Re my last point. The only argument for using Novavax now, is that it would qualify you for mandate exception. However, will they then require you to update with current mRNA vacxx?????

Novavax published booster study pre-print data at the end of last year. Not yet peer reviewed and published as far as I can see. The booster shot was given at 6months post the first two. Some work was done at the Alfred in Melbourne.

Given no-one knows how or even whether the Novavax immunity wanes like the mRNA shot, I think that it will be some time before it is clear what the regimen should be. Approval would follow once that’s clear.

Don’t forget that premiers (squinting at Andrews particularly here) are quite happy to mandate a booster regardless of need or benefit. At this point, having been rendered unemployed by the mandates, I’m not going to bother with Novavax particularly when I’d probably need to get another shot in 3 months to keep working. Far simpler and easier to just drop out of society and coast.

Hey, remember when the usual bully clowns went right off about anyone suggesting that another key purpose of this whole Wu Flu Farce was to fine tune Tracking & Tracing Everyone.

No, and that’s not what ‘anyone’ said either.

I do recall people taking the piss out of random screechers claiming that vaccines were chockers with tiny robots made in Inscrutable Dry Cleaner Land, and for the purpose of tracking and tracing everyone. Nobody, and I mean nobody, mentioned ‘fine tuning’ anything.

Ignoring the machinations of mobile phone technology which allows tracking in any event, said screechers produced links to other randoms such as MICHAELDET? and @spacebunny which didn’t further the screechers’ cause, but did allow them to change direction while maintaining volume.

attacked the topic until only the brave pursued it.

No no no. Only the ‘stunning and brave’ pursued it.

All our current bishops here are novus ordites and just want to climb the clerical ladder and keep getting their taxpayer dollars from the government. Don’t expect any of them to stand up and stand out against societal atrocities. Sadly, our bishops are of the world and readily comply with the world rather than the actual Word. In the not too distant future, we can expect our bishops to agree that breaking the confessional seal is no biggie.

They ought to be sent white feathers in the mail.

As always, Orange man is right…from The Oz

“Stop apologising to these lunatics, Trump tells Joe Rogan

By HUGH TOMLINSON

Donald Trump has urged Joe Rogan to “stop apologising” about his Spotify podcast, as the commentator considers a $US100 million offer to move to a rival conservative platform linked to the former president.

Rogan, 54, is facing a public backlash for spreading misinformation about Covid-19, prompting a series of artists to pull their music from Spotify. He spent last weekend apologising for racist slurs in past episodes. He said he was “regretful and shameful” after a six-minute compilation video showing him repeatedly using the n-word and comparing a black neighbourhood to Planet of the Apes was shared on social media.

Spotify has pulled more than 100 episodes of The Joe Rogan Experience but has no plans to cancel the podcast, which draws 11 million listeners per episode.

‘Don’t let them make you look weak’

The race row prompted Trump to leap to Rogan’s defence, as the podcaster became the focus of the latest clash in America’s culture wars.

“Joe Rogan is an interesting and popular guy, but he’s got to stop apologising to the Fake News and Radical Left maniacs and lunatics,” Trump, 75, said.

“How many ways can you say you’re sorry? Joe, just go about what you do so well and don’t let them make you look weak and frightened. That’s not you and it never will be!”

The comments encouraged other conservatives to rally behind Rogan on social media, claiming he was a victim of left-wing “cancel culture”. The streaming site Rumble said that it had offered Rogan $US100 million over four years to bring his show to its platform.

Rumble has a deal with Trump and securing Rogan would bring the two most popular voices in conservative media to the site as it tries to take on YouTube. Chris Pavlovski, the Rumble chief executive, told Rogan he would face “no censorship” at the platform.

“Dear Joe, we stand with you, your guests and your legion of fans in desire for real conversation,” Pavlovski wrote. “How about you bring all your shows to Rumble, both old and new.”

Rogan, a comedian, has yet to comment on the offer. Despite the conservative effort to present him as a victim, Rogan conceded at the weekend that “whenever you’re in a situation where you have to say ‘I’m not a racist,’ you f***ed up, and I clearly have f***ed up.”

His exclusive deal with Spotify, struck in 2020, was itself worth more than $US100 million, according to reports. Rogan’s comments on vaccines and race have caused other artists to walk out and some members of the public to cancel their subscriptions.

