Those tunnel storing remind me of a couple of my European adventures, one in Perpignan exploring underground Roman warehousing, part of which had been repurposed since medieval times into cellars by various householders much to the annoyance of the current caretakers judging by the comments on site.
And the old lady’s house in Naples, *they have a special name because they lack windows), build into the old Greco-Roman amphitheatre, a n oddly shaped door under her roll back bed took you into very extensive cellarage, all part of the original theatre.

Bruce, roger, have you heard of this crazy lad?

Dot – No, but as a kid me and my friends used to love to dig in the scrub forest patch on the other side of our street. We were about 10 or 11. Lots of moled out cubby houses, some with surface level attics, roofed with bits of corrugated iron and timber which we’d find. Many hours of fun!

I suppose some guys never grow out of that phase of life, like that guy. Although to be fair I still love underground mines. On such things here’s another recent story:

??? Yes it does. It works better for us because our policies actually work. The left – when they’re in power – require continued scapegoats for the fact that their policies always make things worse. They *need* enemies to exist. If they don’t, they have to create them.

The right doesn’t need any enemies at all because our policies always work. If the left ceases to exist (or at least shuts its mouth) then civilisation continues just fine.

Laborites laugh off appeals from Liberals to live up to their own rules, because they don’t believe in those rules anyway.

Kathleen Folbigg to be released from prison after 20 years

Kathleen Folbigg will be set free from 20 years in prison, after a mammoth judicial inquiry into the deaths of her four infants exonerated her from their murder.

NSW Attorney General Michael Daley on Monday made the recommendation of Ms Folbigg’s pardon to the NSW Governor Margaret Beazley AC KC.

Mr Daley also released summary findings prepared by the Hon Thomas Bathurst AC KC, who has been leading an inquiry into the convictions of Ms Folbigg.

In a memorandum outlining his findings, Mr Bathurst stated he had reached “a firm view that there was reasonable doubt as to the guilt of Ms Folbigg for each of the offences for which she was originally tried.”

• There is a reasonable possibility that three of the children died of natural causes.

• In the case of Sarah and Laura Folbigg, there is a reasonable possibility a genetic mutation known as CALM2-G114R occasioned their deaths.

• Mr Bathurst was “unable to accept… the proposition that Ms Folbigg was anything but a caring mother for her children.”

• In relation to the death of a fourth child, Mr Bathurst found that “the coincidence and tendency evidence which was central to the (2003) Crown case falls away.”

• In relation to Ms Folbigg’s diary entries, evidence suggests they were the writings of a grieving and possibly depressed mother, blaming herself for the death of each child, as distinct from admissions that she murdered or otherwise harmed them.

Mr Bathurst advised that due to the volume of submissions and evidence, it would take some time for the formal report to be finalised.

Health is a Bottomless Moneypit

One of the first things that struck me was that there were boxes of supplies everywhere – in corridors, piled up in corners, shoved under desks and counters. The lack of order and method meant that management could have no idea of how much, or what, they had on hand at any time. And, of course, the opportunities for theft were endless.

There was zero incentive to use resources prudently compatible with clinical standards. Half used boxes of tissues and wipes were routinely thrown out. Patients got a bottle of water with every meal, and yesterday’s was thrown out, even if it was untouched.

In terms of staffing, while cleaners were nowhere to be seen, the night shift nurses had a card game going every night in the room where medications were kept. There were as many of them as the day shift, even though they had much less to do.

What should have been a two day stay for me stretched to five because of inadequate hours allocated to orthopedic surgery theatre, according to the doctors there. I had my surgery cancelled in the late afternoon twice before finally getting treated on the third day. By the time they treated the emergency patients, time was up.

This meant that not only did I occupy a bed someone else could have used, it added thousands of dollars to the cost of my stay.

There were numerous other things that would make anyone who has ever run a business squirm, but you get the drift.

The top heavy management structure does not include anyone who actually manages. Nobody is walking around to make sure that the place is clean, or keeping track of supplies, or watching workloads and productivity. Instead, they sit in their offices and generate endless, useless reports.

It is impossible to control the budget in a setup like that.

(1) If the judge is satisfied that, because of illness or other sufficient cause, a juror should not continue to act as a juror, the judge may order that the juror be excused from further attendance during the trial and during any further period that the judge specifies in the order.

There was no need to order a mistrial. This is a normal procedure in NSW to excuse an individual misconducting juror and would qualify under examples in case law.

