Happy New Year All!

The Little Bloke and I drove to the farm yesterday. Spent the afternoon swimming and kayaking in the river. Roast lamb and salad for dinner. In bed by 9 and asleep shortly afterwards. Up early for sheep work, horse riding and feeding sheep this morning.

A great way to start a new year!

If 2022 isn’t much like 2019, there’s going to be a bloody revolution.

The most troubling phrase in that piece is where the beak refers to the ‘scope of the warrant’ as being insufficient, and he’s bang on the money.

A search warrant (or any other type) is not a fishing expedition. You need evidence of the commission of a certain class of offence, and that the person named in the warrant may be involved in the commission of that offence, and finally that evidence to link that person with that offence will be found at location X, whether that is in cyberspace or not. The warrant should stipulate exactly what you are looking for, and the scope of the warrant should end when you find it.

Example: If you were in possession of a warrant to look for a car used in a stickup, and you go to Property X and find that car, that’s it. You do not get to look through undies drawers, because a car can’t fit in it and it’s out of warrant scope.

If you were looking for a shotgun used in that stickup, you could potentially go through undies drawers after you find that shotgun looking for ammo, because ammo will fit in an undies drawer. Note – only if you mention that said shotgun was discharged in the offence, or you produce evidence that ammunition was involved in the commission of the offence in your affidavit.

If you’re looking for a couch, and you find it – that’s where the scope of the warrant ends and you stop searching. If you go in looking for a couch and notice a couple of thousand naughty plants in plain view in a warehouse where you thought the couch would be (as a couch would fit in a warehouse, so you could look for it there) – there’s a couple of common law arrangements you can rely on to take that, but your best best is to apply on the spot for a whole new warrant that includes naughty plants in its scope.

The second warrant process brings with it the necessary accountability.

The problem with cyberspace warrants of this type, including surveillance warrants is that naming things to be looked for is problematic, and also that once you open one door it tends to lead to opening all of them. In turn, this leads lazy investigators to adopt a shotgun approach and try to encompass everything by using the word ‘terrorism’ in the affidavit.

In turn again, this leads to warrants that are blurred in scope and which are therefore dangerous.

As a Captain Obvious moment, there is already sufficient legislation to deal with righteous searches of this type. The proposed stuff is a dead set invitation for ulterior motives to come into play.

It sits in the press with the Beloved’s tasteful statue of David one (fun at bbqs to secretly observe the guys cringing when it gets a little too close to the fire).

You always have to bring back a completely tasteless souvenir gift – that was mine.

Went for a walk along Fisherman’s beach. Very invigorating. There’s nothing better than Port Phil Bay on a warm cloudless day.

Typical Australia though. 4 coffee shops almost side by side and not a one is open. One dude reckoned they closed because of staff shortages, but I don’t think so as they’ve been open throughout including Xmas eve.

I can’t be bothered dealing with the back chatter at the moment. Later.

It’s over, I think the swamp has won the Airport. I can’t deal with this on my own. The big firms are “conflicted” and refuse to deal with me. They’ve sown up the legal side really well.

I’ve been offered some prelim advice by a QC pal (half a pal) and he reckons it would cost me about 100K and likely to lose. I managed to get the names and addresses of the top 500 shareholders and just toying with the idea of sending out a letter, but I’m just not sure. I’ll this though, Gonski is a diabolical turd and I can see why the Lying Slapper hired the arsehole to fuck up the education system.

It’s the swampiest deal ever. Also, I think the stock is worth 12 bucks a share.

An enterprising operator would have his/her espresso van parked at a convenient chokepoint to or from the boardwalk or beach (or other attraction), and have a few fellow contractors working the thing in shifts all day, or until the punters all go home.

(The even smarter ones have a goodly reserve of milk, beans and cookies in a second truck nearby, to save frantically rushing off to find an open Coles or Woolies when the bottles inevitably run out).

Old Parliament House fire protesters linked to anti-vaccine and conspiracy groups

Leaders of a group of protesters who set fire to the facade of Old Parliament House in Canberra are closely linked to a complex network of anti-vaccination and conspiracy groups which have been accused of spreading misinformation in Indigenous communities during the Covid-19 pandemic.

You could argue mineralisation in the water, but that would be accounted for in the sterilisation and pre-production processes, as calcium deposits are not nice on steel fitting and tend to block pipes.

From my time the AAT did only 2 things.

1: Agreed with an appeal on the grounds the boxes werent sufficiently ticked, sending an applicant back to have their decision reviewed.
2: Found boxes had been ticked and there was no grounds for an appeal dur to administrative error.