Daniel Ek, the chief executive of the Swedish streaming platform, has promised a dollars 100 million investment in licensing and promoting music and audio content from “historically marginalised groups” but is reluctant to jettison Rogan. Ek, 38, told staff in a memo on Sunday that Rogan’s comments were “incredibly hurtful” but said he did not believe the answer lay in “silencing” the podcaster. Neil Young, who last month became the first musician to pull his work from Spotify over Rogan’s comments on Covid-19, renewed his attack on the firm yesterday (Tuesday). Young, 76, urged Spotify staff to resign and “get out of that place before it eats up your soul”.

Underscoring Trump’s power over conservative US media, Peter Thiel, the billionaire investor, plans to leave the board of Meta, the parent company of Facebook, to throw his weight behind the Republican campaign before the midterm elections in November. The Wall Street Journal reported that Thiel, 54, who in 2004 became the first outside investor in Facebook, would promote Republican candidates who supported Trump’s agenda. Allies of the former president are seeking to tighten their grip on the party, anticipating another run by Trump to retake the White House in 2024.”

You could be forgiven for thinking a fair trial isn’t on her agenda.

The concept of not appearing in the witness box and being justifiably questioned, at length, on her own involvement, actions and demeanour would probably appeal to Brih-neee.

If there’s a permanent stay of proceedings as a result of Morrison’s clumsy hand-wringing, she will never be held accountable and also be forever able to claim victim status.

I am hoping that:
The longer ATAGI take to mandate the booster as mandatory, the less likely it will become, mainly because ATAGI’s peers overseas are unlikely to go down that path. Dan would then be clearly out on a limb.

HOWEVER, as you say, Dan may just go it alone because he is un petit tyran.

Grace Tame, Brittany Higgins at the National Press Club: parliament is safe — except if you’re a woman, says Higgins

Jess Malcolm
Reporter
@jessmalcolm1
Ellen Ransely
33 minutes ago February 9, 2022

Former Liberal staffer and sexual assault survivors’ advocate Brittany Higgins has opened her National Press Club speech by powerfully describing her alleged assault in Parliament House.

“I was roped on a couch in what I thought was the safest and most secure building in Australia. In a workplace that has a police and security presence 24 hours a day, 7 days a week,” Ms Higgins said.

“The parliament of Australia is safe — it is secure — except if you’re a woman.

“I’m very grateful to take the chance to talk at the National Press Club, I want to stress that I don’t pretend to speak for all survivors. Not for a minute do I imagine that I could. Everyone’s trauma is personal. Everyone’s story of abuse and fear and betrayal and humiliation takes a different shape.”

Ms Higgins has called on the nation’s leaders to address inequalities for women across the country, as she criticised the Prime Minister’s handling of her alleged rope in Parliament House.

Last year, Scott Morrison made headlines and was punished by his critics for explaining he was moved by Ms Higgin’s disclosure after his wife Jenny had urged him to consider what happened in the context of his own daughters.

Ms Higgins said his language was “shocking” and “offensive” and called for systemic action from Mr Morrison.

“Some of his language last year was shocking and, at times, admitly, a bit offensive. But his words wouldn’t matter if his actions had measured up.

“What bothered me most about the whole “Imagine if it were our daughters” spiel wasn’t that he necessarily needed his wife’s advice to help contextualise my rope in a way that mattered to him personally.

“I didn’t want his sympathy as a father. I wanted him to use his power as Prime Minister.

“I’m not interested in words anymore. I want to see action.”

While conceding her patience had run out, Ms Higgins said was optimistic the nation could do better in ensuring equal opportunities for women and girls.

“I think you have gathered by now, my patient has run out. I want to close by saying that for all the fear and anger and sadness that my time in politics has brought me, it did not take away my belief in Australia, my faith in democracy. I know our country can do better for women and girls.

“I know our parliament will be a better, stronger place if more women are ministers and members and senators and staffers.

“It is up to us to keep those in power up to account. To take up the challenge, we each have a responsibility to one another and have a role to play in making things better for the next generation of women.”

Her initial remarks came after cheers from the crowd, and an introduction from National Press Club chair Laura Tingle who said Ms Higgins’ disclosures had unleashed a “great anger” among women in Australia.

