Soldier harboured doubts about Roberts-Smith’s VC honour, court told

A Special Air Service soldier who has given damaging evidence about war veteran Ben-Roberts Smith has told the Federal Court he had doubts about the circumstances in which his former comrade received the Victoria Cross, but denied he was seeking to smear his reputation in court.

The serving soldier, dubbed Person 14, told the court on Tuesday he did not doubt Mr Roberts-Smith put his life in danger during a 2010 battle in Tizak, Afghanistan, for which he was awarded Australia’s highest military honour in 2011, but he did have doubts about the award.

Person 14, whose identity cannot be revealed for national security reasons, was not in Afghanistan in 2010, but served alongside Mr Roberts-Smith in 2009 and 2012.

Mr Roberts-Smith is suing for defamation over a series of news reports in 2018 he says portray him as a war criminal. Person 14 is the second member of the SAS to give evidence in the Federal Court in Sydney for The Age, The Sydney Morning Herald and The Canberra Times, as the news outlets seek to establish a defence of truth.

“Did the awarding of the Victoria Cross to Mr Roberts-Smith create division within the SAS?” Mr Roberts-Smith’s barrister, Arthur Moses, SC, asked Person 14 on Tuesday.

“No. I was there for the investiture and it was a good day, actually,” Person 14 said.

Person 14 has previously admitted he missed out on a deployment to Afghanistan in 2010, when the battle in Tizak took place, because of a disciplinary issue involving him losing possession of a hard drive containing work-related images. He told the court he self-reported the incident to the Defence Force.

Bruce McClintock, SC, one of a team of barristers acting for Mr Roberts-Smith, said during his opening address to the court last year that the soldier’s reputation had been destroyed by a campaign led by “bitter people” in the Special Air Service who were “aided by credulous journalists”.

Asked on Tuesday if he had told Mr Roberts-Smith himself that he had his doubts about his Victoria Cross, Person 14 said: “No.”

“You don’t doubt that he put his life in danger?” Mr Moses asked. “No way,” Person 14 replied.

“You’re not here to second guess those who determined to award that Victoria Cross to Mr Roberts-Smith, are you?” Mr Moses said. “No,” Person 14 replied.

Person 14 agreed he did not know what material decision-makers had before them when awarding the honour to Mr Roberts-Smith.

“Do you resent the fact that Mr Roberts-Smith was awarded the VC?” Mr Moses asked. “No,” Person 14 said.

“Do you resent the fact that he was awarded a VC in respect of a tour that you were held back from going on?” Mr Moses pressed. “No.”

But Person 14 agreed “100 per cent” he was upset he could not go on that tour.

“You’ve come here to throw Mr Roberts-Smith under the bus any way you can, haven’t you?” Mr Moses asked. “No,” the SAS soldier replied.

The Age and the Herald, owned by Nine, and The Canberra Times, now under separate ownership, allege Mr Roberts-Smith committed or was involved in six murders of Afghans under the control of Australian troops, when they cannot be killed under the rules of engagement.

Mr Roberts-Smith maintains any killings in Afghanistan were carried out lawfully in the heat of battle.

Person 14 has said he witnessed Mr Roberts-Smith direct an interpreter in 2012 to tell a member of the Afghan Partner Force to kill an Afghan man they had been questioning, “or I will”. The man was shot dead, he said.

The SAS soldier has also given evidence that he witnessed an unidentified Australian soldier in 2009 shoot a dark, human-like object with a distinctive machine gun that he later saw in the possession of Mr Roberts-Smith.

The soldier had camouflage paint or “campaint” on his face that was “the same, or similar, campaint style as Ben Roberts-Smith”, he said.

Person 14 said he discovered on closer inspection that the dark object was an Afghan man with a prosthetic leg.

He agreed under cross-examination on Monday that he did not know if Mr Roberts-Smith was carrying the same weapon, but said he was carrying the same type of light machine gun.

The hearing continues.

Daniel Andrews has given notice to international travellers hoping to visit Victoria to be triple-dosed or face being locked out of life in the state. The Premier detailed the switch on Tuesday while, saying the redefinition of fully-vaccinated will also apply to travellers when it does to Victorians.

“As far as those who get into the country, and the circumstances in which they get into the country, I think we’ve well established (third dose protocols),” he said. Mr Andrews said any additional mandates will “apply here in the state of Victoria.”

This comes despite Prime Minister Scott Morrison revealing on Monday people visiting from overseas would only two doses. “It will be two doses … There are various arrangements around the world regarding third doses. And so two doses, the Chief Medical Officer, advises will be sufficient,” he said.

