My Mini restorer pal seemed to want a British Racing Green body with a black top. Some later reincarnation, I suppose.

It should be pointed out that while Minis (especially Cooper S’s) went like the clappers at first, they didn’t age well. They were better than Triumphs, which were even worse.

Sadly, many of the Minis when they were fashionable were shoddily constructed pieces of shit.

Here’s the issue : over the past decade or so, there have been around 10 or so blog “deaths” where we subsequently find out it’s a version of the walking dead. In other words, dead zombies who are still around alive . Amazing how many people have feigned deaths at the Cat and elsewhere. There was a famous non death death on Blair’s blog a while ago.

The old Professor’s alter ego – the woman who had genital warts suddenly died one time catching left-wingers by surprise.

One of the more famous ones was my carbon slave who conveniently died at the most convenient time.

Now if the ATO wants to see evidence of death with a properly certified death certificate then why can’t an individual ask for the same.

I’m always sceptical of inconvenient convenient stories. I’m not saying it’s not true, but I’d really like to trust but verify knowing the source.

Austin definitely stuck to the marital and ‘visiting’ issues of the landed gentry (even Mr. Bennet had an Estate) but also recognised the changing milieu that introduced into the old ‘church or army’ traditions of younger sons the new wealth coming from trade and manufacturing. Rich heiresses of more dubious ancestral provenance were highly sought after to improve social positioning, whereas at a later stage in the economic transition (after the rise of the American superrich in the late C19th), the tables were turned, and it was rich American heiresses who sought to improve their position by marrying into the British aristocracy – in what became Cash for Coronets in the general parlance (I wrote a review in Quadrant of the book “The Husband Hunters” which detailed this later period).

Austen was writing about those clinging to ancient ‘connections’ (see Ellie Dashwood on these), and the mingling of older wealth with newer wealth. In ‘Emma’ and elsewhere, she included struggling older women, widowed, or who never married, and who had fallen down the scale in material style but who were still included in the social round because they were ‘gentry’ (indeed, a charity in Britain still provides discreetly for ‘distressed gentry’). She was well aware of impecunious not-quite-gentry, such as Wickham in P and P, who were trying to marry well and improve social status.

In Emma, Austen tries to line up an orphan girl she believes to be ‘gentry’, because someone is paying her school fees, with a man of ‘equal station’, but Austen winds up that tale by putting that girl firmly into her proper class as her non-gentry status is revealed and lo! she ends up marrying the solid farmer whom she has convieniently loved all the time. The well-off farmer and his family are notably below the status of Emma’s circle and of course they never mix.

The emerging middle classes of professionals and tradesmen are introduced to such circles slowly and only if they are wealthy. The TV series ‘Belgravia’ looked at these distinctions as the wealthy and the artistocracy started to blend in Austen’s day in the cities; but aristocracy still dominated and ruled.

The upper middle classes living in comfortable circumstances started to define themselves by education (Oxbridge), manners and most particularly by accent into a large class that was positioned well above the ‘ordinary’ middle classes of lesser professionals, who in turn positioned themselves well above the Mrs. Bucket class of aspirant lower middles who aped accents and manners but always got them wrong.

I am returning to the remnants of this class based structure at the end of the month.
Luckily I have the right accent for it. Still counts these days, but far less than it used to do.
It is a fascinating zoo to study and in some ways take part in.

The Benefits of Walking

Walking can add minutes to your life. This enables you at 85 years old to spend an additional 5 months in a nursing home at $5,000 per month.

My grandmother started walking five miles a day when she was 60. Now she’s 97 years old and we don’t know where the hell she is.

The only reason I would take up exercising is so that I could hear heavy breathing again.

I have to exercise early in the morning before my brain figures out what I’m doing.

I like long walks, especially when they are taken by people who annoy me.

I have flabby thighs, but fortunately my stomach covers them.

The advantage of exercising every day is that you die healthier.

If you are going to try cross-country skiing, start with a small country.

