Bruce Lehrmann’s defence barrister has accused ACT chief prosecutor Shane Drumgold of taking a “pejorative stab” at his client and abandoning impartiality to align himself with former ministerial staffer Brittany Higgins, the ­Sofronoff inquiry has heard.

Steven Whybrow, SC, told the seventh day of the inquiry probing the investigation into the ­attempted prosecution of Mr Lehrmann that he told police the decision to run a second possible trial against his client should not be made by Mr Drumgold.

In other developments on Tuesday, the inquiry released the transcript of a secret Supreme Court hearing over why the high-profile rape trial was sensationally aborted late last year that revealed the juror who brought prohibited material into the jury room had been deeply apologetic.

Evidence also emerged of a heated text message exchange ­between Mr Whybrow and prosecutor Skye Jerome after The Weekend Australian last year published a police review of evidence that included discrepancies in Ms Higgins’ account and concerns over her credibility.

On Tuesday, Mr Whybrow told the inquiry Mr Drumgold was not required to say he believed he had a reasonable chance of convicting Mr Lehrmann for the alleged rape of Ms Higgins when announcing he would not pursue a retrial due to concern for the former ministerial staffer’s mental health.

“I felt like it was a pejorative stab at Mr Lehrmann unnecessarily,” he said.

Mark Tedeschi, KC, who is representing Mr Drumgold, said the landmark Royal Commission into Institutional Responses to Child Sexual Abuse recommended directors of public prosecutions explain their decisions to lower the risk of communities ­losing faith.

Mr Whybrow said he understood Mr Drumgold’s concern for Ms Higgins and said he had held similar concerns for the welfare of Mr Lehrmann.

“Both the complainant and the accused have been subjected to extraordinarily hateful, uninformed and terrible comments on various platforms,” he said.

When Mr Tedeschi asked Mr Whybrow whether it was clear Mr Drumgold had considerable sympathy for Ms Higgins, he responded: “I was concerned he had aligned himself with Ms Higgins.”

Ms Higgins alleged Mr Lehrmann raped her on the couch in the ministerial office of their then boss Senator Linda Reynolds in the early hours of March 23, 2019, after a night out drinking with ­colleagues.

The trial was aborted after a juror was found to have brought outside material into the jury room, and Mr Drumgold said on December 2 he would not pursue a second trial citing concern for Ms Higgins’ mental health.

Many have concluded QAnon was a Deep State intelligence operation to lull Trump supporters into complacency in the runup to the 2020 election and to provide a new pejorative term for the Left to use against the Right. The timing of the rise and abandonment of QAnon postings adds credence to this belief. “Trust the plan” was a component of a sophisticated strategy (concocted far earlier than almost anyone now realizes) to ensure Trump’s 2020 defeat.

Sadly, this is all too likely.

Would you mind clarifying what you understand to be the import of that abstract you keep posting. In earlier posts you appeared to say that reverse transcription was unknown until 2021 when in fact it has been known for decades. This time it reads as if you consider that RNA templates playing a role in repair of DNA double strand breaks would be bad thing.

Perhaps he had in mind reverse transcriptase, the enzyme that, very occasionally, allows RNA write back into the DNA template. DOT knows his stuff is correct about this.

Perhaps CA who plan to use the day-night Test to lecture Australians about how “painful” the day is could instead impart some indisputable facts.

Gardner also warned that Cricket Australia would have difficulty finding someone to conduct a Welcome to Country. (a pleasant change in the winds)

She said: “Welcoming people on to stolen land is probably not appropriate”.

Well, here’s the thing, Ash and Cricket Australia, I don’t need to be welcomed to my own country, and I don’t think I’m living on stolen land.

I don’t think that as a migrant my right to feel Australian and entitled to call this country mine is any less than yours because of my ancestry or your ancestry.

And, guess what, the overwhelming majority of Australians in poll after poll feel precisely the same way.

Despite the persistent vitriol against the day from the bulk of the media, polls from a number of organisations including Roy Morgan, Deakin University and Core Data, show that the great majority of Australians support the national holiday and want it to remain on January 26.

A Roy Morgan poll conducted just five months ago found two in three wanted Australia Day to remain on January 26.

Elite athletes, woke local councils and other organisations should take note.

Bob and Bourne, perhaps I was being oversensitive re how my advice to Muddy was perceived. There’s no way I wanted to upset him so I was worried if I’d stepped over some line about dentistry. Nevertheless, maintaining teeth is important, as others have now noted here.

