The Ben Roberts-Smith decision explained: Why he won’t go to jail and isn’t ‘legally’ a war criminal… and why Nine wasn’t as confident of winning as their jubilant coverage now suggests

Ben Roberts-Smith is being called a war criminal who murdered prisoners while serving with the SAS in Afghanistan after a judge dismissed his defamation claim.

But he has not been charged with any offence – let alone convicted of one – and may yet appeal against the findings Justice Anthony Besanko made in the Federal Court.

When Justice Besanko dismissed Roberts-Smith’s action against Nine newspapers on Thursday he delivered only a five-page summary of his findings.

Nine, which spent an estimated $15 million fighting Australia’s most decorated living soldier for the past five years, has understandably been gloating in its victory coverage.

But a source close to the publisher said Nine executives had considered the case could go either way and were anxious right up until Justice Besanko released his findings.

Yes I agree. Payroll tax is very dirty and sneaky too. Taxing your employer for employing you. So there’s PAYG which you never see and another tax on top of that. I often wondered what mean little twisted mind could come up with something like payroll tax.

With reference to this, when one reads about how some native American tribes used to treat each other, I sure hope morals are cultural.
Dragging the children of the defeated tribe behind horses until they died hopefully doesn’t jump cultures.

It’s incredible how some Native American tribes migrated across the continent (before the forced migration).
Also fascinating how some tribes stayed in the same area for centuries stoushing with their neighbours.
Some were peaceful.
Some were simply blood thirsty.

I guess it’s show what a wonderful disciplined government it is. I said earlier I went out with a trader buddy last night, and although he’s off the planet with some of his ideas he is reasonably well plugged in. He told me that he’s heard that Hunchback will be leaving soon and will be doing “work” for a well known transport family which has earned a couple of bill from his “generosity”. Look, I dunno if it’s true as he’s a little off the planet, but he reckons the hunchback’s family is worth a $100 million as a result of this generosity. I don’t know about that last part but I suspect there will be or there is going to be payback.

I know I’m a bit late to this debate having been busy most of the day today. However, the BRS decisions is jealousy and revenge, pure and simple, and not just from his comrades but from our judiciary who will never have to face such dangers. The judges and magistrates may be invited to the best dinner parties but most people don’t look at them with much admiration these days whereas VC excipients still are so they must be brought down.

NYC to Rome is about 9 hour flight, so it will be a good test to see if she ends up with thrombosis on the problem leg. What’s the rush, right? I’m speechless and her mother is beside herself.

Surber when he had his blog at the Gazette for a long while would put up the details of the IRS account that Americans could donate directly to, if they felt like they weren’t taxed enough. It’s true! They actually have that as an option, to donate more tax to Uncle Sam. I never saw any sign of anyone actually doing it though.

Work update: I’ve been recently horrified to discover that my beloved employer, blundering around into any nearby tarpit as it has been since a regrettable figurative meteorite incident*, now has a competitor.

However, the latter’s showpiece event has turned out to be all froth and no substance.

Many, many disgruntled personages will never swallow the disorganiser’s glossy gossamer again, much less willingly hand over their hard earned.

I know this because our trustee cute li’l in house sirens attended the non event and gathered much intelligence while gifting every wallee (or walleeette) within a 20 metre radius a possible sexy sideways glance (if they were lucky).

One of them reported back to me this arvo, clad like a Go Go Goil in order to maintain her impeccable cover, that our competitors are now way back behind us, trust wise.

Consequently, the week ended on a very happy note. My boss even insisted I take an early mark, which I steadfastly refused. Those mighty goils were far more deserving of it than myself. 🙂

I know Rosie, that’s what I thought until he brought up Hunchback unflagging support for China and the fact that Melbourne Ports or some part of it was sold to Chinese interests (or part of) back in 16. Something smells really fishy about that deal and if he kept loot in China there’s no way would find out. But then, who knows. There’s something that just doesn’t square with that prick. He’s supposed to be the Premier of the work’en men and women. He’s great pals with the transport family and holidays at their vacation homes. He’s really friendly with China.

The Malmedy Massacre was known well before 1949.