“Many of these stories are seen as being stories about women, and they have certainly unleashed a great anger in many women in Australia.

“But they should never be just stories about, and of interest to, women. The theme that ties all these stories together is about relationships of unequal power, and our two speakers today have been central to recasting the way we see these relationships and what we expect from our leaders as a result.”

I’m not sure any government should be ‘frightened’ of their population (frightened governments/people can do stupid irrational things) but they must respect their population and respect dissenting opinion.

Governments should absolutely be actively afraid of betraying their people, seizing power and declaring open war on the entire population. Otherwise what stops them doing that as they currently are? If the parliament and courts are swept away as counter-forces, what then is left to stop them but fear of retaliation by the people?

And without that fear of retaliation, why not just sweep away parliament and the courts as they have?

As I’ve said before, you cannot turn the other cheek.

which is a Christian doctrine that I cannot and will not accept

A couple of things…

The phrase needs to be read in context, i.e. the Sermon on the Mount.

Jesus used hyperbole to make points; in which case a literal interpretation will be missing his true meaning.

Christianity also maintains, in continuity with the Old Testament, the right to self-defence.

A married couple was busted in New York, USA, on Tuesday for allegedly trying to launder roughly US$4.5 billion (A$6.2 billion) in cryptocurrency stolen during a massive 2016 hack, federal prosecutors said.

Ilya “Dutch” Lichtenstein, 34, and his rapper wife, Heather Morgan, 31, are accused of conspiring to wash the proceeds of 119,754 bitcoin that were looted when a hacker breached the systems of virtual currency exchange Bitfinex. As part of the (money laundering) scheme, the duo allegedly “employed numerous sophisticated laundering techniques” including setting up online accounts under bogus identities and moving the money through the darknet, prosecutors said.

Prosecutors said the pair had a bag labelled “burner phones” filled with mobile phones inside their Manhattan apartment, and that Lichtenstein, a dual Russia-US citizen, kept a file called “passport_ideas” on his computer. The Justice Department said special agents were able to recover over US$3.6 billion in bitcoin stolen during the Bitfinex hack — its largest-ever financial seizure.

Too stupid not to be caught. Who, in their right mind, pulls of one of the largest thefts in global history and continues to live in an apartment in New York. Seriously! Did they think “oh well, we just stole $4.5 billion but nobody can catch us ‘cos crypto”. To make matters worse, he is a dual Russian/American citizen. FFS. Idiots.

My understanding is that security staff are there to protect politicians and staffers from the public, not from the consequences of their own actions. And, further, that staffers have never been backwards in letting security staff know that was their role and nothing more and therefore to mind their own business.

Another moment that gets a laugh from the audience. Higgins and Tame are asked how the Labor leader, Anthony Albanese, could do better than the prime minister. Tame says:

All Anthony would have to do is none of the things that Scott’s done.

So Albo gets a pass to keep attending rub and tug shops.

mysterious mysteries of the mysterious mysteriousness…

Tame: I received threatening call from member of government-funded organisation
Interesting. Tame tells the crowd:

I received a threatening phone call from a senior member of a government-funded organisation, asking for my word that I would not say anything damning about the prime minister on the evening of the next Australian of the Year Awards.

Then I heard the words, ‘with an election coming soon …’.

And it crystallised a fear – fear for himself and no one else, a fear he might lose his position or, more to the point, his power. Sound familiar to anyone? Well, it does to me.

I remember standing in the shadow of a trusted authority figure, being threatened in just the same veiled way. I remember him saying: “I will lose my job if anyone hears about that, and you would not want that, would you?”

What I wanted in that moment is the same thing I want right now, and that is an end to the darkness, an end to sexual violence, safety, equity, respect, a better future for all of us – peace, a future driven by unity and truth.

….

An optimistic reporter asked Tame if she would name the person or the organisation who was behind that threatening phone call. Tame has been very animated, very facially expressive. She clowns around with a faux-earnest look and says:

I reckon if I was willing to name either, I would have put them in the speech.

I’m angry that a stupid, drunken, slutty slob slaked her thirst at my expense, hooked up with another slob and proceeded to use Parliamentary offices, paid for by me, for a tryst.

Then has the cheek to proclaim it to the rafters while being hailed as a victim.

