminium and fuel production, veteran economists argue

A tax on fossil fuel production could help fund Australia’s transition to becoming a carbon-free energy giant, lower the cost of living and assist the world to cut greenhouse emissions, according to two veteran economists.

Ross Garnaut, a leading economist during the Hawke government, and Rod Sims, a former head of the competition watchdog, say a so-called carbon solution levy would raise $100bn in its first year alone if introduced in 2030-31 and set at Europe’s five-year average price of $90/tonne of carbon dioxide equivalent.

This tax combined with other steps – including deploying the levy to subsidise as much as half the cost of new carbon-free iron, aluminium or fuel production plants – would allow Australia to exploit its abundant renewable energy resources to revive an increasingly moribund economy, they will say.

The economy is moribund BECAUSE you mongs have increased the price of energy to “save the world”, spastics!
….
“Basic economics means you must price the damage that fossil carbon imposes on us all,” Sims will say. “Not to do so is to make it essentially impossible for green products to compete with currently cheaper fossil fuel products.”

And there it is, the “too cheap to meter” greenshit cant compete with fossil fuel energy unless we stack every weather event on earth against it.

Garnaut will dismiss the view that imposing a levy on the finances of the fossil industry creates “sovereign risk” for the investments.

“Was it sovereign risk when the coal and gas industry and others funded the political campaigns that led to the abolition of carbon pricing?” Garnaut will say. “That was a huge change of arrangement that fundamentally changed the business prospects of a lot of investments made in expectation of legislated arrangements continuing.

“There’s been expectation of constraints on carbon dioxide emissions … for 23 years.

“Anyone who does not anticipate what is good or necessary policy coming in at some time hasn’t absorbed any of the reality around them.

“In the end political judgments will have to be made about whether restoration of rising income standards … and productivity growth and prosperity for the Australian people are more important than preserving the profitability of the oil and gas companies.”

Insane people dont realise they are insane.

Can you say “Using Australians super money in a wise way to secure the future”?
I know you can.

The current auction proposal to lure investors by promising a minimum generation price could cost the budget heavily and “drift into central planning”, he will say. Instead, the commonwealth could underwrite 80% of the costs of a project and rake in 40% of the profits once the investor has got their money back.

Nest of worms.

‘Serious issues’ with Higgins’ $2.4m payout

A judge told the Federal Court that the “serious credit issues” involving Mr Lehrmann and Ms Higgins included the former Liberal staffer’s account of her $2.4 million taxpayer-funded payout.

Justice Lee in the defamation trial noted on Wednesday that Ms Higgins had told the court the Commonwealth admitted liability over her alleged rape.

However, the settlement deed was then tendered and clearly stated the Commonwealth did not accept liability.

Justice Lee said both parties have made in-court and out-of-court representations that were inconsistent with the evidence given in the defamation trial last year.

“There are a number of significant differences they’ve given in court, a number of in-court representations and out-of-court representations,” he said.

Specifically, he raised Ms Higgins’ $2.4 million settlement deed with the Commonwealth and her account of that document.

“There were a range of representations made by Ms Higgins where she was under obligation to tell the truth,” he said.

Brittany Higgins, Bruce Lehrmann credit issues

Earlier Justice Lee noted again that the credibility of Mr Lehrmann and Ms Higgins in the defamation case was “particularly important” in the defamation trial.

“In relation to the principal issue, it is clear that there are significant credit issues in relation to the two principal witnesses … certainly Mr Lehrmann and Ms Higgins,” he said.

“There are quite significant differences in the evidence they’ve given in-court and a number of out-of-court representations, and in-court representations in respect of Ms Higgins, at the criminal trial.

“You have to be careful about when you’re making credit findings working out, if there are general credit problems with witnesses, what parts of their evidence you can believe. Hence, credit is particularly important in this case,” he said.

“So I just want to give everyone a chance to deal with anything they want to say concerning the issue of credit.”

Witnesses to murder by Roberts-Smith gave strikingly similar accounts, appeal told ….. The evidence of three key witnesses about the murder of a prisoner with a prosthetic leg by disgraced SAS soldier Ben Roberts-Smith was strikingly coherent and contained only very minor differences, a court has heard.

