Earlier I put up a scientifically verified video of that doozy carpet muncher, rapeinoe, missing the losing kick which saw the US lesso team get booted out of some women’s BS sport. Doubt was expressed about the ability of rapeinoe to not only miss the losing goal but to propel the ball back in time and be responsible for hitting biden in the back of his empty head causing him to fall, again, at a military function. Let me just say it is this sort of scepticism which is destroying science and our precious body fluids. Sadly, if the Referendum is on the 14th of October we will be in Europe so cannot betake ourselves to a likely electorate and go hell for leather handing out No how-to-votes. Presumably we can postal-vote beforehand to be two of the ten people in Wentworth (Cassie’s in that lot) who will be voting No. Our Ultra-Teal Spender has been running Yes Information Sessions on public money.

If the Voice flops at the referendum, and I suspect it will (although we can’t be sure of anything nowadays), Sleazy will then legislate it, and the legislation will easily pass with the help of the Greens and Pocock. It will be “a la ATSIC” all over again.

I also expect that if it flops, we’ll see an enraged Sleazy and his government. They don’t take kindly to rejection, because they’ve had little of it. They’ll take it out on Australians, that is you and me. Just watch. It won’t be pretty.

ACT Chief Minister Andrew Barr and the Attorney General Shane Rattenbury have suggested Walter Sofronoff – the man tasked with conducting an inquiry into the Bruce Lehrmann trial could face charges over leaking the Board of Inquiry report to journalists.

During a briefing regarding the report on Monday they also suggested outgoing ACT Director of Public Prosecutions Shane Drumgold – the man responsible for case – could also face charges.

“This is not a government that acts on a whim. We act with care. We act with the focus on due process, and we were stepping through that carefully. It’s also part of the reason why the Chief Minister was so clear that we intend to take a little bit of time to look at the report before releasing it,” Mr Rattenbury said.

Shadow Attorney General Michaelia Cash said she is now pleased the report has been released publicly.

“I’m pleased to say that the AC T government have accepted the 10 recommendations, but I think there’s a long, long, long way to go to actually restore confidence in the ACT justice system,” Senator Cash said.

“If you don’t have confidence in your justice system as Australians, what do you have? If you are ever charged you want to know that if a matter is going to trial, and in particular a criminal trial, a criminal trial that the prosecutors act in particular without fear or favour.”

I suggest that could only happen if it is offered up as a promise for the next election. In other words, even Sleazy would understand the gigantic political risk of trying to legislate the Voice after it’s been defeated. With the next election due 2025, it would be crazy brave to foist it on an electorate that has already said no, in 2024.

In fact, I think the referendum path is actually a cunningly smart way to approach the issue. If it fails he can blame racist Australians and then say we can’t legislate ‘cos it was defeated. Game over. If it passes, then the feeding frenzy will begin and he can say “well, you voted for it”.

Prime Minister Anthony Albanese will use the next meeting of national cabinet to campaign for a federal public holiday, should the Matildas make it to the World Cup final.

With Sam Kerr expected to be back on the pitch, the Matildas will take on Denmark on Monday night in the do-or-die round of 16 match.

Should they beat the Danes, the Matilda’s would then take on either France or Morocco in the quarterfinals.

If they were to make it all the way to the grand final – to be played on August 20 – Mr Albanese says he would make a personal appeal to all state and territory leaders to instate a public holiday.

“Public holidays are up to state and territory leaders. But, you know what, we’ve got a national cabinet coming up next week,” he told 2Day FM on Monday.

“I’ll be clearly putting the argument, and I reckon they’ll fold like tents. They will go one after the other.

“Because if we can get there, that would be remarkable.”

Mr Albanese said Matildas fever had gripped the country, and that while he wouldn’t be able to attend Monday’s game due to parliament sitting, he would be eagerly watching.

“I think the legacy in 10 years’ time, 15 years’ time, will be that young girls and young boys for that matter who are watching the World Cup and being enthused, will participate,” he said.

