A curious fact – when I was consulting our bookkeeper got gaoled by the Family Court. She was wife No 2 and a director of a few of the (now) family companies. The husband came to drinks a few times, great drinking companion, possibly not marriage material. I think they may possibly been the first people gaoled by the FC.

I was helping a young relative of Mrs Panzer through that process a while back.
Admittedly she was a total fucking princess, but the first lawyer was nothing short of useless. His letters were riddled with mistakes.
He got rissoled and was replaced by a woman.
I went to the first meeting and when the Princess launched into a diatribe about what an arsehole her ex was (true), the lawyer pushed a box of tissues over the desk and said, “That may be so but family law doesn’t take any of that into account. Just having a quick look over the summary I have seen, there is no point taking this to court. The access will work something like [ ……]. As for the financials I suggest we pitch for x%, but be prepared to fall back to y%”.

The lady lawyer was tops. Matter of fact. Direct and to the point. Didn’t get sucked into the emotional stuff.

This QC pal has been telling me about a case he’s had that’s been going to 5 years and the combined legal is $6 million. Both of them hate each so much they are running down the combined net worth to hurt each more. Apparently , one of the legals in the case is going to write a book on it and it’s been in the press.

In a Federal jurisdiction like family law, yes. I’m not certain about State based matters but there’s now meant to be a single nationwide system of mutual recognition, which I believe is meant to have the effect that it doesn’t matter where within Australia you’ve got your ticket.

My kid was accepted in the “church” a few years ago. They held the seance in the Supreme Court. The title – “Australian Lawyer”- was used when accepting individuals into the church, which I presume means they can practice anywhere in Aussie jurisdiction. I think but don’t really know.

The case I am referring to was at the opposite end of the financial spectrum.
That is why I was really pleased to hear the lawyer say, “Look it will cost you $x thousand – minimum- to go to court, and I don’t think you would improve your position by half that. Yep, he may have cheated, but the court isn’t there to redress that. But he may be feeling guilty, so I suggest you strike while the iron is hot with a settlement proposal. Because that guilt will dissipate pretty quickly.”
Really good practical advice.
I couldn’t believe she was a real lawyer.

JC, I just checked the Legal Profession Uniform Law Act.
It certainly seems that people admitted in any State or Territory which has adopted the uniform law can practise in any other participating jurisdiction. NSW and Victoria are both in, so Melbourne/Sydney’s not a problem. Not sure about other jurisdictions – e.g. it’s a few years since I looked but WA wasn’t in last time I checked.

Further to my post in the morning about the Courier Mail Covid editorial. Only one comment appeared in response to that article. This is simply incredible and suggests to me major censorship of comments. Or as I have seen before they appear to allow comments but none get through. That basically means any commentator is wasting their time posting but does not realise. Either way not a good way to treat their paying subscribers.

A female Coalition senator was hit with a “threatening” letter she believes was intended to “bully and intimidate” sent by lawyers working for Penny Wong after she name-checked the Labor senator in a tweet calling out the poor treatment of women in politics.

On March 16 of last year, Victorian senator Sarah Henderson tweeted a clip of retiring Liberal South Australian MP Nicolle Flint describing the vicious abuse, including stalking, vandalism, and harassment, she endured during the 2019 election campaign.

“Please watch this brave, powerful speech by Nicolle Flint,” Ms Henderson tweeted.

“No woman should endure the systematic abuse, harassment & misogynistic attacks to which she was subjected by Labor, with @SenatorWong in charge, GetUp & the unions.”

The following day, Ms Henderson received a “concerns notice” from Adelaide solicitors acting for Ms Wong, demanding the tweet be taken down as it “gives rise to the defamatory imputations that Senator Wong is misogynistic … encouraged systematic abuse … approved systematic abuse … (and) condoned systematic abuse.”

The letter, sighted by The Daily Telegraph, stated that Ms Wong “reserves all of her rights … in the event that you make any further defamatory publications of and concerning our client”.

Ms Henderson said she was surprised to get the letter as she had not heard anything from Ms Wong after the tweet.

In recent days, Ms Wong has been under scrutiny over her behaviour in relation to ­deceased Victorian Labor senator Kimberley Kitching. Ms Wong has denied the allegations, but admitted to making an insensitive comment about Ms Kitching’s childlessness.

“I was shocked to receive such a threatening letter,” Ms Henderson said.

“All I was doing was standing up and supporting my good friend Nicolle Flint who had been subjected to the worst possible treatment by her political opponents. Given an applicant has 12 months to commence defamation proceedings, it is clear that Senator Wong was only ever trying to bully and intimidate me.”

In her speech, Ms Flint accused Anthony Albanese of tolerating bad behaviour and the mistreatment of women.

Echoing Julia Gillard’s famous misogyny speech she said: “I say to the Leader of the Opposition, I will not be lectured by you, I will not be lectured by your side of politics about the treatment of women in this place.

“I ask the Leader of the Opposition, where was he and where was his predecessor and where were the senior Labor women when GetUp, Labor and the union supporters chased, harassed and screamed at me everywhere I went in the lead-up to the 2019 election?”

Ms Wong’s spokesman said: “The assertions in (Ms) Henderson’s tweet are not true.”

Now this all makes sense, last year I attended a function at which Nicolle Flint spoke. I asked Flint if she reckoned Wong had knowledge about what she endured during the 2019 federal election campaign as well as the harassment she’s endured since. Flint replied, rather circumspectly, that as Wong was “notoriously sensitive and litigious” she’d choose her words carefully and so Flint said that “she’d be very surprised if Wong didn’t know what was done to her in Boothby during the 2019 campaign”.

Memo to Albanese, they’re real charmers these three.

Thought Police: Germany Conducts Mass Raids over Online ‘Insults’ Against Politicians (23 Mar)

Federal police in Germany have conducted mass raids across 13 states on Tuesday over online ‘insults’ levied against politicians.

A large number of apartments and houses were raided in Germany on Tuesday as Federal police in the country look to prosecute those who made allegedly hateful remarks against elected officials online.

Germany’s day of thought police raids against those who are suspected of insulting or defaming elected politicians is only the latest example of the country’s interesting understanding of what protecting democracy means.

The central European country has become infamous for targeting certain political viewpoints, going so far as to put the country’s populist Alternative für Deutschland (AfD) party under surveillance as a so-called “suspicious entity”. … “The party stands for racism, the party stands for exclusion of minorities, the party stands for contempt of the social system,” said Thomas Haldenwang, the President of the German Office for the Protection of the Constitution, which ruled on the surveillance case.

Ah so, I see it now. You are still allowed to insult politicians from righty parties like AfD, you just aren’t allowed to insult lefty politicians.

I wonder how long before Albo brings in similar legislation?