No ability to release anyone or make decisions on actual ‘fugee status.

20+ years ago so maybe the functions changed.
It was always a chore trying to explain to people that it was an administrative exercise and not a place where they could present new “evidence” to support claims for asylum.

Whether I take offence or not is a choice I make. There are plenty of other choices you are free to make. It appears that the liberty almost everyone claims to value so much, and was the basis upon which this forum was originally offered, is all too often a one way street when someone else’s choice is not the one you would make. Drank some tap water in Adelaide and paid the price for several day on our way north. No one warned me not to drink the water. Arky, as a young teacher in Gladstone many years ago I lived in “the teacher ghetto” – about 75 single teachers in the state system in a complex of townhouses and three bedroom houses. Lotsa parties of course.

Two ladies two doors down had a habit of coming home in the small hours – during the working week – and turning up the sound system. Much admonishment the next day at work with them profuse in apologies. Then a week later they’d do it again.

One night at 3am I lost it completely and took a pair of sidecutters down to their place. Big invite in as they presumed I’d come to join the party. Instead I cut off the 24vac plug.

Having a restricted electrician’s licence went back the next day and rewired it. Strangely enough the raid broke their habit.

As for ‘flouncing’. I’d ban the word (except I am not a banner), because it is stupid. Of course people get upset, and have a right to say so and want to burn bridges. That’s normal. Ignoring disparagement of oneself is not normal behaviour. That’s why defamation laws exist in real life but thankfully not here. Also normal is withdrawing and wanting it to be permanent, or at least levelling right off permanently too as I need to do, for various reasons of my own.

Arky, your threads have been good and so is your commenting here. You are an asset here.
Pedal back for a while, your missus will thank you as you’ve told me, just as Hairy thanks me, but don’t stay away long. There were two things going on this morning.
The first was trying to gee-up a pile on against JC, merely for a bit of ribbing about foul language and his simplistic 1951 Economics syllabus.
The second was dressing that all up in victimology. Pity harvesting is an accurate term.
This is a robust place. Don’t dish it out for months (including the arbitrary and capricious editing and deleting of comments on his threads) then cry “po’ po’ pitiful me” when there is a return of serve.

My sisters farm has a large Murray pine forest on it, if we go for a walk in it he insists on taking the BB gun “incase we see a fox”. Could be interesting if it ever happened!

After lunch highlight was a ride in BIL’s Kenworth to the weighbridge just down the road. He was tucked in the sleeper which he thought was pretty cool.

I take it back Megan. There wasn’t a huge age difference. She was born in 1922 and lived 99 years. Frankston was born in 1915 and lived to 1998 – 83. Betty was 7 years younger and lived 16 years more.

Stand alone hard copy sales are a fraction of the readership.
And they make you take the hard copy if you are an electronic subscriber.
Their biggest issue now is lack of tablet downloads, meaning a growing proportion of the electronic subscribers scroll the site & don’t even download the paper anymore.
The only days worth mentioning are the Friday & Saturday (Weekend) sales because of the magazine inserts.

However the ads for the group I linked there are professionally made and hosted on youtube.

Tucker Carlson at the Patriot Awards night said something that plenty of others have said before and will say again and again: the USA is wonderful, the greatest ever, it is not the bad, nasty place that the left makes it out to be, it is not in need of breaking down and reshaping.
OK, many will agree with him and the others that say such things .
But! It didn’t get to be great by indulging the left. It has hatched so many “wrong thinking” types that it’s hard to see how they might be peacefully made harmless. Secondly, it has indulged a do-nothing incumbent Republican old guard that now seems to have way too many RINOs and Never Trumpers. Worse, there are some like Liz Cheney who are so far off the conservative line that they actually assist Pelosi and Co.
The crowd at that night of nights love Tucker, and all those crowds at Trumps rallies prove his popularity.
We are left with two conclusions. Firstly, that the statistical probability of Biden getting all the votes they say he got is way out there. Secondly, given the number of “Blue” states, and the possibility of another election just like the 2020 one (or the federal ferals taking over the election machinations from the states), how much faith do we have that either 2022 or 2024 will be fair?
The current administration is working on all fronts. Importing voters, using covid to impose rules, using January 6 to impose rules, changing the nature of the military, working to disarm the citizens, undermining the currency, wrecking the energy assets, making sure as many leftists as possible occupy key positions from school boards to Attorneys and Judges, public servants, heads of departments, the FBI and CIA. Then there’s the supplementation of the IRS, which got a lot of warping under Obama.
How much faith do you have in the USA squeaking through to a more sensible government by holding award nights and having some, repeat just some, talking heads on Fox telling it like it is?