Roberts-Smith barrister arranged new lawyers for newspapers’ witnesses, court told
Michaela Whitbourn
By Michaela Whitbourn
February 9, 2022 — 11.55am

A barrister acting for war veteran Ben Roberts-Smith in his defamation case arranged for two Special Air Service witnesses that The Age and The Sydney Morning Herald proposed to call as part of their defence to be contacted by new lawyers to replace their existing counsel, the Federal Court has heard.

Nicholas Owens, SC, who is acting for the newspapers, told the Federal Court on Wednesday that “through means unknown”, two SAS soldiers dubbed Person 56 and 66 had been “placed in contact” with new lawyers after Arthur Moses, SC, one of Mr Roberts-Smith’s barristers, contacted a high-profile Sydney silk.

One of those witnesses might now object to giving evidence for the media companies, the court heard.

Mr Owens said “there is, of course, a prohibition on the true identity of Person 56 and Person 66 being made known to anyone” apart from authorised legal representatives in the proceedings. He said the new lawyers were not authorised representatives.

“There was an agreement by Person 56 to both speak to us and not oppose any application by us to call him to give evidence in the proceedings,” Mr Owens said.

“We have become aware that recently Mr Moses has made contact with Mr Phillip Boulten of Senior Counsel, and we understand that Mr Moses expressed to Mr Boulten concerns that the interests of Person 56 and also 66 may not be being properly protected in relation to [them] being subpoenaed to give evidence in these proceedings.”

Mr Owens said the newspapers’ legal team understood that Mr Boulten then contacted Peter Hodges, a partner at law firm Mills Oakley, and either or both of those lawyers “have been placed in contact with Person 56 and Person 66, without that initial contact occurring with the knowledge of [their] … retained Defence-approved lawyers”.

“Subsequently those [Defence Force-approved] lawyers have been made aware of that contact,” Mr Owens said.

“Subsequent to that contact, Person 56’s position [about giving evidence] has changed,” Mr Owens said.

Mr Owens said he understood “Mr Boulten and Mr Hodges are meeting with Person 66 today, and Your Honour knows that Person 66 is, or at least had been scheduled, to give evidence on Friday in these proceedings, and had not filed any application to set aside his subpoena”.

The newspapers’ legal team has now issued a subpoena to Mr Boulten and Mr Hodges and a notice to produce to Mr Roberts-Smith, seeking what Mr Owens described as “evidence of communications between those groups of people and these two witnesses about their participation in the proceedings”.

Mr Roberts-Smith is suing for defamation over a series of news reports in 2018 he says portray him as a war criminal.

The Age and the Herald, owned by Nine, and The Canberra Times, now under separate ownership, allege Mr Roberts-Smith committed or was involved in six murders of Afghans under the control of Australian troops, when they cannot be killed under the rules of engagement.

Mr Roberts-Smith maintains any killings in Afghanistan were carried out lawfully in the heat of battle.

Later on Wednesday, a serving SAS soldier, dubbed Person 14, told the court that he had spoken to one of the journalists who wrote the articles, investigative reporter Chris Masters, at a meeting in January 2018.

He said Masters asked him if he had heard a “rumour” about two alleged incidents in Afghanistan, about which Person 14 has previously given evidence in court. Person 14 said he told Masters he had heard those rumours, and that “no follow up” questions were asked. He said he had no further contact with Masters.

Mr Moses asked for any notes taken by Masters on that day to be provided to Mr Roberts-Smith’s legal team.

The hearing continues.

My observation is that the demons that afflict some (not all) gay people come from within, not the broader community. Why that is I don’t know.

I rather think most men have an instinctive distaste for male effeminacy. We also have an instinct for kindness. Which dominates depends upon the culture, leading either to poofs being tolerated or thrown off tall buildings.

It isn’t unlikely that the poofs also have both instincts, which may lead to self-loathing. The same considerations apply to trannies. Mostly, I feel pity for them, but their suicide rates may owe a lot to an instinctive loathing of their own selves.

This is the security guard’s account of the events of the night once Higgins and the man entered Parliament House. (edited – see link for full version).

Ms Higgins and a colleague were at a nightclub, 88mph, after a night of drinking. The colleague had offered Higgins a lift home in a taxi, which she accepted. The man said he first needed to swing by Parliament House to pick something up.

CCTV from the night shows the pair arrived at Parliament House’s ministerial entrance at 1:50am.