Continuing my UK Nanny rant, I was pulled over by one of Cressida’s finest girlies for the crime of having overtaken a bicycle. No matter that I used the empty on-coming lane to do so.
Hertz County in an effort to make it impossible for vehicles to operate in metropolitan areas have made it legal for any Green rsole to bank up traffic for miles by riding in the middle of the lane.
The daily 7am convoy delivering the commuter stiffs to the railway station has become a nightmare.

As everyone knows, parking in the UK is one of the most successful Government scams on the planet.
Even if you can find a park, you will probably get fined because the rules are incomprehensible, or the parking rules sign is hidden away in the next borough.
The Green morons have added to the chaos by putting free EV charging parks all over the place, but mostly in the most popular parking areas.
Clever commuters returning from the City after 8pm have taken to plugging in with the charge circuit switched off, knowing that the parking filth don’t work at night.
Malicious damage and occasional fisticuffs have resulted apparently.

Funny about that Matrix – as I have noted, I tried more than once to get us all on the same side, but St Ruth would have none of it. Hence the “abandonment” – there are limits to even my patience, and he surpassed them, being constitutionally incapable of any sort of compromise.
So if you want to say I abandoned it, well yes I did – with good reason.
If you would like to chat about how we can go about fixing it so this sort of thing doesn’t happen again, I’m in. If you just want to fling abuse, threats etc or tell me a made a mistake blah blah, and not actually become involved in doing anything constructive, count me out.
Pretty simple really.
And to be honest, anything constructive would likely be appreciated by many others who frequent here, IMO.
But if it’s just complaints and abuse, I’ll either ignore you or send it back at you, depending on my mood at the time. Fair, I think.

BHP expects the $40bn merger of its petroleum business with Woodside Energy will complete by June and has flagged an in-specie fully franked dividend of Woodside shares to its investors.

BHP is expected to receive 914.8 million newly issued Woodside shares at completion, it says in a note on Friday.

The mining giant’s shareholders will get one Woodside share for every 5.534 BHP shares they hold on the record date.

Based on Woodside’s share price of $US25.55 on April 6, the implied value of BHP Petroleum is $US23.4bn.

“At this valuation, which is subject to change, the in specie dividend per BHP share would be $US4.62, with $US1.98 of franking credits being distributed per BHP share ($US10bn of franking credits in total),” BHP says.

Woodside will retain its primary listing on the ASX and is seeking a standard listing on the LSE and a sponsored Level III ADR program on the NYSE from completion of the merger.

This one is a really interesting “policy” as it has very important foreign exchange implications. In order for PM Big Fat Clive to ensure the policy works, he would have to impose foreign exchange controls. which means there would be all sorts of prohibitions on what you’re allowed to do overseas.

Out of all the three we’ve discussed this policy is the funniest of all.

Exchange controls would mostly likely have to be copied from Argentina.

Those controls limited the ability to buy or sell any foreign currency. The restriction was informally known in Argentina as “Cepo cambiario” (Spanish: exchange clamp).

The first restrictions were imposed on October 31, 2011. The Tax and Customs Authority, AFIP, required that individuals and businesses who sought to buy dollars request permission, which may depend of the financial status of the buyer. However, the implementation of the rules was arbitrary. In February, restrictions were applied to all international payments in dollars, such as imports. This also affected the ability of foreign investors to return their earnings to their own countries.[2]

The use of credit cards abroad was also restricted. As of May 2012, people could only buy dollars for 25% to 40% of their wages.[2]

In June 2012, AFIP forbade the purchase of dollars, except for a limited number of activities. As the country had a high inflation at that point, people used to buy dollars to keep the value of their money. The use of dollars for tourism received more limits a couple of months later: people would only receive the local money of the country that they visited, and only 7 days before the trip.

On Monday I appeared in the New South Wales Local Court again in relation to Garry Burns’ complaints against me.