What a clusterfvck. That bloke in WA will be watching with close interest, as will Palacechook. As it happens, Scomo referred to “fully vaccinated” which has different meanings in different countries. And by the way, the Johnson & Johnson version only requires one dose to be ‘fully vaccinated’.

The Australian federation came about because of the circumstances of the time, and the generation of people at the time had particular ideas about freedom and British ideals and interest in American experiment.

Everything that happened afterwards for a century happened with the backdrop of historical moments: The great depression -> Jack Lang’s craziness -> Commonwealth empowered.
WW2 -> John Curtin -> Income Tax fight -> Commonwealth empowered.
etc, etc.

It’s those sorts of things that as a whole created the concept that we have (had) of “Australia” as one unified country with different administrative regions and minor cultural differences.

There is no guarantee that future circumstances will present themselves allowing us to to get it back.

They reversed themselves on that one JC.

It was an incredibly stupid thing to do and attracted the attention of a bunch of State Attorneys General investigating them for wire fraud.
Possibly even more impactful was the donors doing ‘charge backs’ via their credit card companies for breach of contract/fraud. The charges/penalties GoFundMe would have owed would likely have ruined them.

There are people with medical degrees who decided to stick the finger to Medicare, as well as the NSW State Health Service, and have retired early, preferring peace and freedom to a stressful life in the criminally dysfunctional, weaponised health system.
Several senior medical vacancies exist today, not just in NSW, and are increasing (for the last 6 months, at least), with real-life consequences for people needing to receive timely care.

When I was in the game, it was common for these vacant positions to be cheered by the Health accountants – ‘someone’ would pick up the essential bits, and a pile of money was saved.
That’s the mentality you’re facing.

In 2019 I copped flak on the old catallaxy for a small campaign saying that the Commonwealth was losing the heart of the nation and people were turning back towards the original entities that always existed: the colonies, their states. That if the Commonwealth didn’t lift its game it would become irrelevant in the hearts and minds of the nation and the states would become the dominant powers. That the only thing keeping the Commonwealth government alive and relevant to the everyman in 2019 was Medicare and Centrelink.

Like I said, never in a million years did I think it would happen in two years.

Libertarians weren’t there saying “yeah by 2022 Australia will be a collection of tin pot republics”. Instead it was all “mah constitution won’t allow it!!”.

I’d speculate the insurers are acting to try to stop the butchers bill rising with new Covid infections leading to serious/fatal outcomes?

If you have ever been to Friday night drinkies at an Australian embassy, you will understand why it is referred to as the Department of Foreign Affairies.

There was an incident at an airport where a local reception team was waiting to welcome the latest Oz Ambassador.. It was a small airport at the time and passengers had to descend the mobile staircase and walk across the tarmac.

When the Oz VIP appeared at the top of the stairs, he was visibly “tired and emotional”. Just as interestingly, he was wearing, not a stylish, lightweight suit, but T-Shirt from a notorious Bangkok gay bar.

The local diplomat turned to the Australian contingent and straight-up asked them if any Australian men actually liked women. This in a country which “tolerated” “gays”, but absolutely did not encourage or “celebrate” them. Ladies should not feel left out, with regards to such proclivities among the distaff “diplomats”.

That section of Australian “Kultcha” has quite a reputation overseas.

JC, I think the most defining period for this was the failure of the Abbott Liberal government to put the first job – beating Labor debt – first.

Australian journalism (not just the ABC) coerced acquiescence to the silly dogmas of the university class; the Liberals caved and completely destroyed any hope of a fair shake for any ideas of the rational centre.

Stix seems to think this is something altogether different to nanny statism when in fact the power of the states to control our lives through the gendarmerie is meaningless whether it was federal or state based.

And most of the responsibility resides with Morrison & Co. He has (largely) abdicated his responsibility by saying that the States have their own Health and Emergency legislation and its not the Commonwealth’s place or prerogative to intervene. Really?! If the WHO are to be believed, this was/is a global emergency which unleashed unprecedented actions by federal governments across the globe. State/region laws were routinely trounced by their national governments for the ‘greater good’. Except here in Australia, the tail was wagging the dog.

The creation of the National Cabinet allowed the states to impose their will. Whether the federation of Australia will fully recover is unlikely IMO. The precedent of the states exercising their full power is established but worse, they now recognise that, as things stand, the feds have neither the will or the legislative capacity to overrule except in some established areas (defence, national borders, foreign affairs).

But as I said the other day, I am not certain that Morrison didn’t allow this to happen as it gives him a degree of ‘plausible deniability’. He always wants to be the ‘good guy’ and perhaps he hoped that the punters would be angry with their respective state governments and not the federal LNP. If that approach resulted in his re-election then the trashing of the federation was a ‘small price’.

(You know as well as everyone that politicians always have their eye on the next election and now the states are doing their best to shift responsibility back to the feds).