My 3 AFP accusers, and the alleged victim also gave ‘strikingly similar accounts’, the only problem is, they were fabrications, as my phonecam film of events was able to show.

My lawyer told me that judges are suspicious of tightly correlating eyewitness accounts – it is natural for different witnesses to recall somewhat or even substantially different versions of events.

I learn something new every day, hopefully. German obtained the plans of Market Garden

The major reasons for the failure of “Market Garden” were the failure of the air plan, and the decision of the Americans at Nijmegen to ignore their orders, and not give priority to capturing the bridge there…they then successfully blamed XXX Corps for “stopping to drink tea” on the way up…

My bad, Hugh. I should have specified that Marxism’s fascist branch was defeated in World War II, fascism being the popular method we’re witnessing now in Australia — just like Germany in the 1930s — where the government directs the economy and corporates do what they’re told by the government.

Whilst Mussolini is regarded as being the ‘father of fascism’, and his definition (‘fascism is best regarded as a marriage between the corporation and the state’) is generally used, Then and now, the heads of government are deluded in thinking they are the senior partners in the marriage.

Corporations actually drive governments, not the other way around. Reference ‘COVID’ and the last 3 years.

Cleo Smith abductor Terrence Kelly appeals ‘manifestly excessive’ jail sentence
Tim Clarke

The jail time handed to Terence Kelly for stealing little Cleo Smith from her parents — prompting one of the most miraculous human recoveries in Australian history — should be reduced because the judge who jailed him made a series of serious errors.

That is the argument placed before WA’s highest court on Wednesday, by one of Australia’s most fearsome lawyers.

Kelly was jailed for more than 13 years for abducting the then four-year-old from her family’s tent at a Carnarvon campsite then keeping her captive for 18 days.

But barrister Julie Condon argued that sentence was “manifestly excessive” because she claimed that the abduction of the little girl was not in the worst category of similar cases.

“On any view, this was not offending that was in the worst category of offending,” Ms Condon argued.

“It was spontaneous and opportunistic … and wasn’t the subject of planning or well thought out intention. There was no surveillance in advance. There was no violence.

“He made 12 references to (intending to) stealing money not a child. Replete with expressions of remorse, and multiple references to the guilt that he felt almost immediately after he engaged in the child stealing.”

Justice Buss commented that “it started out that way”.

“It then continued for 18 days,” he said.

During an earlier sentencing hearing, it was revealed for the first time that Kelly was high on meth when he snatched Cleo in October 2021.

It was that use of the drug that District Court Chief Judge Julie Wager found — coupled with his complex personality issues, mental impairments and neuropsychological conditions — played a “significant role” in why he snatched Cleo.

And it is that conclusion which Ms Condon said went fiercely against Kelly’s interest — but was not open for her to make based on expert evidence given before the District Court sentencing hearing.

Ms Condon — who last week was representing drug lord Tony Mokbel in a court in Victoria — argued for more than an hour that Judge Wager was wrong in concluding that meth use was a “tipping point” in Kelly’s actions in snatching Cleo.

Three of WA’s most experienced judges — Justices Michael Buss, Robert Mazza and Stephen Hall — will decide the appeal.

And they all quizzed Ms Condon at length about why Kelly’s meth use should not be taken as a major factor in what one of them described as Kelly’s “completely bizarre and very disturbing behaviour”.

“(It was) crying out for some sort of inquiry (by the judge) … sentencing judges do not sit mute,” Justice Mazza said.

“It is obvious this is a factor … it is blindingly obvious”.

Ms Condon said in written submissions to the court that Judge Wager had become “fixated” on Kelly’s drug use as a major factor, along with his complex mental health issues, and severely deprived childhood.

She withdrew that remark when Justice Mazza said the phrase was “unhelpful”.

In Kelly’s second main appeal point, his lawyers claim that Judge Wager “failed to give appropriate weight to the applicant’s childhood disadvantage and trauma.”