“And some of them will go on to become Matildas or Socceroos. It’s just been fantastic.

“I couldn’t have imagined 30 years ago that you would fill stadiums for women’s team sport – it’s about time and it’s just fantastic.”

Mr Albanese also paid tribute to the national netball team, the Diamonds, who defeated England in the World Cup final in South Africa overnight.

“Australia will welcome them back … We’ve been the most successful team in netball for quite a while,” he said.

The extensive legal team fighting for Gina Rinehart to maintain her grip on the lucrative Hope Downs mines have begun opening their case — starting with a microscopic investigation of a 50-year-old royalty deal that could now be worth hundreds of millions.

The trial of Wright Prospecting vs Hancock Prospecting entered its third week on Monday, with lawyers for Mrs Rinehart’s powerhouse resources company given their turn.

Noel Hutley SC — whose previous clients have included James Packer, Rupert Murdoch’s News Corp and the Commonwealth Bank — will be doing most of the talking as Hancock lays out their case.

Mr Hutley’s legal fee has previously been put at around $20,000 a day.

And he spent the first half of his first day fighting back against a claim by the company founded by oft-forgotten Pilbara pioneer Don Rhodes — who claim they are owed 1.25 per cent of the royalties from some of the Hope Downs resource.

An agreement drawn up between Mr Rhodes and Lang Hancock in 1969 is the linchpin to that argument.

Eight years ago, Hancock Prospecting unsuccessfully applied to have the entirety of that claim thrown out.

And so, Mr Hutley said the words drawn up when Mrs Rinehart was just 15-years-old spoke for themselves — and meant there were “fatal” flaws in their lucrative claim.

He pointed out that the rights of occupancy to the mining reserves held by the Rhodes company, DFD Rhodes, and another group, known as the Nicholas brothers, expired without renewal in 1969 and 1979.

“No ore was ever produced by anyone from any of the rights of occupancy or before the cancellation of the temporary reserves,” he said.

“We submit that no mining tenements ever ‘issued from the reserves in issue as contemplated’, which we submit is fatal to the Rhodes royalty claims.”

Mr Hutley accused the Rhodes lawyers of “stretching language”, and even ignoring basic grammar within the deal.

And ultimately, Hancock says Rhodes shouldn’t get a cent in royalties out of the joint venture between Hancock and Rio Tinto.

In the coming days, Hancock’s defence will shift to the claim by Wright Prospecting, who are not only claiming royalties from some of Hope Downs, but also ownership of a portion of it — based again on historic agreements and documents dredged up from WA’s mining archives.

The most stinging portions are likely when Ms Rinehart’s lawyers address the claim of her children against her, a claim which they say involved fraudulent manoeuvres to remove a huge slice of the Hancock empire from their reach.

Ms Rinehart says that claim is also without merit — and should not be in the Supreme Court at all, given it is the subject of a confidential arbitration in the Federal Court being heard by former Chief Justice Wayne Martin.

The trial continues.

Quote for Attapuss’ mouth is between $lK to $2.3K. Costed right down to individual sutures now the full quote has come in. Whew. Hope he’s a mid-range case. It’s getting to rival my son’s full autism work up which is coming up soon. That’s only $3.5K and takes many hours of a psychologist’s time. The cost of services is rising fast, it’s not just at the supermarket.

Still, I love Attapuss to bits. The vet said as she came towards Attapuss on the table that he couldn’t push himself any closer in to me than he was doing unless he crawled under my sweatshirt, which he was trying to do. The sore mouth does explain some of his neediness lately. My son will be extra careful to mash his food until we return.

Former commando Heston Russell has admitted during his defamation case against the ABC that he gave a “fake” document to one of the broadcaster’s journalists when they were researching a story that is not at the centre of his lawsuit.

Russell, a former platoon commander, is suing the ABC for defamation over two articles published online in October 2020 and November 2021, and a related television broadcast.