It was a tense day and I wish to report to you the facts of what occurred. I will not provide any commentary.

I moved a motion to have the magistrate in these proceedings dismissed on the grounds of apprehended bias. My motion was unsuccessful.

The background to my motion for apprehended bias is as follows.

On 16 August 2021, the magistrate ruled that she had retrospective power under Part 3A of the NCAT Act (passed in New South Wales in December 2017) to hear Burns’ complaints against me (for my conduct in Queensland between mid-2014 and early 2015).

On 13 September 2021 my solicitor filed an appeal to the above decision in the New South Wales Supreme Court.

On 14 September 2021 my solicitor served a copy of this appeal on the New South Wales Local Court, as required under legal rules. This appeal is running but will not be heard until the Local Court determines Garry Burns’ complaints against me. At no stage have I ever sought an adjournment to the proceedings in the Local Court in relation to this appeal and nor have I ever used this pending appeal in an attempt to delay proceedings in the Local Court.

On 19 November 2021, while the Local Court was taking evidence in relation to Burns’ complaints against me, the Local Court registry, of its own volition, notified the magistrate of my appeal to her decision that she had retrospective powers to hear Garry Burns’ complaints against me.

Court transcripts show the following statements were made:

HER HONOUR: I really want to know why it is that when the hearing has just commenced that this is copied off and given to me by my court officer and I mean, I just wonder what sort of practices are going on. Is this an attempt to intimidate me or bully me into not continuing?

GARRY BURNS: …I don’t – I can only see it as an intimidation, your Honour. I’m sorry, that’s what I see it.

HER HONOUR: And I’m certainly not intimidated by it if that was its–

HER HONOUR: No, this email’s – anyway, I’m not going to allow it. Much that [Mr Gaynor’s solicitor] will be disappointed, but I am not going to allow it to intimidate me or to worry me any further. But he certainly is behind bringing this to my attention.

On 21 December 2021, Garry Burns sent an email to my solicitor, my barrister and a third party stating that he had lodged a complaint against my solicitor with the New South Wales Law Society:

I allege you have failed your responsibilities as an Officer of the Court.

I have further alleged to the NSW Law Society that you were in Contempt of Court when you filed your incongruous Summons seeking leave under part 50 ( which will be refused ) in the Local Court proceedings before [the magistrate] because the Magistrate had to stop hearing the proceeding to address the filing of that material.

The Magistrate formed a view that you did this to INTIMIDATE her. I have no doubt the Law Society will obtain a copy of the transcript in its investigation of you in regards to your conduct regarding the filing of that material.

On 9 February 2022, in a procedural hearing in relation to my appeal to the retrospectivity decision, Garry Burns stated to the New South Wales Supreme Court:

As I understand it the solicitor for the respondent below filed these proceedings in the Court matter below where the magistrate had to stop the proceeding to deal with that matter and formed the view that the solicitor for the respondent in the Court below did that deliberately to intimidate her.

On Monday the magistrate unreservedly withdrew her comments about my solicitor and any imputation falling from them that he had (or, by implication, that I had instructed him to):
directly communicated with the magistrate;
attempted to threaten, bully or intimidate the magistrate;
sought to bring the appeal to the magistrate’s attention via the Local Court registry in the middle of proceedings on 19 November 2021;
sought to use the appeal to delay proceedings in the Local Court; or
communicated in any way with the Local Court registry about the appeal other than in accordance with legal rules requiring him to serve the registry with a copy of the appeal filed in the Supreme Court.
To the best of my recollection, the magistrate described her now withdrawn statements about my solicitor as ‘unfortunate’, ‘regrettable’, ‘intemperate’, ‘emotional’ and ‘wrong’.

On the basis that she had withdrawn her comments, the magistrate then asked if I would be willing to withdraw my motion that she recuse herself on grounds of apprehended bias. I instructed my legal representatives that I was not prepared to withdraw my motion.

