FL: the prosecution has admitted to evidence tampering, which by the “fruit of the poisoned tree” doctrine means they likely don’t have any admissible evidence left.
I sincerely hope DJT wins and then uses the precedents set in the cases against him against the entire set of democrat pollies and deep staters. Not because I think it’s the right thing to do, but because they need to learn that rules and norms exist for a reason, and you will reap what you sow. Best would be to have them indicted, put on trial to expose their malfeasance, and then for Trump to pardon them near the conclusion of said trials, with the comment that the pardon is made because such political prosecutions should no longer be entertained by either side, and this is an end to the matter.

Former prime minister Tony Abbott has backed fresh criticism of Daniel Andrews and other COVID-era leaders, claiming the premiers’ overreach eroded Australia’s democracy.
The former Victorian premier and other state and territory leaders have landed in hot water for adopting health decisions during the pandemic which were not backed by medical advice, according to former federal health minister Greg Hunt’s submission in the federal government’s inquiry into COVID-19.
Now, Mr Abbott has expressed fresh disapproval of COVID-19 era leaders, saying “the policy to deal with COVID-19 turned out to be far worse than the disease itself”.
“When you go back and look at this honestly and dispassionately, you’d have to say that the first mistake that governments made was throwing out the carefully prepared pandemic plans that we all had in panic in early March 2020, because of the dire photographs coming out of overwhelmed Italian hospitals,” he said.
Mr Abbott said there was “no doubt” government’s “ceased being a democracy and became a kind of a doctocracy” at the time.
Victoria implemented stringent curfews, a 5 kilometre radius, as well as the state’s choice not to use ADF personnel at hotel quarantine facilities.
The state of emergency in Victoria was extended for four additional weeks in April, a move the government claimed help slow the spread of coronavirus and save lives.
Residents and businesses who did not follow COVID-19 restrictions were subject to on-the-spot fines from Victoria Police who were granted additional powers.
Victoria’s tough measures were backed by advice from former state health minister Jenny Mikakos and then chief health officer professor Brett Sutton.
In his submission, Mr Hunt said despite references to “medical advice”, some decisions made by the then Victorian premier lacked such advice from the Commonwealth and chief health medical officers.
“And my fear is that without a fair dinkum Royal Commission type inquiry into the whole response to COVID. Next time a pandemic happens, and it will, we’ll take the over the top response to this one, as the model for all future actions,” Mr Abbott said.

Firstly, Greg Hunt is attempting to cover his ar-e. After all, he was the Health Minister who actually endorsed the mRNA vaccines. And what is this s–t about governments not seeking medical advice????? They DID, but it proved the WRONG advice. They certainly did not rebuke or deny the actual copious medical “advice” that came from all sorts of medical advisers – state, c’wealth, universities etc etc. And they damn well didn’t heed the contrary advice of many many retired senior practitioners ( eg Emeritus Prof. of Immunology and Dr. Phillip Altman, a doctor of pharmacology with 40 years experience – including clinical drug trials for our TGA) who were aghast at the adoption of novel vaccines without sufficient clinical trials.
Correct me if I am wrong – but, although Tony Abbott’s comments are very welcome now, I don’t recall his opposition to the policies at the time. Did he appear at the famous rally in Canberra amongst all those families & average Aussies????
Having said that …. I do understand the fear at the time…. it wasn’t easy to go against the trend and so many senior officials, let alone family & friends. So, I am happy to see the mea culpas. But the bitterness lingers……

No winners’ in defamation case: Justice Lee

Federal Court judge Michael Lee says there are “no real winners” in Bruce Lehrmann’s defamation case against Network Ten and Lisa Wilkinson, as he criticised the broadcaster for advancing “an assertion that they won the litigation” in the aftermath of the judgment.
Justice Lee is delivering a costs judgment and determining who will foot the bill for the reported $10 million associated with the landmark case.
“Although the respondents legally justified the imputation of rape, their conduct was not justifiable in any broader sense,” Justice Lee said on Friday afternoon.
He criticised the “credulous” approach of The Project team in “readily” believing Brittany Higgins’ rape allegations, as communicated to them by her partner, David Sharaz.
Justice Lee said last month he had reached a “level of satisfaction” that costs would be awarded in Ten’s favour, but has not yet revealed the amount.
Network Ten’s failed qualified privilege defence will not impact its ability to claim costs, Justice Lee says.
While Mr Lehrmann had argued the broadcaster’s inability to prove it had acted reasonably in its interview with Ms Higgins on The Project should reduce the proportion of costs it is ordered, Justice Lee disagreed.
“I’ve concluded the issues of the statutory qualified privilege defence were not sufficiently severable from other aspects of the case such as to make it appropriate to deprive Network Ten of its costs of this aspect of the proceeding entirely,” he said.