I wish the protesters well but I am sceptical that a protest vote will exceed 20%.

Why do you think the *gendarme bullies the public so easily? They are 99.5% certain the fucker they’re bullying isn’t packing. Big difference between here and the US. This is why libertarians are so much against gun controls.

*Australian police are essentially an arm of the state carrying out military style actions against the punters. They are anything but police entities. Someone made that comment in a recent vid and I think they’re correct.

The precedent of the states exercising their full power is established but worse, they now recognise that, as things stand, the feds have neither the will or the legislative capacity to overrule except in some established areas (defence, national borders, foreign affairs).

If this were to result in the Commonwealth returning to its roots, looking after defence, national borders and foreign affairs, then we would be much better off in the longer term.

States would have to develop their own tax base to do what they now claim is theirs, which would need some negotiation with the Commonwealth. However, dictatorial states that did not provide adequate services or that taxed excessively would lose population and industry to more congenial states.

Also, the mendicant states would no longer be able to take the begging bowl to Canberra, which would end up with less taxing power.

Handled carefully (I know, I know, who in the present shower is capable of that), we could end up with a federation of states competing to do better, rather than competing to squeeze more out of the Commonwealth.

Hours later, a tearful Ms Jardine said the pair had been held in custody for a few hours before being dropped back at the restaurant in the early hours of the morning.

“It’s a mother and daughter and we were in the cell,” she said.

“We’re going to have to tell my grandchild … we were arrested for her or him because we’re standing up for our children and my grandchildren, that’s what I am doing. I am standing up for the future of our children and if we don’t, we’re not going to have a future.

“[My daughter] was braver than me, but you know, it’s for the kids, we’re doing it for the kids, it’s always been about the kids.

“I’m not sure what’s going to happen with the restaurant and my staff, my 20 staff that I have rely on me for their pay, I don’t know I am going to have to get a lawyer and see what our next step is.”

A WA Police spokeswoman said officers attended the cafe at 1pm, while it was closed, after a member of the public reported staff were unvaccinated.

“Police spoke with the owners and staff and advised them of their obligations under the Emergency Management Act,” she said.
“About 5.30pm, police re-attended and found the café open and trading for business. Staff were asked to leave the café and the café was again closed by police.

“A 51-year-old woman and a 22-year-old woman were taken into custody.”

The women have been charged by summons for breaching the Emergency Management Act.

Three other people were issued fines under the same act.

Asked if he believed the restaurant owners’ actions were putting people at risk, WA Premier Mark McGowan said, “Well that’s the law and people need to comply with it”.

Footage of the incident, uploaded to YouTube by Scorpion Media Group, shows at least seven police officers inside the restaurant during the arrest. Ms Jardine is then led away by two police officers wearing masks and gloves.

They had numerous opportunities in the beginning and even Albo was making (relatively) soothing overtures that Labor would work with the LNP in this global emergency. High public sector spend equals (under this arrangement ) high state tax. Lose taxable residents, and pressure grows on bloated public sectors. The mills would grind slow, but they would grind.

Are the transaction costs of the present set-up acceptable? Short term costs, long term gain.

Qld health is a disaster. Spoke to a friend who has been waiting 18 months for cataract surgery and 3 cancelled appointments with no indication when he will have the op. done. He can’t read anything. Another friend was in hospital with an oxygen saturation at 36(90 is considered a problem!) yet the doctors wanted to discharge him but a nurse kicked up a storm because my friend could barely get out of bed.

Whilst I admire the restaurant owners unfortunately they can’t win against the state who are just going to keep going until their business is destroyed.

What I would like to see is the restaurants, pubs and theatres etc fight back. They are being used to coerce fellow citizens into taking a jab.

Would love to see all venues that are required to turn away unvaxxed start turning away PM, MP’s, Health Ministers and in particular CHO’s and their deputies. Even better if know their families.

In the pre-dinner lull, for those interested, the multi generational house is creeping towards completion.

Roof on, internal wall frames finished and today, the big walk around by the electrician. He starts tomorrow, then the plumber next week. Gyprockers booked for end of month – quite a triumph since tradies are scarce as you know what, but designer/builder SiL has several favours to be called in.

KI son has visited several times, doing stone work, establishing the orchard and building fences to contain the DORPERS. This bunch are very sweet (previous owner named them all) but the cute little lambs will be gracing our Bosch oven within a few months. Son is coming again on Thursday to replicate the Taj Mahal of chicken palaces which he built a few years ago on KI. (Big family dinner to celebrate all being together again.)

Because of the way my working life has developed I’ve moved around more than many. I’m not sure whether that means I’ve been less under glass, or just under another type of glass. But my experience is that the personal costs of moving interstate (or intrastate, or internationally) are not insignificant, or trivial.