We have friends coming over for lunch so I am heading back to bed for another hour or two of sleep after Attapuss woke me wanting to play. He has suddenly become besotted with the little white felt mouse he’s ignored for months and I have to throw it down the hallway for him. I do enjoy the transports of bounding delight he displays when he catches it and brings it back for another throw, but he can be worse than any toddler sometimes re early morning playtime demands. Ash Gardiner might also like to note that by taking the fleet up from Botany Bay on the 18th and thus ‘settling’ legally by international law in Sydney Harbour, and then raising the British flag on the 26th, Governor Phillip beat the French to taking possession of a broadly defined Eastern Australia by only hours, for La Perouse sailed into Botany Bay on the day Phillip sailed out and up to Sydney Harbour, which Cook had mapped out as the proper place to settle. Botany Bay was a ruse to hide that fact.

The French were rather different in their colonising approaches to the British. Ash Gardiner should thank her aboriginal lucky stars that the precepts of the Scottish Enlightenment came with the British from the very moment of raising that flag, where all were declared equal under the law, while the French were just working up to a bloody revolution about rights that in 1789 till 1791 caused complete chaos and many deaths.

Did Shane Drumgold succumb to #MeToo zealotry?

The ACT Director of Public Prosecutions has made some wild claims about political conspiracies between the Morrison government and the Australian Federal Police, between senior ministers and Bruce Lehrmann’s defence team, and between the AFP and defence lawyers.

If valid, these very serious claims would destroy our trust in the proper administration of justice. Therefore, claims of this gravity must be supported by evidence.

Yet Shane Drumgold’s claims were not supported by evidence. They were so manifestly unmeritorious that Drumgold admitted last week he was mistaken about political interference in the investigation of Lehrmann.

The lack of evidence to support Drumgold’s allegations of political interference by the then government must, invariably, lead us to ask why on earth the DPP made these claims.

Was he so determined to secure a successful conviction that he was willing to put these serious claims about political conspiracies to the jury without any evidence apart from Brittany Higgins’s claims? If so, why was the DPP so determined? What motivated him?

During the first week of the Sofronoff board of inquiry into the ACT’s criminal justice system, Drumgold admitted to many errors and misjudgments during his handling of the prosecution and trial of Lehrmann, as well as events after the mistrial.

He admitted to potentially misleading the court, and for paying insufficient attention to the presumption of innocence.

But it’s high time we turned the question of political interference in the prosecution of Lehrmann on its head and asked whether the DPP’s judgment was affected by the political whirlwinds that engulfed this national scandal.

These forces were amplified by the politics of the #MeToo movement, where advocates have given, and continue to give, short shrift to principles of due process, the presumption of innocence and a fair trial. That background is beyond question.

In opposition, Labor pursued the rape complaint for political purposes. It did so ruthlessly, day in and day out, especially targeting Linda Reynolds, Scott Morrison and even its own senator, Kimberley Kitching. The Australian understands that text messages between Higgins and her partner, David Sharaz, record their contact with Labor senator Katy Gallagher about the politics of using this rape allegation against the Coalition government.

Sharaz was also caught – during a recording for Higgins’s interview on The Project – mentioning the political timing and his good friend, understood to be Gallagher. The Australian understands that other messages between Higgins and Sharaz mention Higgins’s contact with Labor MP Tanya Plibersek. This was before Lehrmann being charged, raising the question of how far these potent political forces extended.

The pressures were so pervasive that Morrison apologised to Higgins in parliament, joining the media and political forces that daily undermined the principles that underpin our criminal justice system, including the presumption of innocence.

The question on many people’s minds is: Why did Drumgold make so many profound errors of judgment? Was Drumgold ill-suited to exercise the power and duties that attach to a DPP, a position where a person is entrusted with the solemn, careful task of administering justice?

Others may ask whether the roiling political forces, fuelled by federal Labor and the media, to weaponise a rape allegation also ensnared Drumgold in some way, affecting his judgment, from time to time, as minister of justice.

For example, did these political whirlwinds affect Drumgold’s judgment about prosecuting Lehrmann given grave concerns among senior AFP officers that there was not enough evidence to charge Lehrmann?

Did these political forces affect Drumgold’s judgment when he made brief and dismissive comments to Lisa Wilkinson when she sought his advice about her Logies speech? Did those political forces affect Drumgold’s other decisions, including: when he told ACT Chief Justice Lucy McCallum that the section of a proofing note concerning his comments to Wilkinson were contemporaneous, and created by his junior solicitor, when he knew that neither of these things were true; when he decided to target Aaron Patrick’s book Ego, about Malcolm Turnbull, but not other media that mentioned the Higgins rape allegation; when he dismissed AFP concerns about Higgins’s inconsistencies; when he fought to keep police material from the defence; when he claimed privilege over a document even though he had not read it; when he provided wording to a junior solicitor that resulted in an affidavit used to oppose disclosure, that the DPP agreed last week had the potential to mislead McCallum?

The list goes on. Did the heated and impassioned political environment affect Drumgold’s decision to treat Fiona Brown, arguably the most important witness in the trial, so poorly that she wrote a letter of complaint to the Bar Association earlier this year, and has rejected his claims about her at the inquiry last week?