As part of his claim for aggravated damages, Russell has alleged a separate ABC article published in December 2021 on a different topic, which linked to the earlier articles, was published to harm him. He is not suing for defamation over this article.

On Monday, Russell was asked about a document he sent ABC journalist Josh Robertson before the reporter wrote the December 2021 article, which referred to Russell’s alleged dealings with veterans’ mental health charity Swiss 8.

During a hearing last month, Russell initially told the court this document was a genuine invoice for fitness equipment he ordered in 2020 for Swiss 8, his employer at the time.

Justice Michael Lee asked Russell during a hearing in Sydney on Monday: “I thought we got to the stage … where you agreed that what you sent through to the journalist was not a genuine invoice; do you remember giving that evidence?”

“Yes, your honour,” Russell said.

“So you knew on the 30th of December 2021 [after the ABC’s article was published] that what you had provided purporting to be a genuine invoice was, in fact, a fake invoice?” Lee said.

“Yes, your honour,” Russell said.

“So was the reason you didn’t seek a copy of what you say is the original invoice on 30 December 2021 because you’d already provided a fake invoice so you didn’t need a genuine invoice?” Lee asked.

“Yes, your honour,” Russell replied.

Under cross-examination on July 28, the first day of the trial, Russell told the court he had altered a document bearing his own company name and address to include Swiss 8’s name and address.

Asked why he had initially described this as a genuine invoice, Russell said he was confused by the question and in any event “it did represent the correct invoice”, which he could not locate at the time.

He denied trying to mislead Robertson and said the altered document was an “exact representation of what occurred”.

The YouGov poll is the one consistently showing support for YES…. but then something weird happened… but I don’t know how this writer ends up with a conclusion on Newspoll:

Between the June poll and the one conducted in July, virtually all of those working in the public affairs and polling unit at YouGov left; the departures included the head of the unit (and chair of the Australian Polling Council), Campbell White.

Did the number and quality of the personnel heading out the door have an impact on the analysis of the more recent poll? If the changes at YouGov have affected data quality or the quality of the analysis, and aren’t corrected, then — much like support for Labor or support for the Voice — Newspoll’s status in Canberra might slide as well.

One of mums ex-friends (they were close for decades, then a big falling out) and friend of the family has had 5 or so incredibly bad years.
Her eldest shot himself on the front lawn of his ex’s house in front of her and the kids.
Her husband drank himself to death.
Her youngest son just died, drugs or heart attack (he had a weak heart from a previous overdose that damaged it).
Shes now all alone in the big flash house on the hill with at least one of her sons kids attacking her because the will cant be finalized till the autopsy.

Cling to what you have cats, theres an endless amount of misery the world can inflict on you if it takes a mind to.

National Yes 43%; No 46%; Undecided 11%.

NSW Yes 45%; No 42%; Undecided 13%.

VIC Yes 44%; No 44%; Undecided 12%.

Victoria. Neck and neck. Either side pulls better than half of the 12% Undecideds they win. Too close.

Queensland. Pretty much a write off for the Yessers. All they can hope for is damage control on the National tally.

SA. At 48% Yes and 10% Undecided it os a probable Yesser win.

WA. Totally gonesky for the Yessers. Even ditching the Heritage Grift Act won’t save it. Again all they can hope for is damage control on the National tally.

Tassie. Yessers would need to snag nearly 80% of the Undecideds to get over the line.

So it looks like failing nationally and probably falling two states short on the state by state vote (only NSW and SA as possibles).

1999 Republic referendum: 95.1% turnout.

Of that 95.1%, 0.86% were blank or invalid.

As turnouts have decreased in general elections along with informal votes, the idea that the undecideds will have a literal forced choice is a suspect assumption.

You have to assume at least 5.76% of the 11% undecided are likely not going to vote.

So, that’s likely more than half – which means that the “breaking YES” actually needs to be nearly 100% (97.5%) for an overall YES vote of 50% + 1 measly vote.