What is amazing about this doco is that the left have a hyuuuge dummy spit about it – yet Matt gives them every opportunity to explain themselves.

Their response is to say “well kids can’t get bottom surgery and even in the extreme circumstances where they can, it’s with thousands of hours of counselling and every living relative has to consent so there’s nothing for you to complain about”.

They then turn around and lobby for governments to change the rules so that kids can get bottom surgery without any counselling and parental consent.

Of course, they say nothing about top surgery which is done on minors. And even ignoring the issue of being a minor, these surgeries are horrific. Any doctor who performs one is no different to cutting off someone’s arm or foot because of a fetish. 15 years or 50, it is a violation of the Hippocratic Oath.

That photo pretty much destroys everything that Mizzz Knickerless said about her state when she arrived at Parliament House, and her actions later.

She was clearly NOT paralytically drunk, she clearly was NOT about to collapse unconscious on the couch, she clearly WAS quite able to refuse any advances, and clearly WAS quite able to notice if her dress was being forcibly removed.

What possible explanation could there be for her claiming to be schoolies level shiffaced?
1. She “loaded up” on shots immediately before leaving 88 mph bar and they hadn’t taken effect by the time they reached Parliament House? However, the CCTV evidence from the bar doesn’t show this. Also, the elapsed time from leaving 88 mph to the last CCTV in the corridor at PH is just under seventeen minutes. Anyone who loaded up at 88 mph would be starting to show signs of drunkenness by then.
2. She got stuck into a high volume and/or an unfamiliar tipple in the minister’s office either in the company of BL or not. This might explain the later regurgitation of the Cadbury Favourites onto the ministerial flokati shag rug.
3. She was only moderately pissed and the “schoolies level hammered” affords a convenient cover for hazy memories* and lack of resistance.

* Amazing. She is crystal clear about “he was on top ‘o me” but conveniently vague about every other detail. We call that “going the full Witness J”.

‘Malicious’: ABC deliberately tried to prejudice my rape trial, says Bruce Lehrmann

The ABC deliberately tried to prejudice Bruce Lehrmann’s rape trial when it broadcast an address by Brittany Higgins and Grace Tame at the National Press Club knowing he had been publicly named and charged, according to documents just filed in the Federal Court.

Mr Lehrmann first filed his claim against the ABC in April but now claims it broadcast the Press Club event with “an improper motive”, namely to prejudice upcoming criminal proceedings against him, and that the broadcaster’s recklessness was so extreme that it amounted to “wilful blindness and constituted malice”.

On 9 February 2022, the ABC broadcast the National Press Club speech after the club promoted the sale of tickets to the event referring to Ms Higgins’ decision to “publicly allege she was raped by a colleague inside Parliament House”.

Although the speech did not name him, Mr Lehrmann was identifiable from what was said, having been named in multiple media reports after being charged with sexual intercourse without consent in August 2021, according to his lawyers.

“In her introduction to the NPC address ABC chief political correspondent Laura Tingle referred to ‘shocking allegations of assault’ and stated that ‘I don’t feel I really have to introduce Brittany Higgins and Grace Tame such has been their impact on the national stage.’”

Ms Higgins began her address with the words “I was raped on a couch in what I thought was the safest and most secure building in Australia.

“The parliament of Australia is safe – it is secure – except if you’re a woman. If what happened to me can happen there, it can happen anywhere. And it does. It happens to women everywhere.”

I remember how difficult it was to find funds for that constant trotting off to the doctor’s with sick infants in the late eighties.
You got to wait an hour or two and you didn’t pass go without forking out between $30 and $50 each visit.
Very glad to see our first bulk bill practice, where the young Chinese doctor was the only one of several I’d seen to correctly diagnose my four year’s whooping cough, Dr $50 had it down as asthma.
Abbott’s extraordinarily modest $7 copayment proposal was shot down in flames by the usual suspects and as pointed upthread now families are forking out up to $75 per to see a GP.
Add in mortgage, food, energy it’s a working family crisis.
(I still have 9 to 5 access to a bulk bill clinic, lucky me).

Many here, as parents, will have some practical experience of young women under the influence of alcohol – usually cleaning up, or looking after the wreckage.

Brinny is clearly not shitfaced on the way in – sure, problem with the high heels, but not staggering drunk.

She may have preloaded before leaving the bar – leaving the question of dwell. But experience shows that even larger sized girls go downhill in minutes after a big nip.

She might have been chugging in the taxi, but she doesn’t say so.