So-called ‘Bugmy Principles’ — set out in the High Court more than 10 years ago — mean that “background factors” including Aboriginality and social disadvantage must be given “full weight in the determination of the appropriate sentence in every case”

The most bizarre thing out of today’s proceedings was when Lee threw the Ten lawyer a lifeline, asking what her state of mind was when she gave that advice on the Loggies speech.
Of course, viewers now know the correct answer is, “No idea, yer ‘Onner. I guess I am just a low IQ moron who had a brain fade.”
Instead she launched into this convoluted story about how Cane Toad was sooo committed to Britnah that, if she hadn’t come out in support during the Loggies speech, it would look like she had abandoned Britnah.
Which would be bad because … wait for it … it would damage the trial.
Uh huh.
(Damage the stitch-up is what she really meant).
Stupid bint.
That is the whole idea of sub judice. Saying, “of course I can’t comment further at this point out of respect for the justice system” is perfectly normal and proper and no sane person will draw any conclusion from it.

I once interviewed a trader who had been fired from Alamak’s old haunt, Mother Merrill. “Merrill heads” were generally pretty useless from experience, and I didn’t hire him because he wasn’t much chop. He had been let go by Merrill Lynch for abusing the boss at the Christmas party. I was thoughtlessly commiserating with him, suggesting that it was a terrible thing that had happened to him, but it was just interview bullshit. He took legal action against Merrill for unfair dismissal, and my commiseration comments in the interview were used by this dick as evidence against ML. The firm I worked for insisted they choose the lawyer for the deposition to accompany me. There was really no conflict, so it didn’t pose a problem.

Lesson learned, keep your opinions and small talk to yourself.

Sancho, what do you think will be the weight of today’s loss by Ch10 on the main verdict in March/April?
Even considering the credibility problems of the two bloated idiots, do you think that the balance has shifted?

I don’t think today’s decision affects the fundamentals of the main game at all, albeit that it might move the damages needle away from Wilko and to Ten.
I don’t know why people think Lee has to adjudicate on whether a rape took place.
I think it goes like this.
Lee says both Britnah and Brucey have “credit issues”.
But I think Lehrman’s credibility issues are firstly, not fatal, and secondly, not relevant to the defamation.
I know that sounds silly, but I think the reasoning is as follows:-
Ten, by design, only had access to one of the two people who were in Reynold’s office that night. Under any form of examination, the credibility issues and inconsistencies would (and, in fact, did) start to show. I think Lee will say that Ten should have known there were serious doubts about her veracity, should have made more than a perfunctory eleventh hour “attempt” to contact Lehrmann, and should have excluded features from their story which narrowed the possible subjects of the accusations to a field of one.
So I think the truth defence falls at the first hurdle and I think Lee will find Ten had ample opportunity to detect flaws in her story before going to air, and thus defamed him.

Does America Need NATO?

“Former President Donald Trump has recently reiterated his stance that the United States is unfairly carrying the financial burden of the NATO alliance. He has criticized other NATO members for not meeting their defense spending targets and believes that the US should not protect allies who fail to meet these targets. Trump threatened to withdraw from NATO during his presidency as this has been a longtime grudge. So, who is contributing their fair share?

NATO nations have agreed to pay 2% of GDP toward the alliance in 2014 in the wake of the Crimea annexation. Unfortunately, written agreements carry no weight in politics as of recent years. Trump believes anyone failing to pay their bills should become the target as they do not deserve the protection of the US after years of failing to meet their obligations. Trump would “encourage them [Russia] to do whatever the hell they want” to the 18 nations who are not meeting the 2% target.

Only three NATO nations besides the US were committing to the agreement when Trump was sworn into office in 2017 (Greece, Poland, the UK). NATO members increased their contributions after Trump threatened to withdraw. Still, as of today, only seven of those members besides the US are paying their fair share (the UK, Greece, Poland, Latvia, Estonia, Croatia, and Lithuania). Newly added Romania, Hungary, Finland, and Slovakia are so grateful to be part of the alliance that they are paying over 2%.

Europe arguably has more to lose in this war, so why is the United States bankrolling NATO? Does America actually need NATO for protection? No. But they do need NATO to create and amplify wars. Even European economic powerhouses like Germany (1.57%) and France (1.9%) have failed to meet their 2014 agreement.

