Re-purposing drugs is a very big deal. According to FDA rules, a repurposed drug, to all intents is treated as a new drug.

I agree its a great thing if a new an innovative use is found to “reinvent” already existing drugs for conditions they originaly didnt have a use for.

However…
It has led to patent farming, where a drug which is known to have a few applications is instead ‘found” to have a new function not long before its original patent runs out.

Drug companies typically have less than 10 years of exclusive rights once a drug hits the marketplace. They can extend their monopolies by layering in secondary patents, using tactics critics call โ€œevergreeningโ€ or โ€œproduct hopping.โ€

Lisa Larrimore Ouellette, a patent law expert at Stanford University, said the pharmaceutical industry gets a greater financial return from its patent strategy than any other industry does.

AztraZeneca in 2001 famously fended off generic versions of its blockbuster heartburn medicine Prilosec by patenting a tweaked version of the drug and calling it Nexium. When Abbott Laboratories faced multiple lawsuits over its big moneymaker TriCor, a decades-old cholesterol drug, it lowered the dosage and changed it from a tablet to a capsule to win a new patent.

And Forest Laboratories stopped selling its Alzheimerโ€™s disease drug Namenda in 2014 after reformulating and patenting Namenda XR to be taken once a day instead of twice.

Now you can argue these are improvements, but enough to warrant removing the already established drug and introducing the “new improved” (and extended patented) one?

And yesthe patents system is pretty shit, a better option would be to offer longer patents for discounted drugs giving the companies a 20 year stream of income (at, say a 50% discount) instead of 5-10.
To put it in perspective, Disney has patents which will reach 100 years old still delivering income for them.

But even if both drugs do have a protease inhibitor effect (slowing down the enzyme protease, which breaks down proteins), Pfizerโ€™s new drug trial candidate and ivermectin are completely different chemical compounds. According to Dr Stephen Griffin, a virologist and Associate Professor at Leeds Institute of Medical Research, they are โ€œextremely structurally differentโ€.

Dover, could I respectfully suggest that the issue raised by Gab at 8:42 am deserves its own thread too. The Bio Security Act 2015 is a piece of Federal legislation which details the (limited) Federal Government’s activities regarding pandemics.

At present, it is very limited and the various state public health orders are much more draconian in comparison. The various state public health orders could be challenged in courts of law as they exceed the scope the limited Federal legislation, and the Federal legislation should take precedence according to our constitution.

No cases have yet been heard in our courts based on the Federal limitations vs. state government health orders, these few cases are quickly and quietly settled out of court. The Federal Government therefore wants to “beef-up” its legislation to legalise state governmental tyrannies, and to add additional powers to the government, including the relocation and detention of “groups” as it sees fit.

This must be stopped, this is no different to the Untermensch being rounded up and relocated to ghettos and camps in the 1930’s.

I’m not saying if the dude’s view is correct or not, but it’s an opinion and therefore should be backed up with facts.

The point that I’m making is that the provision allowing new patents for re-purposed drugs is an excellent idea.

Some idiots here seem to think that repurposing doesn’t require additional costs to meet new standards, but it most certainly does.

The suppression of ivermectin is criminal behavior but it opened up a huge opportunity to help address the loss from Pfizer’s recent 2.3 billion fine. ?

We don’t know if it does exactly the same thing. As it is a completely different structure that is unlikely.

Think of a large pharma’s collection of patents as a portfolio of stocks. Some will do better than others and re-purposing gives pharma the opportunity to make lots of money. There are costs involved with repurposing because trials / studies have to demonstrate the old drug actually works for the ailment.

The drug company makes more money on an existing drug. Fucking good for them. Pharma making lots of money means they’re helping people with the illnesses and therefore doing the Lord’s work on earth.

JC – You are conflating evergreening patents and recertifying drugs for off-label uses. They’re not the same thing. The US Pat Office grants patents, the US FDA grants certifications. The latter is the procedurally important requirement. And the FDA is totally controlled by the looney Left, going on the report I linked. The CDC also, based on the other report I linked. It’s all in keeping with Gramsci and the Left’s strategy for the last half century. Why are you surprised? Health is one of the most powerful weapons the Left has to get their way – as we’ve been seeing with this ‘pandemic’.

Ivermectin has known protease inhibitory activity, the Pfizer candidate is reported to be a strong protease inhibitor. Ivermectin also is known via binding studies to interfere with the spike protein-ACE2 docking complex.

Just popped up to the shops to buy lunch. As I entered the shopping centre (Bridgepoint) I noticed the shutters down at the IGA.

There were sheets of A4 stuck on the shutter explaining that a person who was in their store on the weekend tested positive for Covid so they were closing the store while they had it ‘cleaned’.

I suppose this is the price of running a business in a society with so many neurotic people. Doesn’t matter what the franchise owner thinks – if the wee steepit, cow’rin, tim’rous beasties* among their patrons think IGA is not panicked enough then they will write letters or refuse to shop there (until they do come back but with haughty condescension, reassuringly swapping assertions that they ‘would not come here if there was another shop’ in the same way ants swap pheromones from the queen’s butt).

And even if the franchisee had the free spirit to brush the Covid alarm off Head Office would probably insist since it can affect the IGA reputation far beyond the Lower North Shore.

Safer to shut and put on some coof mummery.

Let some Cert IV shaman wander his way down each of the aisles shaking an eagle feather dipped in Dettol at all the lines of products in the shelves.