Lehrmann may have forced drink on her once in the office – but she doesn’t say that either.

This is a textbook case of social workers/police and support agencies doing what they should do to protect a potentially vulnerable kid & mum.

A notification made.
There had been an altercation with her partner at the time and neighbours had called police about a noise disturbance. Melissa was asked by police if she had been drinking. She said she hadn’t because she was pregnant.

Yet, in the officers’ eyes, this incident was enough to justify an unborn notification being made.

Yet further down the “noise disturbance is elaborated on a little more.
to explain that she had support, that she wasn’t living with her former partner anymore and wasn’t at risk of family violence.

Anyone want to bet the noise disturbance might have been a smidgen more than the activist is presenting it as??

Legislation prevents child protection workers investigating or substantiating the alleged risk to the baby while it is still in utero, so the notification stays there until birth.

Most expectant mothers aren’t told about a notification; for the final eight-and-a-half months of Melissa’s pregnancy, it was never mentioned to her.

Then, once her baby was born, and before her family had arrived, child protection workers turned up at the hospital to consider removing the child.

So they followed up on a notification, then investigated and….
Melissa was allowed to take her baby home.


So the system worked as it was meant to, a mother to be was originaly highlighted as possibly having an environment leading to a bub being at risk. Later when bub born her circumstances had changed and bub was assessed as being at minimal risk.

Hundreds of unborn notifications are made against Aboriginal mothers in Victoria each year, of which at least one in five result in the child being removed before they are three months old.

The rates of SUBSTANTIATED reports requiring kid removal/interventions is roughly the same as for non Abbo parents.
The difference is in the sheer numbers being reported.

And overall the figures for Aboriginals abusing or providing unsafe living for their own kids is just disgusting.
Right now, about one in 10 Aboriginal children have been removed from their families and are living in state care, while about a quarter have been subject to a child protection report of some kind.

The reality for many Aboriginal babies subject to child protection notifications is that the state has already set them on a conveyor belt, stopping first in the child protection system before moving on to criminal offending.

I’m almost in agreement with Dover on the source of morality. It comes from the moral sensibility that human beings are born with. Like the sense of humour, or as Calli points out, the aesthetic sense. Some music is better than others, some jokes are funnier than others, and some acts are morally better than others. There doesn’t have to be universal agreement about the details, because different people have different stages of development. All are shaped by culture insofar as different cultures will enable that development to different degrees.
We differ on the ultimate cause. I go with evolution and don’t believe God is necessary.

The bar (88 mph) had 100% CCTV coverage and this doesn’t show any last minute loading, or any suggestion of spiking.

One does not preclude the other, IMO – there is no reason God could not have created the universe with some very simple rules, and while knowing that complex creatures such as men would result, not knowing (or perhaps not caring to exert sufficiently to “know”, or deciding NOT to know!) the exact details. Much like “The game of Life” or “SimCity” etc – the rules are straightforward, but the complexity of the interactions often producing surprising results, even for those who decided on the rules.
Indeed, one could argue that “free will” is exactly the sort the thing that Gods actually wanted – even He doesn’t know exactly how you’ll react until it is before you! (perhaps because He doesn’t want to know, enjoying the discovery instead) What better “game” for the omnipotent than something that produces surprises.
Of course, this is along the same line as sentient aliens – if man was made in God’s image, how many images do you think He made?

I hedged around the war crimes and the increasing ctitique of ADF senior leadership.
He didn’t. He claimed that the ADF was in the hands of a clique of self serving cronies whose focus is exclusively personal and who collectively prevent any questioning of contemporary ADF culture which they fashioned.
In his view, the majority of ADF problems stem from ADFA. (He was an ADFA graduate). Cliques, culture and hierarchies form at ADFA and continue in perpetuity.
In his view, ADFA must be shut down and true diversity of background implemented.
His Dad who is an ex-ADF senior officer and a traditionalist surprised me by saying that he believed that his son is correct. He added his views on the culpability of a series of disinterested Defence Ministers.

What!? I don’t know about the Kathleen Folbigg case specifically but as a more generalised comment; if there has been some miscarriage of justice and the person is ether innocent or their conviction is based on dubious ‘evidence’, then they must be released.

I would have far more confidence in the judicial process knowing that errors will be promptly corrected. Sometimes, sh!t happens for all kinds of reasons, but as soon as that is discovered, it must be corrected. We will deal with the fallout later – but the person must be released without delay.