The 1948 interest in the Massacre was the result of the Baldwin Committee Congressional investigation , of which Senator McCarthy was a member, arguing that most of the investigation evidence was obtained thru coercion (including physical/mental torture) and thus illegal .. the ensuing outcry thru the US media influenced the, eventual, quitting of all the death sentences and along with 95% of all the other German war crimes trials between 1946 & 1952 (by late 1952 the western Allies had lost their appetite for revenge/justice/whatever)very few of the convicted served their full sentences …..
By 1957 98% of all USA/British/French convicted German war criminals had been released ….
Reality was that if you (German) hadn’t been executed, either out of hand, field court martial or summary justice by end 1946 you had 95% odds of survival regardless of the crime …
Apart from the “showcase” that was Nuremburg most trials & sentences were along the lines of being seen to do something rather than set-in-stone sentencing ……
The western Allies very quickly realised that running post-1946 Germany needed “experienced” players .. and 90% the “experienced” players were the ones in detention … sooooooooo ..!

The 3 afghan witnesses all came from the same village as this dog and along with their extended families were paid by the nine bastards to be witnesses. Cameron Stewart in the Oz is calling for BRS to be stripped of his VC. He says that a “court has found there to be substantial truth in reports that he murdered four unarmed civilians as well as other acts of criminal thuggery while serving with the SAS in Afghanistan.”

Apparently there is substantial truth and there is plain old truth. Stewart thinks that substantial truth is enough evidence for him. I haven’t seen journalism this unhinged since Cardinal Pell.

Sorry, but I can’t agree with you – the onus is on those accusing this real, actual hero of our country. Anyone who dares accuse such a man of impropriety without overwhelming evidence deserves to pay, and pay big for what they have done. Justice is supposed to be blind, not stupid, and in my opinion this judgement is not just stupid, it is stupid beyond belief. Stupid squared. It is regrettable that such a decision is no longer surprising.

I always believed that’s how the law worked but apparently there are judges who have other ideas. This decision is not justice, it is revenge and an up-yours to people they don’t like.

Part of the Afghanistan problem might be that the Special Forces are simply too large to be maintained at the necessary standard in a small Army.

Perhaps the solution is to reduce both SASR and 2 Commando Regiment to subunit size, and be much more selective in recruiting. Two benefits of such an approach could be higher standards in normal infantry units, that were no longer drained of their better soldiers, and constraints on future governments using the Special Forces to avoid the risk of high battlefield casualties, while ignoring the stresses placed on limited Special Forces numbers.

I totally disagree Cameron. I’ve served in combat and can’t even begin to explain the absolute terror that that was. For someone to do what it takes to win a VC, and survive to receive it, is beyond comprehension for most people. I seriously doubt that I could have done what it takes. Some of the greatest military people that have ever lived, have been terrible people in the other aspects of their lives. You’re a journalist, I get that, but to bring a Western civilian perspective to this issue, as the only perspective, is fundamentally wrong. Taking his VC would probably knock the stuffing out of serving personnel – the very people we need to do the horrible and difficult things that keep us safe.

Dylan had some amazing songs, but the only problem was he couldn’t sing. He’s probably one of two singers who ended up as a conservative Republican.

We’re very used to being frightened stiff of recessions because over the recent past recessions have often meant zooming unemployment. It doesn’t have to be the case. Japan’s had several recessions since the 90s where unemployment hasn’t budged much. We could be getting there too in Europe, US but maybe not here though. Germany is in recession and the unemployment rate hasn’t moved much.

And the US will likely move into recession, but:

Payrolls rose 339,000 in May, much better than expected in resilient labor market

Not sure, but I think we’re screwed. They just raised the minimum wage today like the economy was booming. Unreal. Markets can’t be trusted with setting wages.

I think the other credit shoe still has to drop and it may be in private equity & unlisted assets.

Here we have some massive rorts in the industry super funds where they outperform but only based on their own values for unlisted assets. Doubt that will come out before next election, but it could be messy for Labor and Oz if a trillion or two gets lost in super somehow.

I’ve had research for a manuscript about Col. Warfe sitting around for years, waiting for me to magically get over a writer’s block type of issue.

Muddy, I feel your pain. I have been sitting on research about the post-Roman writer Gildas, knowing that I have to say what I think about the misdating of his floruit and all that follows from that, but it is an incredibly complicated tale of datings, misdatings, and confusions over a document that is extremely confusing to start with in an historical situation that is fraught with differing opinions about what was going on.

I decided a week ago that I was going to knock some shape into it, send it to Hairy’s barrister friend in England who knows this stuff and who wants to read it, and keep it to a length suitable for a publishable article, not a book chapter, which must come later. This makes me prune it to its essence. That’s a good discipline and I suggest you try to do that same. Keep it as though you are writing for the Cat audience and don’t get above them or talk down to them or become too simplistic for them. A tough call. Eight or quarto pages maximum, even less if your material can be readily condensed. You don’t have to get every little thing in, and beware over overwriting and also of repetition.

Good luck and I hope you wish me the same.