I believed that simply because the magistrate withdrew baseless statements that she now admits were intemperate, emotional and wrong did not remove any concern about the appearance of bias. I also believed that these concerns have only grown due to the fact that Garry Burns has used these baseless statements from the magistrate to attack my solicitor with yet another complaint to the NSW Law Society.

The leading High Court case in relation to the question of apprehended bias states:

…a judge is disqualified if a fair-minded lay observer might reasonably apprehend that the judge might not bring an impartial mind to the resolution of the question the judge is required to decide. That principle gives effect to the requirement that justice should both be done and be seen to be done, a requirement which reflects the fundamental importance of the principle that the tribunal be independent and impartial. It is convenient to refer to it as the apprehension of bias principle.

The apprehension of bias principle may be thought to find its justification in the importance of the basic principle, that the tribunal be independent and impartial. So important is the principle that even the appearance of departure from it is prohibited lest the integrity of the judicial system be undermined.

While waiting for the magistrate to hear our motion, Garry Burns berated, ridiculed and abused me and my legal representatives. His diatribe went on for over 30 minutes. At one point he made the following comment (to the best of my recollection):

As for your client, if I succeed and obtain damages, I will hunt him down. I don’t need the money but I will hunt him down for every cent just because I can.

Garry Burns then got up in front of the magistrate and began sobbing, arguing that it would be unjust for her to recuse herself from these proceedings. I have never seen anything like it.

The magistrate did not retire to consider the arguments put to her. Instead, she immediately ruled that the fact that she had made ‘wrong’, ‘emotional’ and ‘intemperate’ remarks alleging that my solicitor had sought to intimidate or bully her or that Garry Burns had used these remarks to lodge a complaint against my solicitor could not in any way lead a fair-minded lay observer to conclude that she might not bring an impartial mind to this case.

As I do not yet have a copy of the reasons for the magistrate’s decision, I will not attempt to outline the basis of her decision here.

The magistrate then ordered that submissions be filed so that she could determine Garry Burns’ complaints against me. A decision will be handed down later this year.

I have instructed my legal representatives to appeal Monday’s decision and to take other action which I will not detail here. But there are significant issues which now need to be addressed and I will explain them at the appropriate time.

Here’s what I have done for my country, Struth.

I have refused to take the experimental gene therapy concoction because of State and Federal government insistence. Because of the provisional approval. Because of the mandates. Because of serious side effects. (I have friends who have suffered but HAD to take the concoction for various reasons. Economic survival being one of them!) You can add me to your list of those not submitting to boosters.

Three newspapers defending a defamation suit brought against them by war veteran Ben Roberts-Smith have alleged the decorated former soldier and four of his prospective witnesses appear to have colluded to give false evidence in the case.

The allegation prompted a furious response from Mr Roberts-Smith’s barrister, Arthur Moses, SC, who told the Federal Court on Friday it was baseless and may prejudice the court and the public by suggesting the witnesses were involved in a conspiracy. He accused the newspapers of “throwing allegations around like confetti”.

Mr Roberts-Smith is suing The Age, The Sydney Morning Herald and The Canberra Times for defamation over a series of articles in 2018 that he says portray him as a war criminal who was involved in the unlawful killing of Afghan prisoners.

The newspapers are seeking to rely on a defence of truth. They applied on Friday for access to documents related to the preparation of written outlines of evidence anticipated to be given in court by Mr Roberts-Smith, who appeared in the witness box last year, and four witnesses expected to be called by his legal team this year.

Mr Roberts-Smith’s lawyers say the documents are covered by legal professional privilege and cannot be produced. But Nicholas Owens, SC, acting for the news outlets, said the documents may shed light on an alleged fraud or impropriety, and the court should order that the material be produced.

Mr Owens said the five outlines contained “a highly specific, and we will say false, account of a material matter” in the case, which provided a “negative alibi” for a soldier in the Afghan partner force dubbed Person 12.