I’m starting to become confident the Voice is cooked.

Then ask him, and the others, if they would support wording that any dispute could not be taken to the high court or any court whatsoever and the final word comes from the parliament. If TAS is 48% NO with 9% undecided and a mere 5.75% of votes do not turn up or are informal, then 48/94.25 = 50.93%, NO, merely by assuming most if not all of the undecideds will make up the informal/failure to votes.

In the 2022 Federal election, the turnout was 92.43% with 5.85% blank/invalid votes for Tasmania.

Tasmania also swung towards Morrison in that election by 2.3% and against the ALP by 6.3%.

The population pyramid (by age) of Tasmania means that if votes are determined by age cohort, then it simply won’t get up, even with a 100% turnout of YES, NO and undecided voters and a favourable break to the YES nationally.

That should put pay for the Georgia phone call but precedence is ignored by demorats hence that fat pig’s suit against the orange God in NY based on stormy and election fraud after superior courts and the US electoral commission have already looked at this and dismissed it with costs which is unusual in the states.

The referendum proposal for Australia to replace Britain’s Queen Elizabeth II as head of state and become a republic is headed for defeat, according to a poll published Tuesday.

With four days to go, the latest Newspoll published by The Australian newspaper shows 54% of people surveyed are against the proposed republic, while 42% are for it. Four percent were undecided in the poll of 1,250 people across Australia over the weekend.

There was a slight swing, however, towards the republic compared to a Newspoll taken one week previously. In that poll, support for the “yes” case was 41% and support for the “no” case was 56%.

The final national vote was 44% YES to 56% NO with an informal vote of 0.86% and a 95.1% turnout – compare that to 42% yes polled, 54% no polled and 4% undecided.

The presumption that the undecided voters will break heavily to one side or the other is a hell of a bold call to make. It just doesn’t bear out with the reality of choosing not to vote, voting informally and that the polls are likely valid with the sample sizes and repetition. The margin of error won’t save the Voice and it didn’t help the Republic.

Can’t do that head prefect; once something is part of the Constitution the HC must adjudicate on primary disputes involving that part of the Constitution. The day after the screech gets in tommy the commie, terrific teela, marcia, birney and the rest of the shitboxes will be off to the HC to get an interpretation on what the screech can do; and based on the Uluru statement from the arse what it can do will be anything it wants.

Every time nuclear energy is mentioned anti-nuclear Australians scream about the dangers: meltdowns, radioactivity, rivers of toxic waste and so on.

They know none of these concerns are statistically or technologically realistic. And they know their own panic is a pose. They’re fright frauds. Imitation invertebrates.

If not outright scaredy-cats, they’re at least atomic kittens.

France is loaded with nuclear plants. Dozens of the things are scattered across a landmass barely one-fourteenth the size of Australia – yet there is no chance in hell of any anti-nuke lefty ever knocking back a free flight to Paris.

When visiting France our anti-nuke warriors moderate their meltdown anxiety. They relax about radiation.

Prime Minister Anthony Albanese, a long-time atomic opponent, seemed perfectly happy when visiting Paris last year despite being in a nation overwhelmingly powered by nuclear energy.

But Albo then returned to Australia, where he dutifully recycled the left’s standard nuclear fear fakery.

Responding to the Coalition’s exploratory Yes campaign on nuclear energy, Albanese sneered: “No one loves a reactor like a reactionary, which is no wonder they’re so obsessed with nukes over there.”

Thrilled with his own wicked wordplay, Albanese tried it on again a few weeks later. “The shadow minister is looking at the nuclear option,” he told parliament. “No one likes a reactor like a reactionary.”

Those “reactionaries” presumably include, as has been previously noted, late Labor PM Bob Hawke, Gaia guy Tim Flannery and ex-British Labour leader Jeremy Corbyn, who were all pro-nuclear at some point or other.

Albanese’s attempts at rewriting history clearly aren’t limited to his own Indigenous treaty views.