It’s pleasant to imagine being able to say Fuck You Very Much and then shift to a (for the time being) lo-tax, lo-reg, less irritating state.

The reality is a bunch of grit gets into the family gears when you do – and for most folk, shimmying around optimising your location as conditions and needs change is a practical non-starter.

On mining and energy. It’s geology, infrastructure and market that tend to fix you. Given reasonable certainty, regs and royalty and dealing with political dickheads come surprisingly far down the list of showstoppers.

I note PM is not attending the Press Club to hear Tame and Higgins. Likewise Senator Reynolds. I believe in the old days evidence of an early complaint was permissible is sex assault cases. Not sure about now but Higgins conversations with Reynolds would be highly relevant. Is she a likely witness for either side. PM should stay well away from Tame and Higgins.

I seem to recall there were issues about the actions of PH security that night and their evidence is going to be fascinating.

A neo-Nazi video singling out a Victorian Greens senator by name has prompted calls for the group to face “the full force of the law”.

The footage, posted by “Warriors of the Convict Resistance”, shows three men clad in black doing Nazi salutes after burning an Aboriginal flag and revealing a handwritten sign that names Lidia Thorpe and uses a ­racial slur.

Another sign with the word “smallpox” on it was also posted — a reference to the disease that killed huge numbers of Indigenous people after Europeans colonised Australia.

It comes as Victoria’s legal and social affairs committee is preparing to launch a probe into the threat of far-right extremism in the state. Chair of the committee, independent MP Fiona Patten, said the inquiry – backed by the Andrews government and the Greens – would accept submissions on the extremist threat.

“There is no doubt there is wide community concern about the increase of far-right extremism in Victoria,” she said.

“We have seen disturbing videos and images of these types of extremists out in regional Victoria, we have seen gallows being wheeled past parliament.”

Of the video targeting Senator Thorpe, Deakin University senior research fellow Josh Roose said it was the first time he had seen a sitting member of parliament singled out in an far-right video.

“If (Senator Thorpe) was … alone with these people, what would be the result?” he said. “This needs to be taken seriously as a threat. It has to be identified and exposed and those respon­sible should be subjected to the full force of the law.

“The naming of a politician in the context of their messaging basically situates her as an essential target. Particularly when it’s located directly next to a paper sign (that reads) smallpox.”

Unions often sell the membership out for political or other motives. Around 6 years ago I was working for a Woolworths transport subcontractor company, at the time the pay was around 45c a km plus load/unload allowances, you would make around $450/day on average as a casual, a Canberra run took around 9 to 10 hours. New company took over with the blessing of the TWU. The TWU had the nerve to put the deal in their union rag, bragging how good it was.

New deal – 45c/km, but the trucks mainly Kenworths were changed to euro crap and the speed limiters set at 90kmh instead of 101kmh, the Kenworths used to use around 42l/km the euro used around 32l/km, the Canberra run at the lower speeds took and extra 1.5 to 2 hours longer, so a a day that took 9 to 10 hours took 11 to 12 hours for the same money. The operator ran around a 100 trips a day at 800km/trip so fuel savings were around 10l/100km so 80 litres a trip by 100 = 8000 litres a day fuel reduction, big money.

I took this up with the TWU (I’m not a member) and was told “It’s a great deal”, when I said it was a 10% paycut considering the extra hours they just ignored me.

Having at different times moved overseas for an extended period (three years), and changed state of residence after retirement, I agree that the personal costs that arise are not insignificant. I also moved interstate to start work many years ago, so my only siblings and other blood relatives, who remained in my original state, have been inaccessible for practical purposes for two years, and somewhat distant even in normal times. Ditto for my wife.

That said, is it not better to at least have the option to move to a better place if a state government becomes intolerable?

Bolt is as weak as piss.
He tried a Gotcha on Scotty last time he was on his show, now he can’t get anyone from Federal Cabinet to talk to him.
Since the chances of Albanese doing him any favors are zero, i’d say Bolt’s career is over.

That’s it, and good on him.

I’m not sure Morrison was apologising for “Sexual Harassment Brittany was a victim of working in Parliament House”.

He was expressing his sorrow for the “terrible things” Ms Higgins experienced.

It’s not yet clear what these terrible things were, and to what extent Morrison needed to be apologising for them, as opposed to just being generally sorrowful. That’s all sub judice at the moment – a bit a quaint concept, obviously.

He was also expressing sorrow for “all those who came before Ms Higgins, and endured the same”. Which raises more questions than it answers.

And what he was certainly doing was giving Albanese a free kick and a Get Out of Jail card for the crimes and misdemeanours opposite.