The newspapers allege Mr Roberts-Smith directed Person 12, via an interpreter, to shoot an unarmed Afghan prisoner in October 2012. The rules of engagement provide a killing in those circumstances is murder.

Mr Roberts-Smith denies the allegation and had said in his outline of evidence that Person 12 was not on the mission because he had been stood down from the Afghan National Army earlier that year for wounding a soldier by shooting at a dog.

The proposed evidence about Person 12 was offered as a “knockout blow” to the newspapers’ allegation, Mr Owens said.

But Mr Roberts-Smith conceded in court on June 11 last year that his explanation about Person 12 being stood down was wrong, based on material produced by the Defence Department on the eve of the trial. He maintained the Afghan soldier was not there.

Mr Owens said each of the other four witnesses proposed to be called by Mr Roberts-Smith gave a similar account in their written outlines of evidence about Person 12 being removed from the Afghan National Army.

He said there was “no explanation” for the similarity in the proposed evidence that was “consistent with coincidence or innocent mistake”, and it raised a prima facie case of impropriety. Mr Owens said the lawyers in the case were not accused of wrongdoing.

“The concept of fraud in this case is not the traditional, specific concept of fraud; it’s a broader concept,” he said.

“We say it’s easily wide enough to encompass the situation of multiple witnesses colluding together.”

Mr Moses said witnesses may have the same “innocently mistaken” recollection, and it did not mean they were “perjurers or are lying”.

“Behind every tree there is a dark shadow, according to the [newspapers], so they think the worst,” Mr Moses said.

He said the newspapers had “pulled the trigger prematurely” and should have waited to put the allegation to the witnesses in court. The allegation had not been put to Mr Roberts-Smith last year, Mr Moses said.

Justice Wendy Abraham is considering the application for access to documents, rather than the trial judge, Anthony Besanko. Mr Moses said it will be up to Justice Besanko to determine if Person 12 was in fact present on the mission in question.

Mr Owens said it could be accepted that one person might have a faulty memory but it was “utterly inconceivable” that five people would make the same “highly specific and demonstrably wrong error” about Person 12.

He said the newspapers did not need to prove fraud or illegality to be granted access to documents that would otherwise be covered by legal professional privilege, and only needed to establish a prima facie case.

“We don’t have to exclude innocent mistake,” he said.

Mr Owens said Mr Roberts-Smith’s legal team had not suggested the evidence proposed to be given by the other witnesses would differ from their written outlines, and there had been no indication of any additional evidence.

He said Mr Roberts-Smith’s barrister, Bruce McClintock, SC, also said in his opening address to the court last year that Person 12 was not on the mission in question.

Justice Abraham will deliver her decision on the newspapers’ application at a later date.

“The parties will be notified when I am in a position to deliver judgment,” she said.

Ordering a book the other day and the chick was asking me for a mobile number. I don’t go out much, although coming up to a semi-regular pub time of year. I might have to try to slip in unjabberated, with a nod to the quiet-time skeleton staff.

Had lunch in an Asian restaurant today.
Sitting too close to a slightly too loud female and her chime in only to agree male companion, (probably too loud for our benefit).
Only halfway though through her on-line training she was an expert on anti racism, she said so.
One can only be one or the other, a racist or an anti racist and every day one must examine one’s self for racist content. She was engaged in designing cultural appropriate something for some speaker, also mentioned more than once along with comments about the tediouty of dining with little people.
Several times we heard spring rolls were white people food in such an establishment (yes we’d ordered some for the little person) all in all impossible to drown out so we hastened to eat up and get out.
A pity anti racism didn’t extend to saying please to your Asian waitress.

Another one of my favourite English novelists is Elizabeth Gaskell.

Gaskell is very satisfying. Cranford, her best work, was made into a very nice series. So was North and South another fine novel and series. If you want to really read a popular at the time female novelist get hold of Charlotte Mary Yonge although beware her high church moral base can be irksome although well intended. She was enormously popular.