In his view, the majority of ADF problems stem from ADFA. (He was an ADFA graduate). Cliques, culture and hierarchies form at ADFA and continue in perpetuity.
In his view, ADFA must be shut down and true diversity of background implemented.
His Dad who is an ex-ADF senior officer and a traditionalist surprised me by saying that he believed that his son is correct. He added his views on the culpability of a series of disinterested Defence Ministers.

At least some hope remains.

Recall the uncomplimentary Parliamentary Committee report in the 1990s, which described ADFA as a “military nunnery”, and recommended radical changes. Quickly stamped on by the ADF hierarchy, some of whom had been deeply involved in its establishment.

PS, even at the time, there were ADF officers (generally around the LTCOL (E)/COL (E) level who were unhappy with it. The location just over the hill from Duntroon did not help. It has since followed the course of most Australian universities into rampant political correctness/wokeism.

One suggestion was to revert to the old system, and re-use the facilities for senior officer education, but a new “campus” was later built at Weston Creek for that. Maybe the senior-sirs preferred to be less accessible?

Justice Besanko has today released more of his reasoning for his judgement in the defamation BRS case.

There was “no evidence of a plausible motive to lie or collusion” between the witnesses, Besanko said, and they “were independent, had no interest in the result and were aware of the significance of giving evidence. Furthermore, they were in a position to observe the events about which they gave evidence.”

On the other hand, Roberts-Smith “has motives to lie, being a financial motive to support his claim for damages in these proceedings, a motive to restore his reputation which he contends has been destroyed by the publication of the articles and significantly, a motive to resist findings against him which may affect whether further action is taken against him”.

Can’t say as I am impressed. Over the years since these accusations came to light (2018, I believe) I have read quite a bit about the circumstances of the matters. We know, for instance, that there was a significant amount of rivalry (involving animosity) between the special forces groups – the SASR & the Commandos. Besanko has not referred to this or defined the sympathies or origin of the specific witnesses.

Further, I was a bit surprised at the severity of Besanko’s implication of the motives for BRS to lie. After all, defamation proceedings are routinely brought because the alleged victim has suffered considerable harm.

Other than being possible Taliban paid maintenance by the civil defendants to themselves and their entire (rather large) nuclear families, as well as the possible compensation to Bibi Jan, no there’s no motive there at all.

Ive been keeping 1/2 an eye on the case, I find the genetic argument unpersuasive myself, but it was accepted as bringing in enough doubt to make all 4 convictions unsafe.
If there is no conviction (and there no longer is) then shes to be considered innocent unless a new prosecution is successfully launched.

it probably doesnt help shes a bit fruity (possibly because she lost 4 kids)and has the whole “Lindy Chamberlin” unsympathetic accused thing going on as well.

She either receives a payout for wrongful imprisonment, or shes retried and found guilty, any thing else is compounding injustice.

They say “truth wins in the end” and indeed it does – because if you fail to recognise the truth, then you are not acting optimally in terms of survival.
Industrial society has more than a little isolated many from reality – ask them where milk comes from, they are likely to say “the supermarket” rather than “a cow”. This sort of isolation from reality, together with “GovCo will look after me” produces such ridiculousness as “Modern Monetary Theory”, where we can just print more money to pay for things and nothing bad will happen.

There is sufficient wealth to allow this to continue for longer than you might imagine, and this is where we are now – we have over-indulged on debt, and we are not seeing the writing on the wall, or at least, not those who are notionally in charge and should know better. It will bite us sooner or later – hopefully sooner, which won’t cause as much pain, but alas, more likely later when it can no longer be ignored. Privation or war – there is no other way to fix it. And it only takes one side to start a war. China may be going down this path, so we may not have a choice. Hope not, but sure looks that way.

And then, to add injury to the insult to our judicial process, Brittany received a payout of some $3m. For what? Nothing had been (and still hasn’t) been proven. Meanwhile, Lehrmann is hounded out of his job, out of Canberra and his name is permanently sullied.

LOL. Our multinational employer is v concerned about Greenwashing. Hence we cannot participate in a number of local charities to raise funds and use the company’s name. This has effectively stopped most staff initiatives to run small events like morning teas etc. …except for one today. A few of us donated cakes for a morning tea and raised a few hundred dollars for a charity. The PR manager came down and said it wasn’t really appropriate because of greenwash risk. ‘The meja will have a field day!!!’ The Las running it effectively spat it and told her that was just a load of shyte. LOL. What a shit show. There is general feeling that the company doesn’t care nor give a shit about the community, too busy projecting and protecting itself. Im sure if we had a person of drag read us a story time we would get an ESG tick. Gotta love this woke stuff. Cake anyone?

