An ex-juror at the trial maintains the jury was stuck at 11-1 for acquittal, prior to the “juror misconduct” (cough.. cough..) event, which always smelt fishier than a whores’ convention in the Tropics.

If she doesn’t, this could work against her; (for the lawyers here, via Jones v Dunkel reasoning). Lee J’s ruling looks quite critical. However for reasons that might be obvious, Whybrow KC has gained some ground just by trying to get this evidence in.

Secondly, Whybrow (in Higgins absence) advanced a theory that Higgins was happy that there was no second criminal trial because she saw that that she had a better chance of being vindicated by a justification defence on a defamation claim. In turn, this would be to her financial advantage. His theory makes sense, and Lee J needs to rule on whether he can go ahead and cross-examine Higgins. So far, he’s expressed doubts.