On Tuesday, the company behind the development, Winning Moves, announced work was underway to piece together a localised version of the popular trading game.
Winning Moves representative Jaime-Lee de Niet said the idea to feature Darwin had been floated “for years”.

Lehrmann to pay 90 per cent of Ten’s fees
Federal Court judge Michael Lee has granted a costs order in Network 10’s favour in its landmark defamation case against Bruce Lehrmann.
Justice Lee has ruled the network can recover costs from Mr Lehrmann on an indemnity basis – covering about 90 per cent of its legal bill – in relation to its truth defence, and on an ordinary or party-party basis – about 70 per cent of its legal bill – in relation to the qualified privilege defence.
“On balance, the appropriate exercise of discretion is to make an award that Network Ten recover its costs against Mr Lehrmann on an indemnity basis, except for costs incurred in relation to the statutory qualified privilege defence, which will be recoverable, save for the costs of the affidavits, to which I referred on an ordinary or party-party,” he said.
He made an award in the same terms for Lisa Wilkinson.
Poor young Bruce. I suggest he declare bankruptcy and join the French Foreign Legion. Given his previous experiences I suspect it’d do him a lot of good.
If he does this, goes bankrupt and onto social security for three years, then he’s off, and Ten never gets a cent. Perhaps that was Lee’s intention. You can’t get blood out of a stone, although I must say that Lee seemed to get some semen out of thin air in this case.

Apparently, we are not supposed to notice. It is all part of treating everyone as equal. Except that we do notice and it is horrible, especially in historical dramas. They have ruined the TV series of ‘A Gentleman in Moscow’ with this sort of treatment. It’s reasonable well done and casted except for that, so you just have to close your eyes during the parts given over to this nonsense, and imagine it is a Russian-looking person of that era speaking.

He previously said he would barely have given Lehrmann a red cent even if he found that he never raped Higgins. Only the reputations of important people matter to Lee. I posted earlier about he Mar-a-Lago judge who in the 4 trials is the only one worth feeding. The fact that she is in Florida with the strongest GOP Gov also helps. Jack like all the other prosecutors is as cunning as a shit house rat and as dumb as a dog turd.

It appears that Craig McLachlan, back in early 2022, did the prudent thing in dropping his defamation case against Nine and the ABC.
So, Justice Lee prefaces his costs judgment today by stating that there are no winners in this case but he then goes on to validate and reward Ten and the Amphibian.
Lehrman will have to declare bankruptcy, and will never be able to discharge that. His best options are to leave Australia or to spend the rest of his life on sr form of social security. Perhaps he could plead mentally illness and go on the Rorters?
He’d be discharged after 3 years and 1 day, BJ.
Mind you, with another rape trial looming in QLD that’s probably the least of his worries atm.

With that out of the way I am drinking my preferred Speyside scotch and listening to Bruch’s Scottish Fantasy.

In exactly the same way we might imagine those old German towns to be filled with handsomely bewhiskered men bellowing with laughter over foam brimming tankards, served by shapely blonde women in comely traditional costume – utterly insensate to the stink of horseshit in the street, the inescapable mischievous drafts, the inadequacy of the plumbing, and the insistent lack of personal hygiene products – an entire village without a single stick of Rexona between them!
I suppose it is a bit like those mediaeval French women who were so entranced by the stories they heard of King Arthur in that strange, at once dreamlike and nightmarish, land across the channel. The stories the French told of Arthur were almost unrecognisable compared to the traditional British ones – and it was the French ones that won out. The idle civilised and safe with the opportunity to escape their world into fantastical realms with monsters, maids, knights, and superhuman gallantry.
Small aside – when I first saw Monty Python and the Holy Grail and Arthur was facing the French taunter who derisively spoke of “Arthur King, you and all your silly English…Keniggits”. It was not until years later I realised ‘keniggits’ was a mocking pronunciation of ‘knights’: ‘k-nig-hts’.
Naturally I now seek to distance myself this misapprehension by using it to mock other people. “Hmmph! That astrophysicist is so stupid that I bet he doesn’t know ‘keniggits’ is a joke on the spelling of ‘knights’. Yeah. And he poohs his pants!”

Utterly bizarre. Lehrmann’s defence was incredibly high risk because it was actually true. If he had had sex there is no way in a million years he would have denied it. Lee just inverted the most obvious exculpatory piece of information to somehow justify destroying Lehrmann.

So even if Lehrmann had disproved 10’s truth defence he would have got nothing because Lee asserts Lehrmann may still have had sex with briternee. That is fuking amazing and grounds for appeal on the basis that since Lee concedes he cannot be sure Lehrmann had or did not have consensual sex how the fuk can he be sure on the standard of proof that non-consensual sex ie rape occurred?!