And here’s another reactor reactionary for Albanese to consider: former US President Barack Obama.

In 2014, Obama’s government approved loan guarantees for a massive scratch-built nuclear power project near Waynesboro, Georgia.

“The President wants to make clear,” US Energy Secretary Ernest Moniz said at the time, “that he sees nuclear energy as part of his carbon-free portfolio.”

And lo, the Obama government’s reactor fired up for public energy delivery for the first time last week.

“Plant Vogtle Unit 3 has officially reached commercial operation!!” Westinghouse Electric nuclear risk analyst Jenifer Avellaneda Diaz celebrated online.

The plant, she added, is “the first newly constructed nuclear reactor deployed in the United States in over 30 years and one that can power 500,000 homes and businesses”.

There you go. Science grad Jenifer is not afraid at all of nuclear energy, while a majority of our political class is pretend-petrified of it (selectively, anyway. Their mock alarm evaporates when they’re cruising France – or any other nuke-fuelled nation – on our coin).

Besides all their panic play-acting, Australian anti-nuclear types love a location scare. In 2022, Albanese followed long-established Labor tradition by demanding to know “where the plants are going to be”.

In Teal seats, ideally. Or just about anywhere. The French seem to manage. And so will everybody around Plant Vogtle Unit 3, Obama’s only gift to his nation.

The reactor will not only provide power to half-a-million houses and businesses, but it’ll also provide Australian observers with ways of measuring the economic and social impact of a newly operational nuclear facility.

Some data is already available. It just so happens that the Augusta National Golf Club, site of the annual US Masters tournament, is just an hour or so from Plant Vogtle Unit 3’s immense atomic glory.

Every year local hotels make an absolute killing. In 2020, for example, the charmingly straightforward Rodeway Inn – “all rooms include a clock radio and are warmly decorated with carpeted floors” – jacked up its prices from $75 a night to $1520.

If demand is any guide, hotels seem to be coping with their new nuclear neighbour. The Rodeway Inn is already completely booked out for the Masters next year, obviously wrecking my April holiday plans.

Speaking of money, Australian politicians may claim that the new nuclear plant’s budget blowout is evidence that nuclear is too expensive for Australia.

Please. The “too expensive” argument died when our politicians incinerated billions upon billions during the pandemic.

At least a nuclear investment will provide energy – unlike our pandemic madness, which generated only debt. Let’s drop the panic and power up.

The votes of people in the Australian Capital Territory and Northern Territory are only counted in the national vote. If a referendum is approved by a double majority, the change is made to the Constitution. If the double majority is not reached, the referendum has not passed, and the Constitution is not changed.

Earlier I wrote how devolution in the UK and self government here in the ACT and NT is an ongoing disaster because those jurisdictions end up electing leftist governments for perpetuity. The ACT is now a safe haven of leftist governance, and there is probably no way in the world now that any right of centre government will ever be elected again in the ACT. Put simply, the ACT is now a one party territory.

And tonight on Credlin Oz political columnist Dennis Shanahan confirmed what I wrote earlier. Shanahan lives in the ACT and he said, accurately, that there’ll be little to no accountability for Barr and his government, particularly electoral accountability.

I noticed this in NY when I was there and it appears that it’s also the same thing in Oz. People appear to be wearing various examples of sneakers , even at night in restaurants.

Is this some sort of trend coming out of covid?

For those like your good self who don’t know their way around Melbourne, Attwood is a suburb in NW metro Melbourne. Its location near an airport saw it as a favoured site for a quarantine facilities, along with Avalon. The site was ultimately built slightly further north at Mickleham.
Now that we have dealt with that little diversion, let’s go to the tape.
When our very own Concentration Camp Chicken Little, St Ruth, was having his clock cleaned on a daily basis, he had a couple of ardent supporters, running interference and treating him like their very own sponsor child.
Firstly there was MT was dropping “construction industry insider” tips about “suspicious irregularities” in the planning (can’t say too much, but I know a bloke … )
Secondly came Thought Leader who initially thought it all very plausible, but eventually fell back to “well, it’s just a bit of hyperbolic exaggeration to make a point” and “at least he’s doing something“.
Of course, it all fell apart the day the Queensssland Concentration Camp closed without having executed a single Member of The Resistance, with that immortal declaration of surrender from St Ruth … “Well, what was I supposed to think?”