One of the enduring mysteries of the allegations against Ben Roberts-Smith – whether two Afghan men were found hiding in a tunnel and shot – has been answered by the judge, in his newly released findings.

The two men were dragged from the tunnel, Justice Anthony Besanko has found, ruling that Mr Roberts-Smith was “not an honest and reliable witness”, and nor was the evidence of several men who gave evidence at the trial on his behalf.

Justice Besanko on Thursday found the Nine newspapers have proved Mr Roberts-Smith unlawfully killed four unarmed Afghan prisoners between 2009 and 2012 but delayed releasing his full judgment until it had been vetted for national security reasons.

In the full judgment released on Monday afternoon Justice Besanko accepted the evidence of a number of witnesses who implicated Mr Roberts-Smith in the execution of two Afghan prisoners at a compound known as Whiskey 108 on Easter Sunday in 2009.

During the trial some witnesses had backed Mr Roberts-Smith’s claim that no one was found in the tunnel and that both the men killed at Whiskey 108 were legitimate targets – one armed with a rifle, the other a “spotter” with a radio.

Those soldiers included the only man who actually entered the tunnel, a slightly-built New Zealander known as Person 35 who had stripped off his armour and crawled into the narrow space armed only with his service pistol.

But Justice Besanko did not accept the evidence of the wiry Kiwi.

Instead he accepted the evidence of at least three of Nine’ witnesses — Persons 40, 42 and 43 — that they saw men come out of the tunnel. Two others — Persons 18 and 41 — saw fighting age males under guard in the courtyard when they went into the courtyard not long after the tunnel’s discovery.

“No plausible motive for lying was identified in the case of these witnesses and nor was there any evidence to suggest that they had colluded to present a false account.”

The evidence of the applicant’s witnesses was that there were no men in the tunnel.

Justice Besanko rejected claims by Mr Roberts-Smith that Person 41, in particular – who witnessed the shooting – was disqualified by subsequent mental health issues.

“I do not consider that anything emerged from the evidence of Person 41, or indeed the evidence in the case, that suggested Person 41 had a mental health illness or issue which had or may have affected his evidence,” Justice Besanko said.

Mr Roberts-Smith’s account was “highly improbable when all the matters I have identified previously are considered together,” the judge ruled.

“The applicant (Mr Roberts-Smith) has motives to lie, being a financial motive to support his claim for damages in these proceedings, a motive to restore his reputation which he contends has been destroyed by the publication of the articles and significantly, a motive to resist findings against him which may affect whether further action is taken against him.

“I take into account the fact that Persons 5, 29 and 35 are close friends of the applicant, that he had arranged the payment of the legal fees of Persons 5 and 35 respectively and, in the case of all three, he has had discussions with them concerning events at W108.

“Person 35’s evidence was unsatisfactory as to whether the tunnel was found during the clearance of the compound or while the SSE process was being undertaken.”

There’s a private girl’s school on Sydney’s north shore that currently has quite a few girls “identifying as boys”. I know this because a friend’s daughter is at the school. A lot of this gender gunk is a contagion, particularly among girls, it the 2023 anorexia nervosa for young girls. However, as Sancho said above, you can’t just blame the school, it’s also dysfunctional homes and parenting. Oh and this friend made the mistake of misgendering one of her daughter’s friends, she was asked to apologise and she said NO.

Pity that most families don’t have one or even two high income earners able to absorb the cost of private schooling or a private tutor. If both parents work, then homsechooling is also out of bounds.

If you want an animal to live in this corner of the universe with others of the same species, and with a sufficiently complex language, then that corner of the universe will select preferentially those animals which have a moral capacity. We are designed by the corner of the universe we live in. A social system may keep reality at bay for a time, but you can’t beat the universe. The laws of nature are not altered for the convenience of man, neither those of the physical world outside our skin, nor those which operate inside us.

We are not the only moral animals on this ball of floating rocks. Morals didn’t emerge in an evolutionary vacuum. A social system that arises as a product of natural selection needs a moral structure so that the group dynamic is optimised. Whether other animals consciously make moral judgements we don’t know. For a very long time the assumption was consciousness is specifically a human trait. That has taken serious hits in recent decades with most now admitting there is some type of consciousness there. Google it, many fascinating studies there. That or buy a dog. Dogs, like individuals with William’s Syndrome, are loaded to the hilt with oxytocin and in both humans and dogs oxytocin is a hug hormone.