Brittany Higgins looks set to battle on to defend the defamation claim against her by outgoing WA Senator Linda Reynolds – but her fiance David Sharaz has confirmed he is waving the white flag.
During a strategic conference before WA Supreme Court judge Paul Tottle on Friday, lawyers for Mr Sharaz confirmed that his statement that he would “not fight Reynold’s legal actions anymore” still stood.

She was punched 40 times in the head and neck, repeatedly stomped on, choked and hit again before staggering away and dying.
But you won’t find the 24-year-old’s name on the growing list of women killed by their partners, because the West Australian justice system concluded that the Aboriginal woman’s death was not “directly” or “indirectly caused” by the beating she took on December 15, 2022.
Her attacker, Aaron Leyton Wumi, wasn’t charged with manslaughter or murder despite admitting to every prolonged and punishing part of the bashing.
Instead, Wumi eventually pleaded guilty to doing “an act as a result of which the life, health or safety” of his victim “was likely to be endangered”.
His punishment was a four-year jail sentence. It was backdated to the time of his arrest just hours after he delivered such a level of brutality it prompted WA Police Commissioner Col Blanch to describe it as “one of the most violent attacks I’ve ever seen in a public place”.
Wumi was sentenced in the District Court last week. With parole he’ll be a free man by Christmas.
If you’re thinking none of the above seems fathomable at a time when the nation’s leaders from the Prime Minister down have condemned violence against women – and promised to end the cowardly scourge – then you’re not alone.
The family of the victim, who I will refer to by her cultural name of Nyaparu, have been left feeling as though their relative’s life didn’t count.
“This is a black-on-black death,” her brother-in-law Michael told me this week. “They don’t care.”
Michael doesn’t accept how the decision not to lay more serious charges was made.
The post-mortem concluded the level of alcohol found in Nyaparu’s body and her pre-existing heart issue combined to end her life.
“If she didn’t get beaten would she have had a heart attack?” he said on 6PR this week.
“Him chasing her around the city and the assault that occurred caused the heart attack.”
If you’re wondering whether a lack of evidence about the ferocity of the assault was an issue in determining the appropriate charge and resulting sentence handed down to Wumi, the answer is no.
Almost all of what Wumi did was captured on CCTV in Yagan Square and another location between 12.42am and 1.47am that morning.
“You continued to strike the victim to the head and upper body while she was curled protecting herself,” Judge Wendy Hughes said while sentencing Wumi.
“You pulled her to the ground and continued to punch her to the head, face and torso before kicking her to the head and stomping on her head with your foot approximately five times.”
You get the picture. The Judge certainly understood the gravity of what Wumi did.
“The women in your community must be respected,” Judge Hughes said.
“They are not a punching bag for your anger.”
Horrific, but not deadly enough for the system to determine Nyaparu suffered so gravely at the hands of her attacker that it killed her.

The Bay of Biscay, the Sacred Heart and other San Sebastian stories.
For those who haven’t visited San Sebastian, the layout of the city is worth a description. Sprawled along a golden sand portion of the great Bay, it is dissected into a few very distinct districts. The first is the Old Town, nestled under a great outcrop called mount Urgull, which is covered with gardens and remnant vegetation. On the top is an enormous statue called the Sacred Heart. The little town is thus protected from northern gales which threaten, and often do, send the ocean over the sea wall.
Then there is the estuary, which splits this area from the newer part, the Gros. This is where we stayed this time, a very nice hotel called Abba. It has a cycleway just outside the front gate – pedestrian beware! Some lovely bridges span the channel which is full of fish and has, I’m told, a 4m tide.
Directly opposite is another “new town” in which sits the neo gothic cathedral. If you look very carefully, there is a crooked line of sight up to its more elderly relation in the Old Town. And it’s the Old Town that’s full of bars and pinchos and funny little shops. Still recovering from the destructive and totally unnecessary covid nightmare.
Yesterday, as we set out under glorious “Sydney Blue” skies, I noticed a great sea mist developing over the Bay. Slowly, inexorably, it crept towards the town. It enveloped Mount Urgull, leaving only the statue visible. Then it swathed the head with a halo of mist, and finally everything was fog. The cold descended. Sunny Spain no more. A pea souper had caught us.

Something’s bothering me: How Justice Lee found that Lehrmann raped Higgins.
We all know that some kind of sexual interaction took place, but to call it “rape” is a big leap.
I think Lee’s words were along the lines of, “Higgins could not have consented” (because of her state of drunkenness).
But what exactly constitutes consent? For 99% of sexual intercourse, the consent is given by body language. Often, it is the lack of objection that denotes consent.
The two were seen to be “pashing” and kissing at the nightclub – and we can imagine what was going on in the back seat of the Uber on the ride to Parliament House. These actions denoted consent – to some degree.
Lehrmann clearly had consent – to some degree. That Higgins had accompanied Lehrmann into the parliamentary office, knowing what was on Bruce’s mind, amounted to consent – to some degree.
With some degree of consent, how on earth could the judge have found that he raped her? Why couldn’t he have just found that some sexual interaction occurred?
Bothers me hugely also.
When the security guard offered an ambulance, or medical attention, Brittney declined both.