Did Labor’s weaponisation of this emerging national scandal play a part in Drumgold’s claim, put to the jury – with no evidence – that there were “strong political forces at play in the period immediately after the events, through the election and beyond” and that “from the evidence and actions of Senator Reynolds during this trial those same political forces were still a factor”?

In other words, did Drumgold behave, at times, more like a Labor politician than an objective and fair-minded minister of justice?

Did political forces play a part in Drumgold’s extraordinary and emotional letter to AFP boss Neil Gaughan in November last year alleging that police had undermined the prosecution and trial of Lehrmann, again with not a skerrick of evidence?

Did political influences come into play when Drumgold decided to release that letter to The Guardian, earning himself a media medal for the fastest Freedom of Information response – so fast that names were not redacted and people mentioned in the letter were not consulted, as required by FOI laws.

That was such a dodgy decision that the DPP admits in his inquiry statement that, following a report by the ACT Ombudsman, he apologised to the AFP and instituted a training course for his executives “including myself”.

Did political forces play a part in his highly controversial speech in early December last year when he praised Higgins when announcing he would not retry Lehrmann? In the inquiry he admitted he didn’t think enough about the impact of that statement on the defendant’s right to the presumption of innocence.

What on earth explains the long list of rash and ill-conceived decisions by the DPP? Was it #MeToo zealotry? Did political pressures ensnare him? Incompetence?

Any mix of these possible factors is a dangerous concoction in the hands of a DPP who exercises the power and authority of the state against individual citizens.

The questions go on. Did any of these factors impair his directions to junior staff? Did the power imbalance between him and his staff lead to poor decision-making?

Did the DPP have any contact with Labor MPs, federally or in the ACT, about this scandal? If so, to what effect? If there was no direct communication, what role, if any, did Labor’s pursuit of the rape allegation for political purposes play in the DPP’s decisions?

One of the most important tasks for Walter Sofronoff KC will be determining the motivations of the DPP, especially when poor decisions were made. That means answering questions as to what role, if any, political forces played in the poor decisions by the DPP during this debacle.”

I know the answers to Janet’s questions above, and I suspect many others here also know the answers.

* I use the word “persecution” deliberately. From day one this has been a political witch hunt, drenched in political malfeasance, targeting a man to bring down a government.

Voice support slides again as debate rages over model (SMH, 17 May, paywalled)

Support for the Indigenous Voice has tumbled from 58 to 53 per cent over the past month in the crucial “yes or no” question that will decide a referendum on the issue later this year, deepening the risk of defeat after furious disputes on the change.

The sharp fall in support includes pivotal shifts against the Voice in big states such as Queensland and volatile swings in smaller states that challenge assumptions that Australians will cast a majority vote for the contentious change to the Constitution.

Resolve poll. Sky also has a story but it didn’t have any useful text so I grabbed these two paras from the Silly, as they give the essence. Looks like the punters aren’t so sure about what they’re finding under the hood, and the more they find out about it the less they like it.

A Catholic parish not far from me tried an acknowledgement at the start of mass a few weeks ago, there were sufficient complaints they haven’t done it since.

Jacinta’s short and pithy “No” ad taps straight into the racism angle which is the Voice’s overriding feature. And she underscores her point by referring to her family.

An excellent foil to the Wormtongues in the “Yes” campaign, pretending that it’s simply “Constitutional recognition” of aborigines. If it was simply that, why the wall-to-wall nightly nagging? The idea is that volume and frequency will drown out any misgivings. And they may be right.

The irony – demands for a Voice that simply won’t Shut Up.

Feeling very sad and contemplative this morning. Yesterday we revisited the Australian War Memorial after a number of years. Brendan Nelson did a wonderful job in renewing and reconfiguring many installations. Overall, it is no longer a collection of war memorabilia but is a confronting and powerful tribute to the sacrifices of Australians. It also visually shocks with photographs etc of the terrible conditions suffered and the horrible deaths. It does not take a back step. As we approach a defining confrontation with a militant and aggressive China, it is so very relevant.

We left a red poppy at the Afghanistan section – for the SAS fatalities. A response to the current vendetta in the courts against the Special Forces. We noted the display of the uniform of Ben Roberts-Smith & wondered when “they” would remove it.

Incidentally, the huge new building program does impinge at the moment & the entry points are not well signposted.

All cultures are, by necessity, ‘racist*’ – its a variant of the ‘paradox of tolerance’ (where a culture of infinite tolerance will inevitably be replaced by an intolerant culture which they tolerate, but does not tolerate them in return). As an example, the near compulsory religion of Islam in Afghanistan, Iran and much of the Middle East has reduced any alternatives to a persecuted rump.

* A gentler term is ‘in group preference’, for those who allow themselves to be shut down by words rather than arguments.

Grandpa Ed Simpson is a dickhead of the highest order. Any public dental organisation found using mercury amalgam in these litigious days is wide open to being sued for its back teeth (as would any private dentist).