Trump’s comments have sparked anger within the alliance, with NATO Secretary General Jens Stoltenberg saying Trump’s comments threaten global security. While encouraging an attack on any nation is counterproductive, the numbers clearly indicate that NATO is taking full advantage of America, which is propping up the entire alliance by providing over 70% of overall funding. No one is helping America to secure its borders, but America is expected to act as a global police force, abandon all domestic interests, and interfere whenever another nation’s borders are in jeopardy. America does not need NATO; NATO needs America.”

America does need NATO. China. The USA is planning for a conflict or in the very least continued pressure to restrain any ambitions China has. An attack by China will require attacks on US bases in the Philippines and Kadena air base in Okinawa, allowing the USA to invoke the alliance. In the very least the USA will require support from NATO to provide additional ships and probably to secure naval routes and attack Chinese ports in Africa and Pakistan.

Good to know.
I guess the last two days (the unrepentant primacy of supporting the Hog against all common sense) added to the general impression, from last year’s testimonies, that there was significant malice in the actions of both Bunyons and the Ch10 sheltered workshop.
Thank you.

Putin is a great protector of European Christian values and what not. Without him it is a world full of Dan Andrews, Brett Sutton and Joe Biden. Start switching on.

Is he? Divorced once or twice, shacked up with a girl who could be his grand daughter. Makes US$150K equivalent and built a hacienda on the Black Sea costing US$ 1 billion. Owns about 20 homes and the most recent is in modernist style. Opposition either poisoned, fall off hotel terraces, Jets blown up or sent to the Gulag. Journalism is a state function.

Yeah, he could be the new Pope. Pious as hell.

I suppose the Grampians fire is being fought by people who aren’t normally allowed to climb in the Grampians?

Having just done the CFA’s Induction course, might I observe:

1) at least 50 if not 60% of the firefighters in the induction videos were young blond wimmen
2) At age 59, I have never seen a younger person than me in the truck, nor a wimmen, not a blak man (apart from mice-elf of course!)

AG Dreyfus wont be sleeping well I suspect.

And Gallagher, I hope.

Reynolds has announced that she is quitting, worndown, I suspect, by the many injustices she has had to endure, not the least being barred from the negotiating re Higgin’s undeserved windfall (courtesy of the Australian taxpayer).

This was a dog act, a blatant exploitation of parliamentary power. I’ve been waiting a long time for some correction and hopefully, justice.

Sancho, do you think Justice Lee’s interest in this payout – and the accompanying lies Higgin’s spouted about Commonwealth liability – will go anywhere? Shirley, having raised the matter so specifically, he will follow it through?

Trump v Colorado – It’s a Matter of Jurisdiction

QUESTION: Your argument on the Commerce Clause is spot on, I believe. Why do the lawyers involved in the Colorado case removing Trump does not grasp the structure of the Constitution as you do? They admit that ruling in favor of Colorado would result in national chaos. Your analysis of the Commerce Clause demonstrates that the writers of the Constitution understood such a result would break the union. Any comment on this oversight would be greatly appreciated.

BW

ANSWER: “Sometimes, lawyers focus too intently because statutory law is wordsmithing. They are arguing if Trump is an officer when they should be looking at the subject matter jurisdiction of the law. I have had to study law from a global perspective, looking at its evolution from ancient times to the present. Continental Europe followed Canon Law, whereas England created Common Law. There are huge differences such as under French law, not even your brother-in-law can be compelled to testify against you, whereas under English Common Law, the king is ruthless, so the only one with such a privilege is a spouse. They can throw your children in prison on contempt until they testify against a parent. We do not respect the family unit, whereas, under Canon Law, anyone related by marriage is covered.

I was so appalled that the oral arguments were focused on wordsmithing I decided to submit my own Amicus Curiae brief. The Court is not supposed to raise an argument that is not presented. They will probably reject it because it was after oral argument. But if they want a clean escape that is constitutionally correct rather than not addressing the issue directly, then just maybe they might make an exception and accept a Pro Se Amicus. It might be a first, anyway.”

Corporations actually drive governments, not the other way around. Reference ‘COVID’ and the last 3 years.

Except that government can send men with guns to the corporate CEO’s place. The other way round, not so much.

The protection of the community being paramount, he’s best held in a forensic mental health facility until such time as he can function in the mainstream prison system.

The rationale for the appeal, a judicial error, doesn’t warrant overturning the sentence completely.