Yeah, John H. I haven’t read studies about it. I’m of the opinion that self awareness is also related to spatial awareness in the context of where and how say a dog fits into it’s environment. Animals are certainly spatially aware and therefore to a large extent self aware too probably.

Some of this self awareness is missing in humans though. You quite witness the absence by certain people on this blog. 🙂

Re private tutors:

You don’t need one for all hours, all days. They’re actually affordable, given the cost of uniforms, voluntary and compulsory fees, TAS fees, sports fees, excursions…

The problem is for example in the ACT, the town council makes you supervise the tutors! Given you need a decent income to live in Canberra and it has a private sector dwarfed by the government and well-paid government officials, it tends to be only possible for the top officials and (much smaller segment of) elite business owners. If you’re a widow, forget it!

There’s a private girl’s school on Sydney’s north shore that currently has quite a few girls “identifying as boys”

I asked the granddaughters about this when they came home from their private, Christian school today. “Nah,” says #2 (16 yo), “we don’t go in for all that.” She went on to say that maybe three girls (out of 1,000 students) state that they’re trans and want others to use they/their pronouns. “No one does, apart from their friends. Mostly people just ignore them.”

Imagine if everyone did that, as happened in the past. Or perhaps it’s too late now in this post Christian world of grifters, attention seekers and scoundrels.

Biden’s 2024 Hail Mary: Name Barack Obama as His Running Mate?

President Joe Biden’s stumble across the stage after speaking at the Air Force Academy on Thursday will certainly feature prominently in Republican campaign ads aimed at reinforcing the theme, already gnawing at even his most ardent supporters, that Biden is too old and frail for another four years. The unpopularity of backup, Vice President Kamala Harris, only aggravates the problem.

You know, the constitution may not prevent this from happening. I don’t think the Kenyan would play second fiddle the the Crook, but in desperation you never know.

What the constitution actually says.

At first blush, the 22nd Amendment might be thought to preclude Obama from being on the 2024 ticket. That amendment provides: “No person shall be elected to the office of the President more than twice …” (emphasis added). While Obama is precluded from ever running again for election as president, the amendment does not prohibit him from running for any other office, including vice-president.

Nor does the last sentence of the 12th Amendment disqualify him. It stipulates that “no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States” (emphasis added). For several reasons, this requirement does not expand Obama’s inability under the 22nd Amendment to run for election as president.

First, the 22nd Amendment was adopted to address a single, perceived problem — Franklin D. Roosevelt’s decision to run for reelection to a third and then fourth consecutive term as president. Thus, it bars two-term presidents only from being “elected to the office of President.” It says nothing about running for, and being elected to serve, as vice president.

Second, the 12th Amendment regulates voting by members of the Electoral College. The “constitutionally ineligible” clause ensures that the electors may not vote for someone who does not meet the qualifications for the presidency set forth in Article II of the Constitution, which provides only three requirements to be “eligible” to become president: “No person except [i] a natural born citizen … shall be eligible to the office of President; neither shall any person be eligible to that office [ii] who shall not have attained to the age of thirty five years, and [iii] been fourteen years a resident within the United States” (emphasis added).

Despite the fictitious “birther” theories concocted when Obama first ran, Obama meets the three constitutional tests of “eligibility” set forth in Article II — age, native citizenship, and residency. As with the scenario that I propose for Biden and Obama to consider, there are other paths to an Obama return to the presidency that the 22nd Amendment would not bar, thus confirming that he is eligible to run in 2024 for vice president.

For example, a former president is surely entitled to run for Congress, as former president John Quincy Adams did in 1830. Nothing in the Constitution would prevent such a senior statesman from being selected as Speaker of the House. Reflecting the status of the Speaker in the line of presidential succession since 1792, the Presidential Succession Act of 1947 makes the Speaker second in line to replace a president who dies in office. If both the president and the vice president were to die, the 22nd Amendment would not block a former president then serving as Speaker from succeeding to the Oval Office again.

Similarly, a person in Obama’s position would be “eligible” for nomination to fill a vacancy in the office of vice president under the 25th Amendment, which contains open-ended authorization to select a vice president. Whenever there is a vacancy in the office of the vice president, “the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.” Nothing suggests that a former two-term president would not be an otherwise “eligible” candidate for the vice presidency in such a process.