John Quigley ‘corrects’ evidence in defamation case involving Clive Palmer and Mark McGowan

WA’s Attorney General has denied evidence he provided to the high-profile defamation trial involving Premier Mark McGowan and mining magnate Clive Palmer can’t be relied upon.

Mr Quigley has sought to correct evidence he gave to the Federal Court, saying his busy work schedule as a politician may have contributed to him forgetting the date he found out that Mr Palmer had not registered crucial arbitration, which could have led to a massive damages claim against the state.

Mr Palmer was pursuing damages, potentially worth $30 billion, over the previous state government’s refusal to assess the Balmoral South iron ore project in the Pilbara.

Mr Palmer is suing WA Premier Mark McGowan over comments made in 2020, including Mr McGowan’s claim he was an “enemy of the state” due to his legal challenge of the state’s border.

Mr McGowan, in turn, is countersuing Mr Palmer, claiming he suffered reputational damage through claims he “abused the parliamentary system” and lied to the people of WA.
Mr Palmer’s legal team has been arguing the Premier had shown malice towards their client by deceitfully plotting to “torpedo” the arbitration in 2020, when the government introduced extraordinary legislation designed to prevent Mr Palmer from pursuing the damages claim against WA.
Today, Mr Quigley returned to the Federal Court in person to correct evidence he gave last month, telling the court he was mistaken about the timing of when he first found out about Mr Palmer’s damages award not being registered.

Mr Quigley gave evidence on March 9 regarding an interview on ABC Radio on August 13, 2020, during which he talked about the government’s intention to use legislation to head off the possible claim against the WA.**

Mr Quigley told the court his previous evidence, when he said he first knew about the failure to register the award on August 12 or 13, was wrong.

He said he actually became aware before a cabinet meeting on August 11, though he could not specify how long before.

The Attorney General said that after he gave evidence last month, he was told by his Chief of Staff that he might have been wrong, and he called for the cabinet file to be retrieved to help him refresh his memory.

Mr Quigley said he’d been under “a lot of pressure” working hard as a parliamentarian and a minister, and referred to having been served with a $50 million writ by Mr Palmer, who was claiming he was involved in a conspiracy against him.

Counsel for Mr Palmer, Peter Gray SC, asked Mr Quigley how long it was before the cabinet meeting on August 11, that he knew of the risk that Mr Palmer could get the arbitration registered.

Mr Quigley said he couldn’t recall, but he “wouldn’t say months”.

The Attorney General also couldn’t recall whether he’d done any checking before he swore his affidavit, and was taken to task about answers he gave in March, which he now admitted were wrong.

Mr Gray asked Mr Quigley: “Do you agree nothing you say in the witness box can actually be relied upon?”, to which the Attorney General answered: “No”.

Justice Michael Lee described Mr Quigley’s evidence as “not dishonest, but all over the shop.”***

Another one of my favourite English novelists is Elizabeth Gaskell.

Yay, Cassie, you too? She was still just the ‘minor, unrecognised’ Mrs. Gaskell when I read some of her works in the 1960’s going through a nineteenth century novelists phase (never enrolled in English at uni, so self-taught in that). I also read Disraeli’s ‘Two Nations’; interesting politically but not a great writer. Hardy, Austen and Eliot my choice in that English century. Bronte sisters, read some of them, but I think the stir-craziness of living in that unhealthy old Rectory where everyone died from the sewage seep from the graveyard above must have done things to their minds.

BoN, I’m heavily involved & have been for years, in the politics of temporary entry workers, both sponsored & working holidaymakers. (Hence I know the theme of fruit pickers paid $2 per hour is complete bullshit)
Lately all the literature is ramming home the concept of “pathway to citizenship” even for a pacific islander who comes to pick mangos, then goes home with the money (i.e. grubstake) to set up his family future.
This pathway to residency seems to have become an object of faith, even for visas that don’t really call for it, or require it.
A wall of sinister silence meets anyone who makes an objective effort to find out what it is all about.
