It is arguable that that particular section of the constitution does NOT apply to the president – that has never been litigated as far as I know.
As someone else noted, the president is not an “officer” of the US, he is an elected representative, and that section of the constitution lists several elected positions, but doesn’t list the president.
So there would appear to be at least 3 arguments to be made for Trump:
1) that while he was impeached by the house, the senate did not convict him and there have been no civil or criminal charges of rebellion or insurrection against Mr Trump, laws regarding which were passed by congress shortly after the civil war to “enable” the constitutional amendment that bans such people;
2) that his words and actions, regardless of whether he was indicted and/or convicted or not, do not rise to “insurrection” anyway (eg: “March peacefully and patriotically…”, “We are the party of law and order…” and so on) and were in fact covered under his first amendment right to free speech;
3) that, as above, that section of the constitution does not apply to the position of president of the US.
I suspect Trump may file for SCOTUS listing all three and maybe some other things as well. We’ll see, but it is not as simple as the Disinformation Industrial Complex (aka MSM) make out.
If SCOTUS is nervous about it, they may deny the DoJ prosecutors request to go straight to SCOTUS, and instead demand that they go through the entire DC appeals process first, which would likely extend the time before it gets to SCOTUS hearing it until AFTER the 2024 election and so it would become moot and they can dodge the entire shit-fight.

Freeze order plan for Brittany Higgins’ assets
Brittany Higgins and her partner have just packed up and moved to start a new life in France, but they have been hit with another snag.
Former Liberal Minister Linda Reynolds is considering seeking a court-ordered freeze of Brittany Higgins’ assets in the wake of her move to France.
Senator Reynolds — Ms Higgins’ former boss — is suing both Ms Higgins and her partner David Sharaz for defamation over social media posts on Twitter and Instagram.
Her lawyers wrote to Ms Higgins’ lawyer Leon Zwier on Tuesday signalling they plan to ask the Supreme Court of Western Australia for the freeze orders which restrain a party to a case from selling or moving assets while a legal action is still in process.
An extract of the letter sent to Ms Higgins was obtained by The Australian.
“If such reports are true, we consider that an application for freezing orders is appropriate,’’ the letter states.
“Please advise as a matter of urgency your client’s intentions in respect of her travel to France and your availability to confer in respect of our client’s proposed application.”
Ms Higgins, who secured a $2.44 million payout from the Albanese Government a year ago on her 28th birthday, is believed to have purchased her first home in the south of France for an estimated $600,000.
Ms Higgins told the court during her testimony that after she paid tax and legal fees to personal injury lawyer Noor Blumer she received $1.9 million.
If true, she should still have assets somewhere in the vicinity of $1.3 million, minus whatever living expenses she has used this year when she rented a home on the Gold Coast and took several overseas trips with Mr Sharaz to the Maldives, Paris and Geneva.

Calculations reveal a bleak picture for the Duke of Sussex who has seen one of his biggest projects slammed as a “financial fail”.
When his memoir Spare debuted in January, 2023 it almost immediately broke records faster than Usain Bolt after sculling several Red Bulls, seemingly ensuring that Harry’s heart-on-his-sleeve tell-all was a ring-a-ding success.
Until now, that is, with a new report labelling the book a “financial fail”.
Paula Froelich, a former longtime Page Six deputy editor, now writing for the fast growing US cable network News Nation, did a deepdive into the highest selling autobiographies of the year.
Taking into account the hardcover price of the book, the number of hardcovers sold and how much the duke was reportedly paid upfront by his publisher, Froelich calculated that King Charles’ younger son “would have had to sell more than twice the amount of books … than he did to earn back his advance.”
The Duke of Sussex’s title sold 1.2 million hardcover copies, according to Nation, however it would have had to sell 2.7 million hardcover copies for Penguin to come out even.
(According to Froelich, “hardcover sales account for 80 per cent of book sales, so it’s a good determinant of whether a book did well or not.”)
Reports vary as to how much Harry might have been paid as an advance for Spare, however Nation takes the number to be $13- 14.8 million ($USD9 – 10 million dollar), that is one quarter of the $51- 59 million ($USD35 to $40 million) that Entertainment Tonight says is the value of the duke and wife Meghan, the Duchess of Sussex’s reported four-book deal.

If China made its currency fully convertible (floated the Yuan), the wall of money wanting to leave and find a home elsewhere wouldn’t be too far from a 50% drop in the currency’s value. If we remeasured where the Yuan floated (in exchange rate terms), the difference in terms of size would be huge.
So, someone should ask this idiot: if he’s taken the absurd argument that the US dollar fell over the quarter and therefore, in terms of the exchange rate, the US economy was smaller than the 5.2% GDP print, what would things look like if the Yuan was allowed to float?
There’s more to the story about electricity production than meets the eye. China has 1.2 billion people compared to 330 million Americans, and a large number still aren’t on the grid. We don’t know enough about US energy efficiency, and I would like to see the numbers for both China and the US.

This would not have been a ‘major escalation’ but would have meant serious retaliatory business was being considered for outrageous behaviour. With Yemen, that chance was lost. (As a leader, Hairy has turned organisations and situations around by not being scared of bold moves followed by successful deals which is why he admires Trump so much.) Note that Hezbollah pulled its head in with return rockets and while Yemen is different, as you have argued, they still have much to lose. A few installations collapsing would have been reinforcement of that.
America projects only weakness right now. A stronger America can keep Israel on track for destroying (at best) or at least further containing Hamas, and I’m hoping we’ll see that with a Trump win. Trump is also a deal-maker who will seek outcomes and rewards for those who agree to participate across quite wide differences. There are a multitude of possible ‘deals’ and pressures that a strong President could make to settle things down in the Middle East. Some were mooted on the last thread, but strategies will change as situations do.