Security issued issued the pair with Positively Identified Passes, or green passes, which allow holders unrestricted, unescorted access. Security took the pair up to Senator Reynolds’s office, unlocked the door and let them in before the security officer headed back downstairs to continue the shift.

Once inside the office, Higgins has said the male colleague began looking for the item he needed to retrieve and she fell asleep on a couch. She later claimed that she woke to find the man on top of her.

“I woke up mid-rape, essentially,” she said. “Um, I, I don’t know why I knew he was almost finished, but I’d, I’d felt like it had been going on for a while or that he was almost done. He was sweaty. I couldn’t get him off of me. At this point I started crying.”

CCTV shows the man left Parliament House at 2:35am (about 45 minutes after arrival).

At 4:20am, security went to do a welfare check on Higgins at Senator Reynolds’ office. The security office said “As I approached Minister Reynold’s office, I opened the door and announced myself. So, yelling, ‘Security. Hello. Security, security’ … just so that she was aware that I was there,” she said.

“I got no response whatsoever.”

The security officer opened the office door. “As I’ve opened the door, I’ve noticed that the female was lying on her back, completely naked, on the lounge that was adjacent to the door, for which I’ve gone, ‘Oh,’”.

“The sound of the door or the breeze of the door opening has then made the female open her eyes, look at me. And then she’s rolled over onto her side.” “So, therefore, my [take] on it was she’s conscious. She’s breathing. She’s doesn’t look like she’s in distress. She’s just sleeping off her night. And with that, I shut the door, and I exited the room. I made sure her dignity was intact by shutting this door… I was trying to do the right thing by keeping her dignity intact.”

At 7:00 am another security guard did a welfare check but did not go into the office and called out from behind the closed door. No reported response.

Higgins is recorded as leaving Parliament House at 10:00am and took an Uber to her Canberra home.

The accused had denied he had sex with Higgins.

The world’s first female F-35 fighter pilot crashed a plane on its first flight

The world’s first female pilot, crashed an F-35 fighter on her first try.

After the publication of a video of the collision of an American F-35 fighter with the deck of an aircraft carrier, it became known that the world’s first female F-35 pilot was at the helm of the US Navy’s fifth generation fighter. This, according to American sources, was her first flight from the deck of an aircraft carrier, which was enough to destroy a fighter worth more than $ 100 million.

The information that the fighter was flown by a woman was presented to the media by one of the crew members of the American aircraft carrier Carl Vinson, noting that despite the fact that the woman had completed a full course of training and successfully completed the take-off and landing training program on the deck of an aircraft carrier, for her, the current flight was the first from the deck of a real warship.

It is noteworthy that in the video (50 Secs)you can hear that the crew is furiously giving instructions to the F-35 pilot, probably realizing that the crash of the fighter will be virtually inevitable, and literally in a matter of moments the woman is trying to align the fighter with the deck, but completely unsuccessfully.

The command of the US Navy has not yet commented on such information.

From something I posted last night – wonder if anyone has any thoughts:

Check out the WA government’s vaccine dashboard. The numbers don’t add up. WA has a population of 2.8 million. Govt claims ~93.6% of the population aged 12 and over are double vaxxed. Govt claims around 4.25 million shots have been administered. At first pass that doesn’t seem right. The population aged between 0-11 numbers about 600k – a decent chunk of the 5-11s have received their first shot, just awful. A decent chunk of the 12+ cohort have received their third. Seems to me that waaaaay over 5 million shots – probably nearer to 6 million – would need to have been administered to hit that 93. 6% rate, after accounting for shots given to the poor 5-11yo human guinea pigs, the million or so that are boosted plus those that only got one shot…something doesn’t seem right here.

Leaked Video Emerges Of US Stealth Jet Crashing On Carrier In South China Sea

In late January, a $135 million single-seat, single-engine, all-weather stealth fighter jet designed by Lockheed Martin crash-landed aboard the flight deck of the USS Carl Vinson in the South China Sea. I don’t have any reference, but she claimed that she went into the building with him because she didn’t want to wait in the taxi.