Why Dettol? Because when the quaking masses finally stopper their urethrae and venture back into the store the clean smell put them at ease and they can wrap themselves in their cocoon of mundanities where they can through sheer stubbornness stay caterpillars forever.

Thanks for that intelligent response. I really, really have an issue with intellectual property rights and it’s been swirling around in my head for decades. I sometimes see the advantage of offering what is essentially a monopoly right and I also can see how it’s abusive and wrong and wonder if the world would be better off with no such thing as intellectual property rights or much, much more stringent system.

Keep in mind that its people like Cronkite who has most likely destroyed the system… modern day lawyers.

No JC. As I said the FDA has nothing to do with patent protection whatsoever. I’ve had many patents granted through the US Pat office, I know what I am talking about.

No doubt the US Pat Office will expedite the Pfizer patent application, which is fine by me. But the FDA approves the use of it, and says nothing about monopoly rights to the manufacturing of it. That’s what the patent would be for, although Pfizer wouldn’t need one immediately since they’re well ahead of the competition in the manufacturing method development – which would not be easily duplicated overnight by the Chunks or Indians. Though they could probably do knock offs fairly quickly once they knew the chemical structure,

JC – The FDA can help pharma companies with patent evergreening though. Typically evergreening is about a minor change to the method – eg a vaccine which includes a different adjuvant or preservative. There might be a small improvement or even no improvement at all, but if the FDA certifies the new concoction and de-certifies the old method then that prevents generics companies from selling the out-of-patent formulation in competition. Big money in that. Which I suspect is going on widely behind the curtain. Kickbacks for everyone.

That’s correct JC except it is not able to be priced as an entirely new drug, since the patent protects the manufacturing process, not the pharmacological use.

Of course if someone develops a different manufacturing method then they can sell the same compound themselves. But developing such processes isn’t easy. Copying a known process is easy though, which is why the patent system exists.

Btw the Chinese ignore patents (except their own ones) which means as soon as they get the details on the new Pfizer compound they’ll be selling a knock off of it.

I disagree, JC. AdamD did something that no one else seemed willing to do and on very short notice. He simply cloned the site so it could continue – no one knew how long the place had before Jacques pulled the plug.

Bird being repulsive and obsessive didnโ€™t help, nor do the huge drawer of banned socks that now get a regular airing. But there are still some excellent commenters over there, albeit a dwindling number. I donโ€™t want it to fold.

After all, I am fairly certain they did not invent those uses.

JC, to be fair I think Adam did a sterling job considering the short notice. Remember, Sinc (bless him) did pull the plug rather quickly. It doesn’t matter if Merck invented Iver. If it bought the rights to it, it owns all rights ownership bestows.

After all, I am fairly certain they did not invent those uses.

Which uses? The original use of Iver or subsequent? Possibly all repurposed drugs new uses are found by accident/anecdote and then there are the serious studies. All good.

Furthermore, how is it efficient?

The better question to ask is what would happen if the incentives weren’t there?

JC – I’m fairly sure repurposing is common, but not being a pharmaceutical chemist I’ve only limited cases in memory. Penicillin was first an antibiotic then a growth stimulant for livestock, and it’s degradation product penicillamide is used for detoxing heavy metals poisoning. Thalidomide was originally used for preventing nausea (with terrible results) but then was repurposed for leprosy, multiple myeloma and recently has been found to be useful for Covid also – obviously with careful control.

My ex police friend indicates somewhere north of 80% of police time is taken up by that demographic.
Most of the time there are events in progress, witnesses, footage or other forensic evidence (fingerprints etc) which point out broadly who they are looking for.
Its relatively “easy”policing which has a great impact on everyones quality of life, the offences are simple, the ability to lay charges generally uncomplicated and resources needed to have an impact relatively low.
In addition the incidence of repeat offenders is massive, a turd at 13 will probably continue being a turd till they die… not always but often.

Police work where the bulk of their crime comes from.
And I cant overstate just how shit the criminal element of the underclass can make it on the people living nearby, often other lower income types.

A rich kid on stealing charges takes the same resources to process and take to court.
A rich kid on a DV charge is very likely to be treated pretty much the same as Billy Bongsmoke.

Where wealth makes a massive difference is in the white collar crimes, which take far, far more resources to prosecute and often pit a force lawyer/prosecutor against some very sharp legal minds.

I knew a couple of the more infamous ones when I was growing up.
One in particular was a raving queen.
My theory goes like this …
They grew up in ultra-conservative religious households (and society in general) in the ’50’s and ’60’s.
There was no way they were coming out as gay.
Joining religious orders seemed like a good idea.
Sexual urges fought and suppressed during their teens and twenties, and they had no experience at developing an adult relationship.
So it finally erupted as child abuse.
Not excusing it in any way.
Just an explanation as to how all these freaks ended up in religious orders.

Your comparison with an oil company ‘discovering’ oil on a redneck’s property is null and void. They’re legal terms in case you’re wondering. Another legal term is that ivermectin is an off-patent drug, no one owns it. Copyright and patent law is specific: you can’t take a product, tinker with it and claim it as your own. Pfizer didn’t invent/discover ivermectin and if as it appears, all they have done is change its structure, a common procedure with complex drugs, while maintaining it’s anti-viral effect then it would be an interesting case. But, it begs the question, if this ‘new’ drug does the same thing as ivermectin why isn’t ivermectin used since it has a 60 year proven record as an anti-viral. Same as Hydroxychlorine.