The high court wouldn’t be able to interpret anything more than what is stated.

As BJ says above the screech is much more. Any reasonable legal eagle could get a ruling that the screech empowered any 3rd nations to have any whitie as a slave and alround arse licker.

I don’t know the numbers for past referenda, but the chance of an accidental informal ballot on a Yes/No question is much lower than, say, a bedsheet sized Senate paper, or a reps ballot with 10-12 candidates.

I then informed her about the Uluru Statement, the treaty and reparations in perpetuity. She was visibly shaken by all this. I urged her to discuss it with her friends and work colleagues, most of whom, she admitted were going on feelz (like her) rather than informed conviction. Also, they’re driven by those feelz to do ‘the right thing’ as pushed relentlessly by the Yes. Hence my apprehension for the outcome of this referendum.

The above is a very close, if condensed, description of our conversation.

*I know that the actual figure is far in excess of this, but I always underplay to avoid being accused of exaggeration.

The presumption that the undecided voters will break heavily to one side or the other is a hell of a bold call to make.

I don’t think you can use the Republic referendum as a template. I don’t recall there being the level of vitriolic labelling from the pro side as we have with this one. An pre-poll undecided in 1998 was genuinely undecided or uninterested.
I have suspected that the “undecideds” this time contain a significant number of “shy No” voters, as we saw with Trump in 2016 or Brexit. This is supported by the Redbridge poll which showed that when the Undecideds were forced to choose, they broke 2/3 to No.
So I do believe those declaring themselves as Undecided will break to No by at least 60:40, and Redbridge polling supports this.

In my part of the world not so much. I wear sandals and sports shoes. COVID has nothing to do with it, we’re just more practical here. Ties are rarely seen. I’ve always hated ties. My lifelong reason for avoiding ties was reduced oxygen supply to the brain. Turns out that might be true …

My concern is that even a formally separate and legally non-binding Voice will be able to exert an emotive blackmail on political leaders – they have already shown themselves quivering lumps of jelly at any accusation of ‘racism’.

But I would not be surprised to find a High Court discovering obligations of the legislature to the Voice. For example, they insist it is only intended to advise. But suppose the Voice were to make the point that advice supplied but not heeded would defeat the purpose, and that therefore there must be a mechanism to ensure advice is being given weight.

Now, the people being given advice, and possibly ignoring it, cannot be entrusted with deciding if advice is being understood – only those giving the advice. So in this roundabout way the Voice would be able to set the terms for how advice is acted upon.

I can’t member who it was, but a former High Court judge warned that the High Court could be tied up for months, if not years, by actions resulting from the Voice.

The word advise or advice is not mentioned in the screech. The word used is representations:

In recognition of Aboriginal and Torres Strait Islander peoples as the

At law a representation is a statement of fact. Normally in contractual disputes a represented fact may be disputed. But if the representation is grounded in the Constitution there is no dispute possible except possibly to the extent of the fact. I would argue that when a screech representation is made it will be held by the HC as a fact which cannot be ignored by parliament which enabled by clause 3 will have to legislate according to the representation.

In short the screech will run this fu.ked in the head backwater. Until the chunks get the shits with the tom foolery and send over a few battalions to ventilate the black and white arseholes.

1999 had 95.1% turnout and 0.86% invalid/blank votes.

So I do believe those declaring themselves as Undecided will break to No by at least 60:40, and Redbridge polling supports this.

I thought the YES case claimed nationally they were breaking 65% to YES.