Has the whole taxi thing been explained?
She said (as I understand it) that she took a taxi with him as a convenient way to get home.
OK, but they went to Parliament House. How was that convenient for her? She hadn’t asserted that she had any reason to go there.
The explanation of that was that he said he had to just duck in there to pick something up and it wouldn’t take long, and she acceded to that.
OK, so why didn’t she wait for him in the taxi? Because, she said, she’d feel safer in Parliament House.
(Would she have felt unsafe at the front entrance with the security guards? But that’s a side issue.)
OK, but what happened to the taxi? Has anyone ever heard of a taxi driver letting multiple passengers all leave the cab and go into a building without paying?
So, maybe they paid the driver. OK, then what happened? Did the driver drive off looking for another job? If so, that blows the “convenient” argument right out of the water. (I’m presuming that at 2.00 am on a weekend there wouldn’t be a taxi rank outside Parliament House that was so long that they’d be sure of getting another cab straight away when they came back out.)
If not, what was the deal with the driver? Wouldn’t he just say “sure I’ll take you if I’m still here when you come back out”. But that too would blow a big hole in the “convenient” argument.
It only works if one assumes that they paid the driver and then the driver promised to wait for them – exactly why he’d promise that is not clear. Even then there’s something a bit odd – why would she risk the driver reneging?
Was it impossible for her to wait near the cab so that the driver wouldn’t start heading off without her knowing, but within sight of the security guards so the safety angle was covered? Maybe not, but it would be worth finding out.
And then, when they got into the minister’s office, how long were they there before she started questioning the “just got to pick something up, won’t take long” line – particularly if she’s claiming she only shared a cab for convenience and by hanging around in the minister’s office she was risking the driver getting impatient and going off for another fare.
Maybe that works if she walked into the minister’s office and almost immediately flaked out.
But remember, her story is that she was compos mentis enough to make a decision to go from the taxi to the building (and remembers her reason for doing so).
So the whole thing hinges on some rather strange interactions with the taxi driver, followed by a sudden transition from active decision maker to unconscious victim within a walk down a corridor. But how does one explain the bloke’s motivation? If he’d been intending all along to rape her when she flaked out, there was a potentially big flaw in his plan since she was still compos mentis even at the door of Parliament so how did he know she’d flake out at all? If he wasn’t planning to rape her all along, presumably it was a spur of the moment thing when she did flake out – which isn’t impossible, but it does seem far fetched that a Canberra staffer would do it in a Cabinet minister’s office just on a whim given the consequences which would inevitably ensue.
I’m not saying this is conclusive proof that she’s lying. However, there’s a very narrow range of circumstances in which her story is at all plausible.

I’d like to think so but I don’t think they could fudge the numbers that much. Also, that would put us at a similar vaxx rate as comparable countries. However, Australians have been terrified by an artificial depiction of Covid as presented by the media, and I think that has made us more compliant and willing to get vaxxed. In comparison, those other countries have been living with Covid pretty much continuously since early 2020 and have a much more realistic outlook on the threat it poses. So it makes sense to me that a higher proportion of Australians are vaxxed than the population of, say, the UK. But 95% vaxx rate here? Nah that’s bullshit.

Dunno, OCO. I’m very sceptical about any numbers offered by the gummint, although I’m less sceptical about the numbers that destroy their arguments. I figure that the mean and median ages of death from/with WuFlu are probably safe, for example. They exceed the life expectancy, suggesting that you’re better off with WuFlu. This is unlikely.

I certainly don’t trust the official numbers about vaxx rates. But I don’t trust anything the officials tell me. There is lots of evidence that the buggers will say and do anything that suits their agenda. Trying to get us to take a new and untested medical procedure by pretending nearly everyone else has done it would be exactly their modus operandi.

https://richardhanania.substack.com/p/womens-tears-win-in-the-marketplace

Given that (3) is so horrible and basically gives a veto to hysterical women over all public policy, we have to choose (1) or (2). I have no doubt that public discourse as a male space works better. That doesn’t mean women are barred from voting or discussing politics. They can participate in the public arena but as soon as they start crying over a Halloween costume or talking about “online abuse,” most people should roll their eyes and understand that someone without the emotional stability to even participate in the marketplace of ideas isn’t going to have the traits necessary to contribute much to it. I think we were closer to this ideal 20 or 30 years ago, but we’ve moved away from it under the pressure of civil rights law and women becoming more prominent at higher levels of important institutions. This is basically the way we treat men already; a male journalist crying over mean words instantly loses credibility, and rightfully so. The public space should be regularly purging people, and we can’t care if the purges have a disparate impact.