The judge had to make a finding on the rape allegation.
That’s what Lehrmann’s defamation suit related to – that a rape had taken place and the Ten report identified him as the rapist.
As for the question of consent, we’re not in the 1950s anymore, Toto. The promiscuity bequeathed us by the sexual revolution has made this issue a minefield.
The judge could have just said, “I find that sex occurred, but I cannot be sure of the degree of consent, so I cannot find that it was rape”.
Oh, come on. That would requiire a degree of commonsense, something notably lacking in the current judiciary.
There was zero factual basis for Lees judgements – no doctor was visited, no police complaint initiated, no clinical tests done, no proof that she had been drinking to excess, no sign that she was coerced into going inside and zero proof that she had not given consent.
As pointed out – Lee judged Tens actions to be careless and non fact-based in believing Brittney whereas he was doing a good job in taking her fact-less assertions and pronouncing guilt on Bruce.
Unfair and unjust – no matter how much we might dislike the defendant.

Reading upstream, on many subjects, so I will make a few statements on some. Firstly, and maybe only comment, concerns the infamous “JAB”. I have been stuck in a nursing home for several years, and have almost physical altercations with doctors and staff over this crap. I remain the only person here whom is not jabbed, but that leaves me in a position where I can have no visitors, and remain basically isolated from life. The staff and any visitors still have to do the R>A>T> test every time they enter the place, and still have to wear face nappies, what a load of crap. If I had a way out, I would raise the middle finger, but I do not have that option, so all I can do is continue the fight.

DPP steps up as Chris Dawson insists Lyn phoned after disappearance

Christopher Michael Dawson claims Justice Ian Harrison caused a miscarriage of justice by failing to believe his story that his wife Lyn called him to say she “needed time away” from him and her two young daughters.
The appeal, commencing on Monday, will see taxpayers fund both sides of the case, with Dawson to be represented by public defender Belinda Rigg SC and the crown case to be put by NSW Director of Public Prosecutions Sally Dowling SC.
In a fresh appeal point lodged with the NSW Court of Criminal Appeal, Dawson claims Justice Harrison was wrong in 2022 to find Dawson guilty of murdering Lyn and sentenced him to 24 years in prison.
Dawson won’t be eligible for parole unless he reveals what he did with Lyn’s body, thanks to a new piece of legislation named ‘Lyn’s Law’ in honour of the devoted mother, who vanished in 1982.
Lyn’s family have asked that she be known by her maiden name, Lyn Simms.
Dawson claimed in police interviews after her disappearance, and through his lawyers at his murder trial, that on 9 January 1982, while he was working as a lifeguard at Northbridge Baths on Sydney’s north shore, he received a call from Lyn in which she indicated she was leaving him and their two little girls.

They could have taken on the pseudo-health bureaucracy in the form of the Chief Health Officers and simply compelled them to show their work and the whole lockdowns horror could have been avoided.

If I had the money I would back his appeal, not because I like him, as a matter of fact the whole lot involved in this sorry saga are revolting.
I would back him because of all them he was the one totally wronged by the ‘performing to the crowd’ judge.
And we all pack the court chanting “where’s the forking evidence?” until various morbidly obese would be brown shirts get all huffy for about ten seconds, before they stagger off and adjourn to the nearest krispy kreme dispensary.

Universities cancel October 7 ‘victory’ speaker Sami Hamdi
One Australian university has banned British Muslim speaker Sami Hamdi and another has cancelled his planned speaking engagement.
“I have made the decision that an individual who made unacceptable comments in the days following the terror attacks of 7 October 2023 will not be allowed to speak on campus,” University of Queensland vice-chancellor Deborah Terry told The Weekend Australian.
“This decision was not taken lightly but the safety and wellbeing of our community must be my priority.”
The University of Western Australia also confirmed it had decided to cancel the event after “careful consideration”.
“Consistent with UWA’s code for the protection of speech and academic freedom, UWA affirms the right of all persons to engage in lawful and respectful expression of their views,” a university spokesperson said.
“However, the university also has a duty to foster the overall wellbeing, including psychosocial wellbeing, of all its students and staff.”
I’m in two minds as to this outcome. Are our universities so anti-Semitic that they keep promoting like minded speakers until being called on it? The other option could be that our knowledge workers are so ignorant that they must be constantly supervised to prevent them from making stupid decisions.