Ben Roberts-Smith case hit with twists as Nine‘s source unmasked and private documents released
Perry Duffin
Senior Court Reporter
@perryduffin1
NCA NewsWire
56 minutes ago February 9, 2022

The defamation trial of Ben Roberts-Smith has been hit with a series of dramatic twists; one SAS witness is backing away from giving evidence against the celebrated soldier, another may do the same, while a third has been unmasked as a source for Nine‘s journalists.

Meanwhile the Federal Court has released a trove of documents that expose the inner workings of Mr Roberts-Smith‘s intensely private “affair” and images of his injured ”mistress” which could decide crucial parts of the case.

Mr Roberts-Smith is suing Nine newspapers claiming they falsely accused him of war crime killings in Afghanistan when he was deployed in the SAS.

He is also suing the newspapers, and journalists Chris Masters and Nick McKenzie, over accusations he abused a woman known as Person 17 during a clandestine relationship.

Nine stands by the stories, saying the allegations are true, and opened its case against Mr Roberts-Smith by calling SAS soldiers to testify against him in the Federal Court.

The court is expecting to hear from multiple members of the SAS throughout the coming weeks including two soldiers known only as Person 56 and Person 66.

Nine‘s barrister Nicholas Owens SC, on Wednesday, told the court he believed Mr Roberts-Smith’s legal team had contacted two high profile lawyers – Philip Boulten SC and Peter Hodges.

In that contact, Nine claims, Mr Moses “expressed” that the interests of Person 56 and Person 66 may not be ”properly protected” when they are called to give evidence against Mr Roberts-Smith.

The identities of the SAS witnesses are closely guarded secrets known only to their lawyers and others closely involved in the defamation trial.

Nine claims Mr Boulten and Mr Hodges “through means unknown” were put in contact with Person 56.

Person 56 is now seeking to withdraw from giving evidence, Nine told the court.

Mr Owens claims the two lawyers will meet with Person 66 later on Wednesday and is expected to give evidence on Friday.

Person 66 has not made any application for that plan to change, the court heard.

Mr Boulten and Mr Hodges are not accused of any wrongdoing

According to court documents, Nine alleges Mr Roberts-Smith stood behind Person 66 and ordered him to execute one of two Afghan prisoners in a field in Syahchow in October 2012.

Former SAS soldier and Liberal MP Andrew Hastie was deployed during that mission, the court documents state, and is expected to testify for Nine saying he saw Person 66 looking anxious after the mission.

Mr Roberts-Smith denies that allegation entirely.

Person 56, the court previously heard, is expected to give evidence about Nine‘s “centrepiece” murder accusation where Mr Roberts-Smith is alleged to have kicked an unarmed shepherd named Ali Jan down a ”cliff”.

That shepherd was allegedly then shot dead by another soldier while lying injured in the dry creek bed below.

Mr Roberts-Smith denies that allegation as well – saying he shot dead a spotter in a cornfield during that 2012 mission within the rules of engagement.

The court has previously heard claims from Mr Roberts-Smith that Nine had done “a deal” with Person 56 that he would only have to give evidence about that single mission.

On Wednesday Justice Anthony Besanko agreed Nine could issue subpoenas to Mr Boulten and Mr Hodges and another notice to Mr Roberts-Smith‘s lawyers to overturn their communications relating to Persons 56 and 66.

Nine‘s main witness this week, an SAS soldier known as Person 14, has accused Mr Roberts-Smith of ordering the execution of another unarmed Afghan in 2012.

The court had ruled Person 14 would not have to answer questions from Mr Roberts-Smith‘s lawyers about whether he had spoken or met with Nine’s journalists.

But Justice Besanko, on Wednesday, reversed the decision and ordered Person 14 to answer the questions.

Person 14 told the court he had met and spoken with Mr Masters about rumours in the SAS involving Mr Roberts-Smith and a major raid in 2009 known as Whiskey 108.

Nine would later accuse Mr Roberts-Smith of ordering the execution of one Afghan prisoner to “blood the rookie” in his SAS unit and further accuse him of machine gunning another captive during that raid.

Mr Roberts-Smith denies that allegation and has told the court the man he shot dead had been armed and was killed under the lawful rules of engagement.

As Person 14 gave evidence the Federal Court released dozens of documents that had been entered into evidence in June 2021.

The documents contain marriage counselling notes between Mr Roberts-Smith and his now ex wife Emma Roberts, medical records, emails and text messages.

Some of those messages are between Mr Roberts-Smith and a married woman known as Person 17.

The court has previously heard the pair had been dating and had a volatile relationship – Mr Roberts-Smith maintains he dated Person 17 while separated from his wife.

Person 17, the court has heard, had hired a car and driven to Mr Roberts-Smith‘s marital home to expose their relationship in April 2018.

The text messages, released on Wednesday, show Mr Roberts-Smith accusing the woman of “outright blackmail” in the hours after she confronted his then wife.

“Please don‘t waste your time with intimidation or payback,” Person 17 wrote to Mr Roberts-Smith, the texts show.

“The benefit of seeing what you are capable of a few weeks back & knowing the threats you‘ve made to me since is that I immediately put in place ’insurance’ in the event that anything should happen to me or my family.”

Mr Roberts-Smith has steadfastly denied he ever threatened Person 17 and told the court she had lied on multiple occasions – his lawyers describe her as a “fabulist”.

Person 17 is expected to testify, for Nine, that Mr Roberts-Smith struck her after she got drunk at a swanky party one month earlier, in Canberra in 2018.

Mr Roberts-Smith totally denies that saying Person 17 fell down the stairs while leaving the venue and ended up with a black eye.

He told the court he stayed up all night tending to the injured and intoxicated woman at the Hotel Realm and photographed her injury.

The documents, released on Wednesday, contain an email chain where Nine‘s lawyers request those images.

The images, with Person 17‘s face covered by a black box, appear to show a woman in bed.

The lawyers for Mr Roberts-Smith, in the emails, tell Nine‘s lawyers that the original images were deleted and all that remain are screenshots.

“Unbeknownst to (Mr Roberts-Smith), at some point his former wife, while searching his belongings and mobile phone, had taken photos of the images of Person 17,” Mr Roberts-Smith‘s lawyer wrote in the March 2021 email.

Mr Boulten and Mr Hodges have been contacted for comment.

Have they established whether it was pilot error or mechanical failure?

No they haven’t calli. It will be some time before the investigation is concluded.

Bruce O’Newk:

I used to support Howard’s firearm buyback, but that was when I thought making firearms scarce would be a useful way to keep the underclass to the kitchen-knife level. Narrowly, it worked. Unfortunately now that all Australian governments have turned into 1930’s grade fascists I can see my error. Sorry.

I never supported it.

The world’s first female F-35 fighter pilot crashed a plane on its first flight

Sadly the USN would grab any lady cadet with both hands and physically carry her through training these days if that’s what it took, such is the woke imperative for equalidy. That’s not a good preparation for a carrier fighter pilot. I don’t know what her story is, but I’ve often seen women being levitated in such a way in corporations for that reason.

With the latter overwhelming the former, DrBG.
I believe that the vast majority of men would leap to the defence of an effeminate male who was was being bashed.

Very much a cultural thing. My sense of justice would certainly override my distaste for effeminate men. But then, I was raised in a Christian country. It would be different if I’d been brung up in Saudi Arabia, I suspect.

Bullshit.
Since the taxi was now a free agent, she could have given the driver her address and paid for the ride there from PH.
She had the option to leave.

Exactly. “I shared a taxi since it was a convenient way to get home, it drove somewhere totally different, and I watched it set off into the distance leaving me stuck there until another taxi could be summoned, instead of getting that taxi to take me home”.
Anyone think that’s a good enough basis for a “beyond reasonable doubt” guilty verdict?

That’s not a good preparation for a carrier fighter pilot.

John McCain crashed at least 6 Navy jets, plus causing massive loss of life by starting a fire on the USS Forrestal.

I don’t know what her story is, …

So why are you commenting on it for?

The stupid are not innocent, laws cannot protect the stupid. Neddy NutCase you are a prime example of stupid. Everyday you prove it. No law can be written to make you any different. If you ever get anything right it will be by accident. Look up the Oxford Dictionary of Stupid. In your version there will be a mirror. Thats what stupid looks like. Go away, you have nothing to contribute.
